Please print these Terms and Conditions for your records.

GUEST, the undersigned, renting SeaBliss at Signature Beach at 1816 Scenic Highway 98, unit #401, Destin, FL 32550 (Herein referred to as the PREMISES, PROPERTY OR UNIT) for vacation or recreation purposes, agree to the following:

The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. No early check-ins are permitted during peak season but may be coordinated with owner if available during off season. We do our absolute best to meet this checkin time, but if excessive cleaning is required from the prior renter, delays may occur. This does not entitle you to a refund.

GUEST is responsible for full payment for the entire rental period: a $350.00 rent first payment being due with the return of this Agreement via credit card, and the Balance of the rent being due 90 days prior to occupancy via Check to avoid credit card fees. Remaining balances not received (90) days prior to the arrival date will be considered a cancellation. (See Cancellation Policy). Rates are subject to change without notice. The advance payment will be applied toward the total rent. Advance payment is not a damage deposit. See Damage Deposit Requirement below. GUEST can make the check payable to: SeaBliss. The rental rate information will be emailed to you. If you are booking this within 90 days of arrival, the total amount is due at time of booking.

Roomarama

Exception to this policy: Roomarama bookings will be paid in full directly to Roomarama. A payment code will be given to guest and presented to Concierge upon checkin. Guest will remit 300.00 Security Deposit via credit card upon agreeing owners Terms and Conditions on ivacationonline.com( Property 2359).

CLEANING:

Cleaning fee is $250.00.

BEACH CHAIRS:

Please note portable chairs and umbrellas are not allowed on beach. One complimentary setup comes with the unit. You can rent additional beach setups from beach staff!

ACCIDENTAL RENTAL DAMAGE INSURANCE:

49.00 Damage Insurance -Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder. Guest credit card number will be retained for 90 days after check-out. In the event damages exceed 3000.00, Guest’s credit card will be charged for any damages above and beyond insurance coverage and the retained security deposit of 300.00.

SECURITY DEPOSIT:

A $300.00 security deposit will be added to Guest's rental total. Items or damages not covered by insurance will be paid for out of the security deposit. Items/damages including but not limited to: excess cleaning fees, evidence of smoking, evidence of pets, loss of keys, loss of Security FOBS, theft, missing remotes, damages beyond normal wear and tear. If no issues are noted, the deposit will be refunded 100% and will be returned after all repairs have been made.The OWNER will process refund within 2 weeks after checkout. If damages are noted, the full cost of replacement, repair or cleaning will be deducted from the deposit and receipts will be provided to the Guest.

OWNERS AGENT inspects the unit before and after each stay and damages are noted in detail with pictures in a report to the owner. However, any damage noticed upon arrival should be reported to the owner or owner’s agent immediately. If damage is not reported, the amount may be deducted from Guest’s security deposit or credit card depending on the amount and kind of damage. All general maintenance should also be reported so the unit can be kept in good repair.

SEVERE WEATHER:

We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of rent or deposit.

Hurricane Policy and Tropical Storm Policy

We do not offer any refunds for Hurricanes or Tropical Storms. We highly recommend getting optional TRAVEL Insurance for your trip. It is up to the Guest to purchase this coverage for their trip.

Insurance Coverage is available for health and weather related problems. Please call the travel insurance agency directly or order online to purchase this in your name.

Travel Insurance provided by TRAVEL GUARD: Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). ACTS OF GOD/EVENTS BEYOND OUR CONTROL:

OWNER , Property Manager and Owner’s Agent shall not be liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to, Acts of God, acts of governmental agencies, fire, strikes, war, tornado, ice storm, severe weather, Signature Beach pool closures, Signature Beach building issues, inclement weather, personal travel cancellations (i.e. airfare), loss of electricity, construction on Signature Beach building or buildings surrounding Signature Beach or loss of water. NO REBATE OR REFUND shall be given in these circumstances. We recommend you purchase "Cancel for Any Reason" Travel Insurance while making your reservation.

MAINTENANCE & REPAIRS:

Every effort is made to keep SeaBliss property and its equipment in good working order. Please report any inoperative equipment or maintenance problems to the Concierge or Owner immediately.

OWNER , Property Manager and Owner’s Agent shall not be liable or responsible for events, delays and/or service interruptions beyond our control with regards to appliances and building which interfere with your scheduled occupancy, including, but not limited to utilities (such as cable tv, internet access, phone services, etc)., equipment (such as clocks, blow dryers, Televisions, Audio Systems, phones, piano, remote controls to TVs, fans) Air conditioner, Heat, Water Heater, Whirlpool tub and ALL appliances throughout the condo ( i.e. Fridge, washer/dryer microwave, stove top, wine chiller, dish washer, oven, garbage disposal, outdoor grill etc.). We provide all of these appliances however they are not 100% guaranteed to work. Should an issue occur prior to or during your check in, we will immediately address the issue and get it resolved as quickly as possible. Delays may occur due to scheduling delays of repairmen.

