Rental Agreement Terms and Conditions for Emerald Waters – Lakefront Mountain Chalet

This rental contract is a legally binding document, please read it carefully.

Person/s accepting this electronic agreement shall hereafter be known in this agreement as "LESSEE".

Lakeside Partnership Properties, LLC hereafter known as “LESSOR” enter into this agreement with lessee for the short term rental of the property known as Emerald Waters – Lakefront Mountain Chalet. Located at Property Parcel ID: 078019 04214

Lessee understands that Damage Protection will be written in the lessee's name and a copy of said policy will be emailed to lessee. The damage protection is coverage for the rental property only and does not cover personal belongings of the Lessee. Lessee understand that Travel Insurance may be purchase independently to cover travel related incidents. Lessee agrees to report any accidental damage to Lessor IMMEDIATELY, by contacting Lessor at the phone number provided in the Lessee's Welcome Documentation. Lessee also understands that this policy does not cover:

a) Acts of God

b) Intentional acts of theft and/or damage.

c) Gross negligence, willful and wanton conduct by an insured person.

d) Any cause, if the insured does not report the loss or damage to the lessor of the rental property.

e) Loss of use of the rental property

f) Theft or damage to any property owned by or brought by an insured person onto the property.

g) Theft or damage caused by anyone visiting other than an insured person.

h) Theft without a valid police report, unless the damage is caused by an insured person.

i) Damage or theft if the number of persons occupying the property exceeds the units occupancy limit or pet damage in a non-pet unit.

I. CLEANING /RESERVATION DEPOSIT:A reservation deposit of ($125) one-hundred twenty five U.S. dollars is required to secure the property reservation. This reservation payment must be made with a valid credit card to be put on file in the event of damages to the property. We will not accept a reservation without receipt of a deposit. Your deposit constitutes acceptance of these Terms and Conditions. The reservation deposit automatically converts to your cleaning fee upon arrival. The fee is use to clean the property after your departure and is not refunded.

II. CREDIT CARD AUTHORIZATION FOR DAMAGES NOT COVERED BY DAMAGE PROTECTION : Lessee consents to and understands that the provided credit card, without an original signature on the charge slip, will be charged for damages, stolen items and excessive cleaning fees if the following provisions are not met by the renting party. This credit card authorization cannot be revoked and will not terminate until 40 days after leased premise is vacated. Acceptance of this reservation constitutes acceptance of these terms.

a) No damage is done to the property or its contents, beyond normal wear and tear.

b) No illegal activities or substances are conducted on or brought onto the property.

c) No pets, pet oder, pet hair, smoking, or smoke oder within the walls of the property.

(see section III 2 and 3)

d) Reservations are not falsified. (see section III. #6)

e) All doors and windows are left locked and alarm system is left on when you depart the property.

f) Locked cabinets are left as is and no items are removed.

g) Departure checklist is completed by lessee. (see section III. #11)

h) No items are removed from the property.

i ) No long distance calls are made from the properties telephones. (see section III. # 12 b.)

III. TERMS/CONDITIONS/ AGREEMENTS

1. CHECK-IN/OUT/ Lease Term

Check-in time: is 3:00 p.m. on the first lease day.

Check-out time: is at 10:30 a.m. on the last lease day.

Late check-out: Persons opting for Late Check-out, by choosing the late check out option during booking, must depart the property by 12:00 p.m on the last lease day. No late check-outs will be accepted after the initial reservation is made.

Lease Term: Lessee agrees that access to the property, including decks, land and boat docks, is limited to the time period set forth in the lease agreement. Lessee may not use or enter the property at any time before or after check-in / check-out and shall be considered trespassing and subject to legal action shall this occur.

2. NON-SMOKING POLICY - NO TOLERANCE NO EXCEPTIONS!

There is NO SMOKING allowed inside the property. Smoking is designated outside only. Lessee agrees any smoking within the walls of the property will result in damage fees of ($300) three hundred dollars which will be charged to renter/s credit card. Any smell of smoke in the house will result in this fee being charged. To avoid this charge make sure all doors and windows are closed when you smoke outside to prevent smoke from entering the home. Empty ashtrays into bags in the OUTSIDE trash cans only. Emptying cigarettes in the inside trash will make the property smell as if it was smoked in.

