PLEASE MAKE SURE THAT EVERY ADULT IN YOUR GROUP READS THESE TERMS AND CONDITIONS. WE KNOW THAT EVERY ADULT DOES NOT SIGN THE RENTAL AGREEMENT AND IT IS YOUR RESPONSIBIITY TO MAKE SURE THEY UNDERSTAND OUR RULES.
Please note that we reserve the right for our local caretaker to be on property at any time. If he comes onto the property during your visit, he will come make you aware of his presence.
The property will be ready for occupancy at 3:00 PM local time on the beginning date of the lease and must be vacated by 11:00 AM local time on the ending date of the lease. During high season, the home may not be ready by 3 PM, your patience is appreciated.
The PREMISES or PROPERTY is located at: 1177 C.R.3010, Lampasas, TX 76550.
Any damage noticed upon arrival should be reported to the OWNER immediately. If damage is not reported, your credit card may be charged for the cost of the repair. All general maintenance should also be reported so the property can be kept in good repair. In order not to be charged additional fees, the following must occur:
- a) No evidence of pets on the property. This includes outside the property, but especially INSIDE the property.
- b) No damage is done to the property or its content including the linens.
- c) No items are missing upon the inventory check.
- d) All debris, garbage and discards are placed in proper containers.Put all garbage in the dumpster by the barn. (We are sorry that our trash service does not offer recycling. We have requested it several times. They tell us they will be offering it in the near future.)
- e) All soiled dishes are placed in the dishwasher and turn it on to wash when you leave.
- f) There was no exceeding the maximum occupancy of the property (18 people) and number of guests have been reported honestly and accurately to owners.
- g) There was no smoking or evidence of smoking in this designated non-smoking property. (Smoking is permitted OUTSIDE, please remove all evidence and use caution when extinquishing cigarettes because of dry conditions.)
- g) Property is left in neat condition.
- h) Linens are to be dealt with in the following manner: Used towels should be placed in one pile on the floor in the utility room, A SAFE DISTANCE FROM THE WATER HEATER. Used sheets and blankets should be left on the beds. The cleaning crew will remove the linens and launder them.
- PLEASE LEAVE UNUSED SHEETS AND BLANKETS FOLDED ON THE BED.
- NO SILLY STRING IS ALLOWED ON THE PROPERTY. FINDING IT ON THE PROPERTY WILL RESULT IN A $500 CHARGE.
PLEASE BE SURE TO READ THE CHECK OUT PROCEDURES AT THE BOTTOM OF THIS PAGE. SEVERE WEATHER - We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of rent or deposit. We highly recommend getting TRAVEL insurance for your trip! Travel insurance is inexpensive and could save you a lot of money!
Hurricane Policy and Tropical Storm Policy
We do not offer any refunds for Hurricanes, Tropical Storms, or any other form of incliment weather. We highly recommend getting TRAVEL Insurance for your trip.

ABSOLUTELY NO PETS are permitted INSIDE the dwelling under any circumstances, NO EXCEPTIONS. If any evidence of a pet(s) is found INSIDE the dwelling, you will be asked to vacate immediately and your credit card will be charged for any damages or extra cleaning fees incurred by the owners, including carpet cleaning, odor removal or furniture damage. We will consider allowing the keeping of pets OUTSIDE the dwelling. We must be notified in advance of booking and payment as to the type and number of pets that will accompany guests. A pet deposit will be required if the pet is approved. A fully-fenced, 30 ft x 30 ft "dog run" is provided for guests who typically travel with their pets.
ABSOLUTELY NO FOUR WHEELERS OR OTHER FORMS OF ATV's may be ridden on the property. There are many county roads immediately beyond our property line where you may choose to ride. Violation of this condition will result in an automatic $500 fine.
ABSOLUTELY NO RV's or "5th WHEELS" OR TRAVEL TRAILERS allowed onto the property without prior consent. Violation of this condition will result in an automatic $500 fine.
ABSOLUTELY NO CANDLES MAY BE BURNED IN THE HOUSE OR ON THE PROPERTY.
THE HOUSE AND PROPERTY MAY NOT BE USED FOR PARTIES OF ANY KIND OR WEDDINGS WITHOUT PRIOR WRITTEN PERMISSION OF THE OWNERS AND IS ONLY PERMITTED AT AN ADDITIONAL COST. WEDDINGS AND PARTIES MAY BE BOOKED THROUGH A SEPARATE CONTRACT ONLY. PLEASE CONTACT THE OWNERS IF YOU NEED MORE INFORMATION.