No rate adjustments, rebates or refunds will be issued for any mechanical failures, delays due to receiving parts needed for repairs, delays due to service/utility companies, requests made outside operating hours or holidays for air-conditioning/heat, refrigerator, dishwasher, range/oven, disposal, ice machine, fans, washer/dryer, televisions, DVD players, audio equipment, remote controls, or other appliances. Please note: Selected services requested may be handled the following day or upon business hours. The Agent or Maintenance Staff may enter the unit during working hours or at other times in case of an emergency for the purpose of completing necessary repairs and/or maintenance.

AMENITIES OFFERED: Everything will be done to make sure what was offered in any advertising will be in the property as described. There may be times when the exact amenities are not in the property. Every attempt is made to keep the inventory as advertised. A difference in amenities does not entitle lessee to any refund of rents paid. Amenities may be added or removed at the owners/managers discretion. Example: We may have advertised 4 DVD players; one may be out for service. That does not warrant any refund.

EMERGENCIES: For emergency after hour's assistance call 888-235-5603 or 770 973 4765 or 850 217 1111. No other arrangements, property substitutions, rate adjustments or refunds will be issued for mechanical failures or service delays. In addition, No rate adjustments, rebates or refunds shall be given for mechanical failures or service delays related to the Signature Beach building and property such as pool closure, elevator mechanical issues, garage door mechanical issues, key pad issues, garage door issues etc. In addition, as it relates to the building and property, Owner and Owners agent shall not be liable for events beyond our control which interfere with use and/or enjoyment of building and/or property.

Pool heating is not guaranteed. It must be requested prior to your arrival.

NO PETS:

No Pets are permitted in rental unit except Seeing Eye Dogs. If any evidence of a pet(s) is found in your unit or on the premises, you will be asked to vacate immediately with no refund of rent or security deposit.

COMMUNITY RULES:

Guests agree to abide by rules of the community as well as the city and State. These may be posted in the unit or at the community pool or office. These rules may change from time to time.

Damage to or destruction of elevator equipment or walls is strictly prohibited. Elevator equipment must not be tampered with. Misuse of elevator mechanisms, such as forcing doors, removing panels, tampering with fire equipment, or damaging electrical control equipment, is a serious and dangerous offense. Any person causing damage or destruction of elevator equipment or machinery will be responsible for any fees required to correct the damage.

MINIMUM STAY:

This unit has a 7 day minimum during peak season. Exceptions may be given for last minute reservations. If you have a question about the length of stay please contact the owner directly.

INCLUSIVE FEES:

There is NO DAILY MAID SERVICE. An initial set up of trash liners, paper products and toiletries (Face and Body Soap, Body Lotion and Shower Gel) is provided. Seabliss Spa Robes and Extra Large Spa Towels are provided for your use during your stay. We have a limited supply - please do not take the Robes or Spa Towels, as removal or theft of Seabliss property will result in a $150.00 fee. An assortment Towels and Bed Linens are provided. Extra items needed are the responsibility of the guest. (i.e. Bring your tooth paste, beach towels, extra toilet paper etc.).

Security FOBS and Door keys:

FOBS will be assigned for each guest stay which will allow access to the building and garage. Replacement of FOB will be 100.00 per FOB and 25.00 per Door Key and will be taken out of your security deposit. Please be sure to place all FOBS and door keys in the lockbox on laundry room counter prior to check out. If the keys are not in the lockbox upon checkout or returned within 4 days, you will be charged the fee.

GRILL-An Electric Grill is provided for GUEST use on the Balcony only. Guest agrees to keep Grill clean and the floor area around the grill after use after use to avoid grease fire. Failure to do so will result in additional cleaning fee of 50.00 from your security deposit. The Grill will be checked after checkout. Please clean the grill and floor around the grill after your use.