3. NO PET POLICY- NO TOLERANCE NO EXCEPTIONS!

This is an allergen friendly home and NO PETS OF ANY KIND ARE ALLOWED ON THE PROPERTY. Bringing pets to this property presents a serious health risk for those with allergy induced asthma expecting to stay in an allergy friendly home! Lessee agrees that no personal pets shall be brought to the property including indoor and outdoor areas. Failure to comply with this policy will result in a ($300) three hundred dollar damage fee, charged to your credit card on file. Any evidence of a pet being brought to the property will result in this fee being charged! Note: See our video surveillance policy in section #25.

4. LAKE LEVEL POLICY:

Lessee understands Douglas Lake water levels are controlled throughout the year by the Tennessee Valley Authority. The lake levels at Douglas Lake vary about 41 feet over the course of a normal year. Water levels begin dropping in late summer to provide space for the next spring’s rains. Lessor can not be held responsible for the water levels effect on docks, views or recreational activities such as swimming, boating or fishing. The water is typically low from the months of September through the beginning of May.

5. MINIMUM AGE REQUIREMENT:

Tennessee law requires lessee be of a minimum age of 21 years old. We can not lease to anyone under the age of 21. Lessor reserves the right to refuse service or rental to anyone at their complete discretion

6. FALSIFIED RESERVATIONS:

Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money. Persons will not be permitted to check in. If lessee has already occupied the property, expulsion will be immediate and without notice. No refunds will be issued. If after check-out it is discovered that the number of persons listed on your lease agreement were falsified, your credit card will be charged the appropriate fees.

7. PAYMENT:

Upon your reservation your $125 reservation deposit is due by credit card. The advance payment will be applied as your cleaning fee upon your arrival. The BALANCE OF RENT including tax, is due thirty (30) days before your arrival date. Reservations made less than thirty (30) days in advance are required to pay the total balance at the time of booking. Payments may be made in the form of Visa, Master-card, or American Express through our online booking system. Persons wishing to pay their remaining balance by check must contact us directly, and all rent by checks must be received sixty (60) days prior to check-in.

8. CANCELLATIONS/ REFUND POLICY/ TRAVEL INSURANCE

a) Cancellation made 60 days before check-in.

Cancellations that are made more than sixty (60) days prior to the arrival date will incur a ($50) fifty dollar cancellation fee.

b) Cancellations made between 59 - 31 days prior to arrival date.

Cancellation made between 59 days and 31 days prior to check-in will forfeit the advanced payment of $125 dollars.

c) Cancellations made less than 31 days prior to arrival date.

Cancellations made less than 31 days prior to arrival date are responsible for paying the full amount due and no refunds will be issued.

d) Changes that result in a shortened stay or early departure does not warrant any refund of rent or deposit.

e) It is your right to purchase travel insurance.

Travel insurance is short-term insurance available specifically against travel-related emergencies and expenses. Travel insurance will often cover expenses related to unexpected cancellations, costs associated with a canceled flight, including accommodation, meals and other incidentals.

9. MAXIMUM OCCUPANCY:

The maximum number of guests per cabin is limited to ten (10) persons. Six (6) adults is the maximum number of adults this cabin can accommodate, the remaining persons must be children under the age of fifteen (15) as the bunk room is not intended to sleep full sized adults.

10. MINIMUM STAY:

This property requires a 2 night minimum stay.

11. DEPARTURE CHECKLIST:

Our cleaning service provides general cleaning. Upon your departure you are asked to complete the following.

a. Load all dirty dishes/utensils in dishwasher and start dishwasher.

b. Place all soiled bath lines in bathtubs.

c. Place all trash in appropriate outside containers (All trash must be in a bag)

e. All smoking materials are extinguished and empty into appropriate trash containers OUTSIDE

f. Place general items away, i.e. Remotes, toys, DVD’s, games, etc.

g. Remove food items brought to the property from cabinets and refrigerator

h. Temperature control should be set to temperature listed by thermostat.

i. Lock all doors and windows

j. Arm alarm system

12. ADDITIONAL FEES:

Additional fees not included in the rental rate are as follows:

a) All rental rates are subject to a 13.75% sales and lodging tax. This charge will be added to the total rental rate and is due with your final payment.

b) Lessor provides free local telephone service:

In order to keep rates low, lessee will need to make all long distance calls by use of a telephone calling card. Any long distance charges presented during your stay will result in an administration fee of ($20) twenty dollars, plus long distance charges, charged to the credit card on file. Any long distance calls made to the lessor are exempt from this policy.

c) Excessive Trash.

