This rental agreement is between you (the "Guest" or "Tenant") and Mindy Ashby ("Owner" or "Lessor"), the management company that operates this unit. Contact information: Mindy Ashby, AshbyOhanaBeachHouse@gmail.com or 801-372-3309 mobile.
The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. During high season, some units may not be ready by 4 p.m., your patience is appreciated.

Accidental Rental Damage Insurance

Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.
Any damage noticed upon arrival should be reported to the owner immediately. If damage is not reported, your credit card will be kept on file and may be charged for the cost of the repair or replacement. In lieu of a security deposit, we will keep your credit card on file. You are responsible for any and all damages that occur to the property or its contents by you or any other member of your group, individually or collectively, while you are the registered occupant of the property. We will capture an amount from your credit card to cover the estimated cost of the repairs or to replace missing items. The amount captured will be an estimate and may be more than the actual cost of repairs or clean-up. We will provide a statement of the damages and the cost of the repairs after they have been completed. If there is a refund due, it will be returned to the credit card after all repairs have been made. All general maintenance should also be reported so the unit can be kept in good repair. PLEASE BE SURE TO READ THE CHECK-OUT PROCEDURES AT THE BOTTOM OF THIS PAGE.

Travel Insurance provided by TRAVEL GUARD:
Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). ACTS OF GOD: OWNER shall not be liable for events beyond our control which interfere with TENANTS scheduled occupancy, including but not limited to, Acts of God, acts of governmental agencies, fire, strikes, war, tornados, ice storms, environmental issues, severe weather, inclement weather, bridge closures, loss of electricity, or loss of water. NO REBATE OR REFUND shall be given in these circumstances. We recommend that you purchase Travel Insurance for your reservation.
SEVERE WEATHER:
We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do not warrant refund of rent or deposit.
Hurricane Policy and Tropical Storm Policy
We do not offer any refunds for Hurricanes or Tropical Storms. We highly recommend getting TRAVEL Insurance for your trip. It is up to the Guest to purchase this coverage for their trip.
Coverage is available for health and weather related problems. Please call them direct or order online to purchase this in your name.
TRAVEL INSURANCE AND HURRICANES: WHAT’S COVERED?
Travel insurance may cover a traveler’s vacation investment if severe weather conditions directly affect their travel arrangements or accom­mo­dations. For example, if a traveler is forced to cancel a trip due to a hurricane, travel insurance with trip cancellation can provide a reimbursement for nonrefundable expenses, up to the limit of coverage purchased.
If severe weather forces the evacuation of the traveler’s unit, the travel insurance may provide reimbursement for nonrefundable expenses, and additional travel expenses. For losses to be covered, travel insurance must be purchased before a hurricane is forecasted or predicted. Once a storm is named, losses resulting from a hurricane that has been forecasted or predicted on or before the effective date of coverage are excluded.
All claims will be evaluated on their own merits at the time of adjudication.
Travel Insurance is available on this site and we highly recommend you purchase it.
ABSOLUTELY NO PETS:
No Pets are permitted in rental units under any circumstances, NO EXCEPTIONS. If any evidence of a pet(s) is found in your unit or on the premises, you will be asked to vacate immediately with no refund of rent and will be charged $500 to the credit card on file.
ABSOLUTELY NO SMOKING:
No smoking is permitted in or around the perimeter (i.e., porches, decks, front yard) of the rental unit. If any evidence of smoking is found in the unit or on the premises, you will be asked to vacate immediately with no refund of rent and will be charged $500 to the credit card on file.
COMMUNITY RULES:
Guest agree to abide by rules of the community. These may be posted in the unit or at the community pool or office. These rules may change from time to time.
Do not leave anything hanging on the balconies or in the yard. (i.e., towels, rafts, beach toys, etc.)
Loud music systems and other disruptive noises are not permitted. Quiet time begins at 10:00 p.m.