SWIMMING POOL: Our property includes an in-ground swimming pool on the Roof. There is no lifeguard and no diving allowed. By renting this property, you are taking full responsibility for the safety of all guests and recognize that the use of the pool is "at your own risk". Children and non-swimmers must be supervised at all times. There shall be no bike riding, skateboarding or roller skating around or near pool area. Children 3 years of age and younger must wear a swim diaper. No one except the pool serviceman shall adjust the thermostat of the pool. Owners assume no responsibility for any accident or injury in connection with such use. Persons using the pool agree with the Owners for and in consideration of the use of the pool, to make no claim against the owners for or on account of any loss of life, personal injury, or damage to or loss of personal property. POOL CLOSES AT DUSK. NO ONE IS ALLOWED AT POOL AFTER HOURS. SECURITY CAMERAS with SPEAKERS AND OFF DUTY POLICE MAN/SECURITY GUARD MONITOR THE ACTIVITY AT NIGHT. SECURITY CAMERAS ARE THROUGHOUT THE BUILDING FOR YOUR SAFETY. POOL HEATING IS UPON REQUEST BUT CAN NOT BE GUARANTEED.

UTILITIES:

The OWNER will provide water, heat, electric, trash removal and local telephone usage. GUEST will need to use personal cell phone for all long distance calls made during tenancy.

RESTRICTIONS:

No trailers, boats, jet skis. Occupancy of RV campers and /or tents on the premises, beach or lot is forbidden. Please note portable chairs and umbrellas are not allowed on Signature's beach. You can rent additional beach setups from beach guys!

ACCOMMODATIONS:

Three Kings Beds, Two pullout queen sofas, Two sets of Twin over Full Bunk beds and one modular sofa that can be configured to sleep at least two are provided.

Linens are provided. GUEST should supply own towels for beach use.

MAXIMUM NUMBER OF OCCUPANTS:

Occupancy (including small children, infants and visitors) is not to exceed 12 persons. If more than the maximum number is found to be occupying the leased property, GUEST agrees that a charge of $150.00 per person per day will be charged to GUEST’S credit card, or if GUEST is paying by check or money order, GUEST will promptly submit moneys due. Additionally, this Agreement may be immediately terminated without refund.

ERRORS/OMISSIONS: Double booking is rare. We will be careful to avoid conflicts with reservations; however, if through error/omission, other tenants are occupying the rental unit or the unit is otherwise unavailable for any reason on the dates of the rental agreement, We will attempt to find a substitution accommodation of a similar quality/price range when the error is discovered. If there is no replacement property found or if you reject the replacement, a refund of all rents and fees You paid shall be your sole remedy for any and all damages, liability or inconvenience arising out of the double booking. In no event will renter be permitted to demand removal of those occupying the rental unit.

AGE MINIMUMS

LESSOR does not rent to vacationing students or groups of singles under 25 years of age unless accompanied by at least 2 adult guardians or parents. No chaperoned groups. Any violators will be evicted according to Florida Statue 508.141 with forfeiture of all monies. . LESSEE hereby stipulates that he/she is at least 25 years of age and will occupy the premises full time during this rental period. ANY renter who violates this agreement will be evicted and will have all rental monies forfeited. We do not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. The parent/child ratio of 1 adult for every 2 children applies during Spring Break. Our home is monitored during Spring Break for violation of this policy. All violators will be evicted and all rental payments and/or security deposits WILL be forfeited. This also applies if the rental agreement is signed under false pretenses. No chaperoned groups. Seabliss’ Concierge will greet every rental party and may ask for photo ID/ driver’s license as proof of age.

Check-Out Procedures We ask that you abide by our Check-Out Procedures so we can prepare the unit for the next guest as they arrive only hours after you leave. If you leave the unit in great shape, the next family can have access to the unit on time. We appreciate your cooperation in following these procedures. Check-out time is by 10:00 am CST. Our cleaners arrive at 10:00 am to start cleaning the unit There is a $50.00 fee per incident or per hour, which ever applies, which will be charged to your credit card if these procedures are not adhered to.

  1. No damage is done to the unit or its contents including the linens, walls, furniture.
  2. No items are missing upon the inventory check (This includes, but is not limited to, transferring items to other rooms).
  3. All debris, garbage and discards are placed in proper containers.
  4. All soiled dishes are placed in the dishwasher.
  5. There was no exceeding the maximum occupancy of the unit.
  6. There was no smoking or evidence of smoking in a designated non-smoking unit.
  7. Unit is left in neat condition.
  8. Keys are put in lockbox in laundry room
  9. Clean the Grill if you use it (50.00 cleaning fee)
  10. Lock all doors behind you if cleaners are not there. Key can be used in lockbox outside the unit

FALSIFIED RESERVATIONS;

Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.

GUEST may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.

GUEST assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.

GUEST assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).