This unit does not have a scheduled trash pick-up. Our service personnel remove your trash after your departure. The amount of trash removed without charge is limited to eight (8) thirty gallon (30 gal.) bags. After that, the charge for removing trash is ($5) five dollars, per bag, to be charged to the credit card on file. If you are staying for an extended period and need to dispose of trash, you may do so by dropping your trash, free of charge, at the trash collection area at 766 Allensville Rd. They are open Monday - Saturday 6 a.m. to 6 p.m.

d) Coupon Terms:
During the Online Booking process, enter the Coupon Code exactly as it appears, using upper and lower case (it is also space sensitive). Codes can be redeemed for a discount during initial purchase through our online booking system. Online special coupons may be redeemed during booking before expiration with the following conditions:

Only 1 coupon may be used on any order.

Promotions may not be combined.

Coupons may not be used on prior orders.

Coupons are valid only for new orders.

Coupons may not be split between 2 or more orders.

Coupons must be redeemed, in their entirety, in one order.

Minimum purchase or stays may be required to redeem coupons.

Some Coupons may not be valid during Holidays

13. NO DAILY MAID SERVICE:

There is no daily maid service. Your reservation fee automatically converts to your cleaning fee upon arrival. This fee is used to clean the property after your departure.

14. RATE CHANGES:

Rates subject to change without notice. Any confirmed reservations are locked in at the quoted rate.

15. WRITTEN EXCEPTIONS:

Any exceptions to the above mentioned policies must be approved in writing in advance.

16. PARKING:

Parking is limited to (4) four vehicles. Vehicles are to be parked in designated parking areas only. Parking in undesignated areas is not permitted. Please do not block the circle drive.

17. Hot Tub Rules: When using the hot tub, remember there is certain health risk associated with this facility. Use at your own risk. Our housekeepers drain, sanitize, refill and replenish chemicals in hot tub prior to your arrival; therefore, it may not be warm until later that evening. Hot tub covers are for insulation purposes and are not designed to support a person or persons. DO NOT STAND OR SIT ON THE HOT TUB COVERS, they will break and you will be charged for a replacement cover. Replacement cover cost will be in the amount of $350 (three hundred and fifty dollars). High bather loads can displace water in the hot tub. Never allow the water level to drop below the jets, as this will render the hot tub inoperable. Remember when not using the hot tub, leave cover on so hot tub will stay warm. Hot tub use is "at your own risk" and renter/s is responsible for all persons on the property. To avoid injury, do not permit children to use or access the hot tub unless closely supervised by an adult. Use extreme caution, and supervise your children at all times. Water in the hot tub should never exceed 104 degree F (40C). Temperatures between 100 degree F (38C) and 104 degree F (40C) are considered safe for healthy adults. Lower temperatures are recommended for children. Usage time for these temperatures is 10 minutes; prolonged usage may be injurious to your health. Pregnant women should consult a physician before using a hot tub. Before using a hot tub, the water temperature should be measured with an accurate thermometer. Medications, alcohol or drugs should not be used before or during hot tub use as they can lead to unconsciousness with the possibility of drowning. A physician should be consulted before using a hot tub if there is a medical history of heart disease, low or high blood pressure, circulatory system problems, diabetes or if suffering from obesity. Any person using medications should consult a physician before using a hot tub. Some medications may induce drowsiness. Other medications may affect heart rate, blood pressure and circulation and may cause drowning. Do not use hot tub unless all suction guards are installed to prevent body and hair entrapment. Never operate the hot tub if the suction fittings are broken, cracked or missing. Do not permit any electric appliances such as a telephone, light, radio or television within 10 feet of the hot tub. People with infectious diseases may not use the hot tub. Wet surfaces can be slippery; to avoid injury, exercise care when entering or exiting the hot tub. Do not use a hot tub immediately following strenuous exercise. The use of alcohol or drugs can greatly increase the risk of fatal hyperthermia in hot tubs. A hot tub cover is not representation that it will prevent children from entering. Supervise your children at all times during your stay. Stay off hot tub cover - it will not support weight. Remove cover completely before entry to prevent entrapment. Failure to follow instructions may result in injury or drowning. No horse play or rough housing in hot tub.