This lease is between the LESSEE or Guest and M&M Creekside, LLC. or LESSOR. M&M Creekside, LLC is the management company that operates this unit.
PROPERTY RULES: Guests agree to abide by rules of the property. These rules may change from time to time.
Parking: Substantial parking is available throughout the property. Absolutely no parking on front or rear lawn immediately surrounding the property. No parking within 50 ft of the private pool. No parking within 100 ft of the propane tank.
Minimum Stay: The minimum stay is two days.
INCLUSIVE FEES- Rates include a one-time linen setup. There is NO DAILY MAID SERVICE. Guests will need to provide their own paper items and daily cleaning supplies. An initial set up of trash liners, toilet paper (1 in each bathroom) and hand soap is provided. Extra items needed are the responsibility of the guest. (i.e.: Bring your tooth paste, laundry detergent, fabric softener, soap, beach towels, extra toilet paper, paper towels, paper plates, plastic cups, shampoo, sunscreen, etc.)
UTILITIES: The landlord will provide water, heat, electric, trash removal, and onsite internet service. (PLEASE BE ADVISED THAT INTERNET SERVICE IS NOT GUARANTEED. IF YOU NEED INTERNET FOR WORK OR OTHER REASON, PLEASE TALK TO YOUR PHONE COMPANY ABOUT MAKING YOUR MOBILE PHONE A MOBILE HOTSPOT while you are at M&M Creekside. Also, the McDonald's in town has free internet, as does the Lampasas Public Library.)
ACCOMMODATIONS: Two king beds, two queen beds, two double beds, six twin beds, and two full-length sofas.
MAXIMUM NUMBER OF OCCUPANTS: The base rate requires that the house be occupied by no more than 15 (Fifteen) persons at a maximum. Options for up to 18 (Eighteen) occupants in the house are available. These rates can be found when booking reservations, listed as "Optional Fees." We will not rent to vacationing students or singles under 20 years of age unless accompanied by an adult guardian or parent. VIOLATION OF THIS PROVISION SUBJECTS LESSEE TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM VACATION RENTAL.
FIREARMS: ALTHOUGH DEER AND OTHER FORMS OF WILDLIFE INHABIT THE PROPERTY GROUNDS, ABSOLUTELY NO HUNTING OF ANY KIND IS ALLOWED. FURTHERMORE, ABSOLUTELY NO FIREARMS MAY BE DISCHARGED ON THE PROPERTY OR BROUGHT ONTO THE PROPERTY IN ANY UNSECURED MANNER. ANY VIOLATION OF THIS POLICY WILL RESULT IN A $1000 CHARGE TO LESSEE'S CREDIT CARD AND IMMEDIATE TERMINATION OF LESSEE'S STAY ON THE PROPERTY WITH ABSOLUTELY NO REFUND OF RENTAL CHARGES.
FALSIFIED RESERVATIONS- Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
LESSEE assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
LESSEE assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).
LESSEE agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
LESSEE and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
LESSEE agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
LESSEE agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the LESSEE, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.
LESSEE agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.
Upon not less than 24 hours notice, LESSEE shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants. In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from LESSEE.
LESSEE may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.
If LESSEE abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.
In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.
Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.
The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures. Violators are subject to eviction according to the Texas Property Code Sections 24.005 and 91.001.
LESSEE assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the LESSEE.
PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION. VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEPTIC SYSTEM. THEREFORE, IN THE EVENT LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FIFTEEN PERSONS WITHOUT PRIOR WRITTEN CONSENT OF THE LESSOR, LESSEE SHALL BE RESPONSIBLE TO PAY LESSOR.THE-SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF FIFTEEN PERSONS PER DAY FOR EACH DAY THE LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FIFTEEN PERSONS.
Cancellation or changes of reservations with advance payments: Cancellations that are made more than (60) days prior to the check in date will forfeit a minimum charge of $ 100.00. Cancellations that are made within (60) days of the check in date forfeit the full payment. Any changes made within (60) days of the check in date that result in a shortened stay, change of dates, change of location or unit, may result in loss of entire payment. Cancellations and early departures due to inclement weather do not warrant any refund of rent. We highly suggest that you purchase travel insurance for your trip!
CREDIT CARD AUTHORIZATION
I understand and consent to the use of the credit card provided without original signature on the charge slip, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include: unauthorized long distance telephone and satellite TV charges; damages beyond normal wear and tear; unreturned keys, parking infractions and violation of the maximum occupancy provision.