All trash must be placed in plastic trash bags, securely tied and placed in outdoor trash receptacles provided. Trash pickup is on Tuesday, Thursday and Saturday. Do not place any loose trash into garbage cans. ALL trash must be in plastic trash bags. Do not transport the trash containers to the street or the driveway. They will be picked up and returned to the areas where they are located next to the home.
PARKING: Parking is only allowed in the driveway. Maximum parking for this home is 4 cars. No parking is allowed in cul-de-sacs or along the side of the streets in the roadway or on any grassy areas. Doing so may result in damage to sprinklers or vegetation which may result fines being imposed. Vehicles that are illegally parked are in direct violation of the fire code and will be towed at the owner's expense. Neighborhood parking rules are strictly enforced. Commercial vehicles, boats, trailers, RV's, jet skis, wave runners, motorcycles or similar vehicles are not permitted in the development.
MINIMUM STAY:
This unit has a 7 day minimum. If you have a question about a longer or shorter stay please contact the owner direct.
INCLUSIVE FEES:
Rates include a one-time linen setup and cleaning service at the time of departure. There is NO DAILY MAID SERVICE. A vacuum cleaner, broom and dust pan are in the home should you need them during your stay. Guests will need to provide their own paper items and cleaning supplies. An initial set up of trash liners, paper towels, toilet paper and hand soap is provided. Extra items needed are the responsibility of the guest. (i.e., Bring your tooth paste, laundry detergent, soap, beach towels, extra toilet paper etc.) We do not permit towels or linens to be removed from the home at any time during your stay. Missing towels and/or linens will be charged to your credit card. Guests must bring their own beach towels.
UTILITIES:
The landlord will provide water, heat, electric, trash removal and Wi-Fi. The air conditioning will be set at 72-74 degrees. There will be a $500.00 charge to your credit card on file if the clear covers over the thermostats are tampered with. (Monitored by IRIS notifications to Owner.)
RESTRICTIONS:
No trailers, boats, jet skis.
ACCOMMODATIONS:
One king, 2 queens, 2 sets of bunk beds (twin over double with twin pullout trundle). GUEST supplies linens for beach use.
MAXIMUM NUMBER OF OCCUPANTS:
The house is to be occupied by no more than 14 (fourteen) persons at a maximum. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups VIOLATION OF THIS PROVISION SUBJECTS GUEST TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM SUMMER VACATION RENTAL.
FALSIFIED RESERVATIONS;
Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
OWNER reserves the exclusive right to prohibit and/or cancel reservations providing all payments received are returned to GUEST within 7 days of notification.
OWNER, Emerald Shores HOA, and the on-site property management company will NOT be liable for lost or stolen items of any kind and GUESTS will take measures to safeguard all valuables and personal items.
All persons using the pool area do so at their own risk and sole responsibility. There is NO Lifeguard on duty. CHILDREN MUST BE SUPEVISED BY AN ADULT AT ALL TIMES WHILE IN THE POOL AREA. OWNER assumes no responsibility for any accident or injury in connection with such use. Persons using the pool agree with OWNER, for and in consideration of the use of the pool, to make no claim against the owners, for or on account of any loss of life, personal injury, or damage to or loss of personal property. Babies are not permitted in the pool at any time without swim diapers. No glass containers or bottles are allowed at the pool. No pets are allowed at the pool.
GUEST assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
GUEST assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).
GUEST agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
GUEST and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
GUEST agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
GUEST agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the GUEST, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.
GUEST agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.
Upon not less than 24 hours notice, GUEST shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants.
In case of failure of a system or amenity during your stay, including but not limited to, water, sewer, heating, air-conditioning, electrical, mechanical, ventilating, structural systems, major appliances, or entertainment equipment, LESSOR shall repair them in a workmanlike manner. GUEST agrees to permit access to the unit to make the repairs. LESSOR shall not be liable to GUEST in damages, and NO REBATE OR REFUND will be given for such temporary failure, provided LESSOR is making reasonable efforts to repair the system or amenity in a reasonable manner after having received notice from GUEST that repairs are needed. Absolutely NO REBATE OR REFUND will be provided for a failure or the restricted access to an amenity outside of the unit (i.e., pools, tennis court, tram, beach service, etc.)