18. MAINTENANCE: We do everything possible to keep all equipment in good working order. However it is impossible to guarantee that all appliances hot tubs, hot water heaters, fireplaces, etc. will be in working order 100% of the time. We do guarantee to make every effort to correct all deficiencies as soon as possible during normal business hours. Report all maintenance problems to the property owners at the contact information provided. If it is after hours, please be certain to leave a message including your cabin phone number and the nature of the problem. You should take reasonable action to secure the problem. Management reserves the right to perform exterior and/or interior maintenance during your stay if necessary. In the event maintenance must be performed, we will do our best to do so without inconvenience

to you.

19. Fireplaces: From April through October fireplaces will be turned off and are not to be used. Please adhere to this policy. Do not attempt to alter the fireplace in any manner. The gas fireplace and logs are designed to burn cleanly without emitting harmful carbon monoxide gas. Tampering with the settings or rearranging the logs can be very dangerous, causing the fireplace not to burn cleanly and thus emit carbon monoxide gas. If you have a problem with the fireplace please contact us promptly.

20. NO HOUSE PARTIES: This is a family vacation home. No house parties are permitted. Please respect the neighbors and observe respectable noise levels. Our service personnel periodically check on the property. If they see a house party in progress you will be asked to leave the premises and forfeit all advanced payments and security deposits. No refunds will be issued for early departure.

21. STORM POLICY/ROAD CONDITIONS: No refunds will be given for storms, acts of god, evacuations, blackouts or road conditions. In winter months when there is snowfall or ice, it is highly recommended that you use a four wheel drive vehicle.

22. LOCAL/STATE/FEDERAL LAWS AND REGULATIONS: Lessee agrees to abide by all local, state and federal laws and regulations and assume all responsibility for reviewing and researching laws pertaining to, directly and indirectly, any and all activities they participate in while under this rental agreement. Following the aforementioned laws is the sole responsibility of the lessee. As the lessee, you are held responsible for the actions of all the members within your party while at Emerald Waters – Lakefront Mountain Chalet. This would include any persons that may be temporarily present on the premises, at your invitation and / or concurrence, during your stay.

23. Child Safety: This home is not baby proofed. Doors leading to the outside of the property do not contain child safety locks and should not be considered a safety feature to prevent child access to decks, stairs, hot tubs, docks, lake, roads or land. Use caution and supervise children at all times.

24. LIABILITY RELEASE: Lessee agrees that the lessor is not responsible for any accidents to persons or personal property, injuries or illness that occurs while on the premises or its facilities. This includes any and all parts of the inside and outside of the property. Including, but not limited to, decks, hot tubs, stairs, boat docks, lake, roads and land. Lessee understands that there is risk of injury or death associated with water activities and agrees to hold lessor harmless from any and all claims of liability. The lessors are not responsible for the loss of personal belongings or valuables of the lessee.

25. Video Surveillance: Lessee understands that the outside of the property is under video surveillance and this footage may be used to enforce the terms and conditions of this lease or to carry forward prosecution of any illegal activities at the property.

26. Alarm System Policy: Lessee agrees to be responsible for activating the alarm system upon their departure from the property. Lessee understands that failure to activate the alarm system will result in a remote activation charge of $50 (fifty dollars), charged to the credit card on file.

27. ACCEPTANCE OF TERMS: By accepting this reservation, it is agreed that all lessee's will abide by all terms and conditions. By Acceptance of this contract, lessee agrees to expressly assume the risk of any harm arising from their use of the premises and surrounding areas, or others whom they invite to use the premises.

28. CREDIT CARD AUTHORIZATION - Upon registering on-line, the registered occupant (lessee), understands and consents to the use of the credit card provided without original signature on the charge slip and that this Credit Card Authorization cannot be revoked and will not terminate until 40 days after leased premise is vacated. The registered occupant (lessee) understands by “clicking” that they have read the terms and conditions of this property, they are bound by this agreement and have signed it “electronically”. Charges may include but not be limited to: damages beyond normal wear and tear, failing to comply with no pet and no smoking policies, smoke oder, pet oder, falsified reservations, excessive cleaning fees and costs for stolen items.