All persons using the pool area and creek to do so at their own risk and sole responsibility. KIDS MUST BE SUPERVISED ALL THE TIME IN THE POOL AREA. Owners assume no responsibility for any accident or injury in connection with such use. Persons using the pool and creek agree with the Owners for and in consideration of the use of the pool and creek, to make no claim against the owners for or on account of any loss of life, personal injury, or damage to or loss of personal property.
All trash should be placed in plastic trash bags, securely tied and placed in the outdoor trash receptacles provided. Trash pick-up is on Tuesday. (WE ARE SORRY THAT OUR TRASH SERVICE DOES NOT OFFER RECYCLING.)
Check Out Procedures
We know you are on vacation and we do appreciate your business. But we do have to ask that you abide by our Check Out Procedures. The main reason for this is so we can get the unit ready for the next guest. They arrive only hours after you leave. If you leave the unit in great shape, the next family can have access to the unit on time. We really appreciate you following these procedures.
Most of our guests follow all of these rules very nicely, but for the few that do not, this is notice that a $50.00 fee per incident or per half-hour which ever applies will be charged to your credit card on file.
1. Check-out time is by 11:00 AM local time. Our managers and cleaners arrive at 11:00 AM to start cleaning the unit.
2. Make sure you leave the key in the lock box. Lock all the doors (there are NINE) when you leave.
3. Take ALL of the trash in the dwelling, including the bathrooms and bedrooms, to the dumpster outside the dwelling. This is the most common problem. (Please note that our trash service does not offer recycling.)
4. Put ALL dishes in dishwasher, put soap in and turn on.
5. Wipe down all kitchen counters and sweep the floors.
6. COMPLETELY empty the refrigerator. Please do NOT leave any food for any reason.
7. Bring all used towels to the laundry room. Please leave the used towels in a pile on the floor, safely away from the hot water heater.
8. If some of the beds have not been used, please just leave the folded linens on those beds. UPON YOUR DEPARTURE, PLEASE LEAVE THE BEDS THAT HAVE BEEN SLEPT IN UNMADE AND LEAVE THE SHEETS AND BLANKETS ON THE BEDS. THE CLEANING CREW WILL REMOVE AND LAUNDER THEM.
9. Make sure all indoor and outdoor furniture is in original position. If you have moved any furniture, please put it back where it was when you arrived.
Please leave the property neat and orderly to avoid additional charges. If the cleaning crew finds that the property has been left excessively dirty you will be billed for the additional cleaning time at a rate of $50 per hour.
If evidence of pets is found inside or outside the house, you will be charged for cleaning pet hair, pet wastes and whatever it costs to free the house of allergens.
Please leave the property in as good as shape as possible. The cleaner we find it, the faster we can turn it over to the next guest. We appreciate your help.
You are responsible for any and all damages that occur to the property or its contents by you or any other member of your group while you are the registered occupant of the property. In lieu of a security deposit we will keep your credit card on file as a security deposit. If we discover that there has been damage to the property or its contents while you are the occupant we will capture an amount from your credit card to cover the estimated cost of repairs. The amount we capture will be an estimate and will probably be more than the actual cost of repairs. We will provide a statement of the damages and the cost of the repairs after they have been completed. If there is a refund due it will be returned to the credit card after all repairs have been made. If the cleaning company detects any evidence of smoking in the homes not specifically listed as a smoking home you will be billed an additional $500 to deodorize the home.
SECURITY: In lieu of a security deposit we will hold your credit card on file. If there are damages to this unit during your stay, we will bill your credit card and send you an invoice. You agree to this by booking this unit. The balance of rent and any other fees are due 60 days before you arrive. You can mail a check to M&M Creekside, LLC. This information will be emailed to you. If you are booking this within 60 days of arrival, the total amount is due at time of booking.
You are responsible for any and all damages that occur to the property or its contents by you or any other member of your group, individually or collectively, while you are the registered occupant of the property.
M&M Creekside Hill Country Retreat occuplies 20 beautiful rolling acres of property on a creek. Although we treat our home quarterly for pests and never have any problems, please be aware that outside there are bees, wasps, an occasional scorpion, and other critters. If you have anyone in your group highly allergic, please be prepared.
Again, it is your responsibility to make sure all the adults in your group are aware and have read these Terms and Conditions. Thank you for your assistance in this regard!