In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from GUEST.
GUEST may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.
If GUEST abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.
In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.
Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.
The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures.
GUEST assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the GUEST.
In the event of cancellation of this contract, the deposit is non-refundable and will be kept by the owner.
PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION. VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEWER .THEREFORE, IN THE EVENT GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FOURTEEN PERSONS, GUEST SHALL BE RESPONSIBLE TO PAY LESSOR.THE-SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF FOURTEEN PERSONS PER DAY FOR EACH DAY THE GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FOURTEEN PERSONS.
NEW 2015 Security Wristband Policy and Procedure:
The new wristband policy will be in affect starting March 2015 through August 2015 and each consecutive year during those same months.
Guests will have to provide a lease agreement or an email confirmation of their lease agreement along with a valid ID (photo of lease and ID on a smartphone will be accepted) to the security attendant located at the beach pavilion 7 days a week from 10am-4pm to obtain their wristbands. Guests must wear their wristbands while at the beach, pavilion and pool areas.
A deposit of $20 will be collected from the guest at the time the wristbands are issued. When the wristbands are returned, the attendant will return the deposit to the guest. If wristbands are lost, the replacement cost is $2 per band.
Children 12 years and younger are not required to wear a wristband.
CHECK-OUT PROCEDURES:
We know you are on vacation and we do appreciate your business, but we do need to ask you to abide by our check-out procedures so we can prepare the unit for the next arriving guest in a timely manner. We appreciate your cooperation in following these procedures. Most of our guests follow all of these rules, but for the few who do not comply, this is notice that a $100.00 fee per non-complied with item will be charged to your credit card on file.
1) Check out time is PROMPTLY at 10:00 a.m. CST. Our cleaners arrive at 10:00 a.m. to start cleaning the unit. If you are not out promptly by 10:00, you will be charged $100.00 each additional half-hour.
2) Place all trash into plastic trash bags (No loose trash in garbage cans outside) and place in outside trash cans by 9:00 a.m. on Saturday. Empty everything that has been opened out of the refrigerator/freezer. All unopened food items will be donated. Feel free to leave unopened cold or frozen items in the refrigerator/freezer.
3) Please remove used sheets off of beds and leave on the floor in the middle of the room they belong in. Do NOT remove any bedding, linens, pillow shams, bedspreads, etc. from the rooms. Leave them in the closet or laying on the beds.
4) Start a load of towels washing in the washing machine.
5) Clean all soiled dishes.
6) Clean outdoor grill if used. Turn propane tank to "off" position. Put on cover.
7) Close all blinds, drapes and windows.
8) Check the house thoroughly for any personal belongings.
9) Leave guest parking permits on the kitchen bar counter.
10) Return wristbands to beach attendant.
11) Make sure all porch lights are off and all doors leading to the outside are locked.
12) Make sure the coded door locks behind you. If it does not lock, please press the lock button inside which will turn red and then close the door and check again to see if it locks. If you cannot make the door lock, please call me 801-372-3309 and I can lock it remotely.
Please leave the home neat and orderly to avoid additional charges. If the cleaning crew finds that the home has been left excessively dirty, you will be billed for the additional cleaning time at a rate of $100 per hour. Please remember and respect that this is our family's home that contains our personal items that we are sharing with you. We are excited to share our vacation home with you and hope that you make many fond memories here.
CANCELLATION POLICY:
Cancellation or changes of reservations with advance payments will receive NO refund. All payments are non-refundable. Cancellations and early departures due to inclement weather do not warrant any refund of rent.
CREDIT CARD AUTHORIZATION:
I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by "clicking" that I have read the terms and conditions of this property, I am bound by this agreement and I have signed "electronically, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not limited to: unauthorized long distance telephone and satellite TV charges; damages beyond normal wear and tear; unreturned keys, and parking violations.
