RENTAL TERMS & CONDITIONS

This agreement is between our "Guest(s)", and TLC Vacation Rentals, Inc., Daniel and Cynthia Schanink (owners). The property will be ready for occupancy at 5:00 PM local time on the beginning date of the booking/lease and must be vacated by 11:00 AM local time on the ending date of the booking/lease.

PROVISIONS: The property is fully furnished. We will provide linens and towels, as well as starter paper products, some staple basic cooking ingredients, spices, coffee filters and accompaniments, dishwashing and liquid hand soap. The kitchen is stocked with dishes, pans, silverware, coffee maker, blender, microwave, toaster, oven, range, refrigerator and dishwasher.

TRASH: Please follow written instructions posted on frig. and check-out sections for trash disposal in brown bin.

UTILITIES/CABLE/PHONE/INTERNET: We will pay all utility costs (water, heat, electric, trash removal) and provide basic cable television and internet. Since we have found that most guests are now traveling with a cell phone and coverage is excellent in Hot Springs Village, this property is NOT equipped with a telephone. If you will be bringing your cell phone, please make sure we have your number so we have a way of reaching you while you're enroute and staying at the home.

USE OF LAKES, POOLS & GOLF COURSES / GUEST PASSES: In order to use the Hot Springs Village amenities (fees apply), you must have guest cards. Please ensure prior to your arrival that we have the full names of all those in your party for issuance of your passes. They will be waiting for you when you arrive, along with the guest information book and lots of local and area information.
SMOKING AND DISTURBANCES: This house on property is non-smoking. Ashtrays are, however, provided if you would like to smoke outside. We strive to be good neighbors and will appreciate your treating our neighbors just like you would treat your own. If police or neighbors call reporting loud and/or unruly behavior, you will be asked to leave immediately and will forfeit the remainder of your stay and monies paid. Absolutely no drugs or illegal substances of any kind may be used on the premises.
DAMAGES: We ask that you treat the property as your own while you are there. Should anything be damaged or broken upon arrival, please let us know right away and we’ll work together to remedy the situation and/or replace the items. All damage to the property (above normal wear and tear) caused by you and your children or your guests during your stay, shall be subject to replacement or repair at your expense. However, if we discover that something is missing, or there has been damage to the property or the contents of the property while you are the occupant, we reserve the right to capture an amount from your credit card to cover the cost of repairs. We will provide a statement of the damages and the cost of the repairs after they have been completed. We shall not be responsible for any of your own items inadvertently left behind after checking-out.
Travel Insurance provided by TRAVEL GUARD:
Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). CHECKOUT AND CLEANING: You will find written check-out procedures in the property for your review. We expect that you will leave the property in good order when you leave. When you made your reservation, we charged a minimal cleaning fee of $75 to cover normal thorough cleaning, as we prepare for our next guests. However, should we find after your departure that excessive cleaning is necessary (above and beyond ordinary and normal use), we reserve the right to capture an amount from your credit card to cover the associated costs for labor and supplies. To avoid these charges, please adhere to the check-out procedures carefully and dispose of all trash in the proper receptacles.

DISCLOSURES & DISCLAIMER:
We are not responsible for any personal injury or death on the property, or loss or damage to your property caused directly or indirectly from foul, inclement weather conditions, acts of God or nature, failure of heat, accidents related to fire, heaters, stoves, grills, snow & ice, flooding, swimming/boating or water-related accidents, or any unforeseeable circumstances. We are also not responsible for the failure of or non-availability of any amenity. For your protection we encourage the purchase of travel insurance.
Right to enter...... we reserve the right to enter the property with proper notice (phone message to suffice) for maintenance purposes or to show the property, should it be on the market. In an emergency, we reserve the right to enter immediately, without notice.
Termination of rental agreement...... we reserve the right to terminate this rental agreement with 60 day notice, should the property be marketed and sell prior to your occupancy. In that event, we will refund your monies paid, in full and every effort will be made to help you find an alternative property that will meet your needs. In the event that there is some unforeseen event that requires us to withdraw the property from rental status (owner or family illness or death, maintenance issues, weather related damage, fire damage), we reserved the right to terminate this rental agreement immediately and refund your monies paid in full. Again, every effort will be made to work with you to find an alternative property that will meet your needs.
CREDIT CARD AUTHORIZATION:
You hereby understand and consent to the use of the credit card provided without original signature on the charge slip; that a photocopy or fax of this agreement will serve as an original, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include, but are not limited to: damages beyond normal wear and tear and replacement of missing items.

CANCELLATION POLICY:
All monies paid in connection with this booking shall be considered refundable if we are givien 60 days notice of cancelation. Should you find it necessary to cancel your reservation, we will refund your deposit and any additional monies paid, less a one night ($350) booking fee, as a credit to your card, only if we are able to re-rent the home for the dates you had reserved. If we cannot re-rent the unit, you will be offered an exchange option for another date range on a last minute basis (within 14 days of requested arrival), based on availability. Some exclusions, such as holidays and peak season may apply. After check in, no portion of the rental fee is returned, for any reason, including early departures due to inclement weather. Please note that travel insurance is available from multiple vendors as an option for your added protection.
