1. These Terms and Conditions, in addition to details in the Lease, constitute this Agreement.
2. Cottage Name and Address: Eagles Nest. 3318 Wilcox Avenue, Muskegon MI 49441, behind 3312 Wilcox Avenue, corner of Wilcox Avenue and Cherry Street. You will not see the 3318 address.
3. Co-Manger: Jane Schapka, 231-755-4466.
4. Communication: Email shall be the method of communication between owner and guest concerning this reservation. Incidental questions not related to contractual items may be by telephone.
5. Payment: You shall pay the amount and date(s) due as stated in the Lease or as amended. We shall automatically cancel the Lease, without refund, if you have not paid any balance payment by the due date.
6. Cottage Description: Furnished cottage, 1-story, 1-bedroom (Queen bed), Queen sleeper sofa in living room, 1 compact bath (shower, no tub). WIFI, cable TVs, and baseboard electric heat. Located on a forested sand dune, 12 stairsteps above street.
7. Bed Setup: Queen bed, smart TV. Queen sleeper sofa in living room, flat screen TV.
8. Parking: Free. Off-street. Park in left (west) lane of double-wide driveway, shared with main house on street level. You will pass by the main house fire pit on your way up to Eagles Nest on the dune.
9. Exclusions: No dishwasher. No washer/dryer. No phone. Please bring your own beach towels.
10. Age Limit: Main renter must be age 25 or more and be present during the stay. Children welcome.
11. Maximum Occupants: Four maximum, or the number submitted by guest at reservation, whichever is less. Family rental only (includes best friends) - no unrelated groups, no wedding or other parties. Eagles Nest is recommended for two persons or for up to four people who are comfortable in a small cottage with one small bedroom and a Queen sleeper sofa in the living room.
12. CHECK-IN: 4 PM EST or later. Call a few days before arrival for lock box code. Entry Key is in Box.
13. CHECK-OUT: By 10 AM EST. Late Departure Fee: Our housekeeper usually arrives at 10 AM EST to clean, and if the cottage is not vacated she bills us for her waiting time, at $25 per each half-hour, which we shall pass on to you by automatically charging your credit card. You agree to this by renting.
14. No Lake or Beach View: Cottage is not on lake or beach; there is no view of lake or beach from the cottage. Lake Michigan beach is 3 blocks to the west; Muskegon Lake shoreline (not a beach) is 1 block east and is the end-of-street sandy area for a boat launch and a bench to watch sailboats go by.
15. Furnished: Linens and towels, blankets, pillows, pillow cases. Starter Supplies of paper products are provided, which are not intended to last your entire stay. (Deli store is 2 blocks away, Meijer, Wal-Mart ~15-minute drive.)
16. Kitchen: Small, galley-style, apartment-size kitchen. Four-burner electric stove with oven, microwave, refrigerator/freezer, garbage disposal. Dishes, glassware, cooking, baking, serving, eating dishes, utensils.
17. Dining and Reading Corner Room: Round dining table, 4 chairs, reading chair and ottoman.
18. Bathroom: Compact (small) bathroom with sink, standard 30" shower, chair-height toilet. Towels provided (not for outdoor use).
19. Small Appliances: Coffee maker (Mr. Coffee, 12-cup, round flat filters- you bring), toaster, blender.
20. Electronics: smart TV and DVD in living room. 40” smart TV on dresser. WIFI internet.
21. Yard: Patio on forested dune, with table, 4 chairs, 4 Adirondack chairs surrounding fire pit, BBQ grill (propane). Fence on two sides. View from patio is of forested dune--no houses to left, right, or back.
22. No Refunds. We do not refund. To protect your vacation investment, you may wish to purchase (or not) travel insurance during the reservation process. See Travel Insurance offered and provided by TRAVEL GUARD.
23. No Rebates. We do not rebate for any utility or equipment failures. Report problems to Owner/Manager.

25. We do not charge or collect Damage Insurance. Any accidental damage or non-accidental damage or breach will be your responsibility and will be charged to your credit card, and you agree to this by reserving.
26. Initial Survey: Check to see that everything is in order so you won’t be charged with someone else’s damage or loss. Tell us if something needs attention. We can't fix it if we don't know about it.
27. No smoking, no pets, no candles, no fireworks. Violation results: immediate eviction, no refund.
28. Consideration and Quiet Hours: Be mindful of the neighbors—Quiet Hours: 11 pm to 7 am EDT.
29. Insects: Cottage is sprayed for insects, but being on a sand dune/woods location, a spider can spin a web or a lovely ladybug can arrive moments after the cottage is cleaned.
30. Acts of God: If house be uninhabitable due to Acts of God, we shall refund, pro-rated, the total amount you previously paid to us, and that shall be our total obligation to you.
31. Duties (Common sense): Perform routine housekeeping while here.
32. Departure Duties: We do not expect you to clean before you leave, but please leave cottage picked up and almost as neat as you found it upon arrival. Here are some reminders:
    1. Remove your food and belongings from cabinets, refrigerator, and drawers.
    2. Wipe up/off countertops, stovetop. Burn food off after you grill on BBQ outside.
    3. Empty wastebaskets and kitchen trash into garbage can outside under/by stairway.
    4. Wash, dry, and put away dishes. (This is not housekeeper’s duty.)
    5. Return remote controls, furniture (inside & outside), and game parts to original positions.
    6. Leave shams, bedspreads, and blankets on beds unless soiled. Put used / soiled linens, towels by dining table.
    7. Close windows, turn off lights, TVs, stove/oven. Leave TV, Internet plugged in!
    8. Put 2 keys on rings on dining table, lock door, return plain key to lock box, scramble dials to 0-0-0-0. ~ Thanks very much!