GUEST, as well as tenants and visitors, agree that any drug use on the property, or any disturbance, annoyance, endangerment, or inconvenience to the neighbors, or use of the premises for any immoral or unlawful purposes, or violation of any law or ordinance or committing any waste or nuisance on or about the premises will immediately terminate GUEST’S occupancy and rental agreement of these premises.

GUEST agrees that no occupant may smoke in the home and to keep the doors shut if smoking on the balcony so the smoke does not blow into the condo and to remove all ashes and cigarette butts from Balcony. If the cleaning company detects any evidence of smoking in the home, a $300.00 charge will be assessed and taken out of security deposit.

GUEST agrees that there will be no loud or large parties in the condo or on the premise, and that all listed previously will maintain the premises in good order and appearance and conduct themselves in a manner non-offensive to the neighbors.

GUEST shall be responsible for all damage, breakage and/or loss to the premises, except normal wear and tear and unavoidable casualties (deemed by LESSOR or Managers of Property) which may result from Occupancy. GUEST agrees that, household contents, etc., other equipment and fixtures will be in the same condition as at the beginning of GUEST’S stay.

GUEST agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of GUEST’S stay, or that may be put in during the term of the lease, with reasonable wear and tear and/or damage by unavoidable fire and casualty being the only exception. Prior to vacating the condo, GUEST is responsible to remove all trash (trash chute located on 4th floor) and recyclables, ensure all dishes and cookware are clean and return any furniture that was moved to its original position. GUEST agrees no Garbage will be left outside the unit or by the trash chute. If evidence is found by building staff, concierge or neighbor, 150.00 Fine will be assessed as this is very upsetting to neighbor. Please keep beach floats in closet as maintenance cleans floors in lobby area.

The property will be left in the same good and habitable condition in which it was found on GUEST’S arrival. Any damages or notable conditions found upon arrival will be reported to the Owner/Property Manager within one (1) hour of Occupancy. GUEST understands the property will be inspected when he/she/they depart. Otherwise, GUEST agrees that repair/replacement costs for any damages will be submitted to Damage Insurance Company and that if the Damage Insurance is not sufficient to cover the repair, cleaning or replacement costs that they will be paid by GUEST credit card and/or security deposit.

LESSOR, Owner, Property Manager and Owner’s agent, shall not be liable to Tenant, Tenant’s guests, licenses or invitees or any other person for any injury, loss or damage to any person or property on or about the premises. Tenant shall hold LESSOR, Owner, Property Manager and Owner’s agent harmless and indemnified from and against all loss, injury or damage occasioned by the use or misuse or abuse of any part of the premises, parking lot, beach or community and from or against any omission, neglect, or default of Tenant, his guests, licensees or invitees. Owner will NOT be liable for lost or stolen items of any kind and Guests will take measures to safeguard all valuables and personal items.

GUEST agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.

Upon not less than 24 hours’ notice, GUEST shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants.

In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from GUEST.

If LESSEE abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.

LESSEE agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the Tenant, or guests of Tenant or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.

If GUEST abandons or vacates the premises, LESSOR may, at his option, terminate this lease, enter the premises, and remove all property. In the event that any action shall be commenced by either party arising out of or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.

Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law. The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners, are required to conform to all Policies and Procedures. Violators are subject to eviction according to Florida Statute 509.141.

GUEST assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above, including any outstanding or unpaid charges that are the responsibility of the GUEST.

CANCELLATION POLICY:

Cancellations that are made more than (90) days prior to the check in date will forfeit a minimum charge of $50.00. Cancellations that are made within (90) days of the check in date forfeit the full advance payment (the entire rental amount). LESSOR will make every attempt to re-book the reservation to another party. If the reservation is re-booked at the same rate to another party, GUEST will be refunded all funds paid minus a $350.00 fee. GUEST understands that if LESSOR rebooks to another party at a lesser rate, GUEST will be refunded the difference between the two reservations plus 350.00 fee. Cancellations and early departures due to inclement weather do not warrant any refund of rent. In the event that Travel Insurance has been purchased for GUEST prior to cancellation, GUEST will not be refunded the amount paid for said Insurance by the Owner. Please direct questions to the insurance company directly regarding cancellations.

If GUEST cancels reservation within 90 days of scheduled arrival after it has been confirmed and the reservation cannot be rebooked, GUEST understands that all monies paid will not be refunded unless Trip Cancellation Insurance is purchased and the reason for cancellation is a covered condition under the Insurance policy. GUEST confirms that GUEST has read and understands the policy on Trip Interruption/Cancellation and maintains sole responsibility for its purchase. GUEST will work directly with the Insurance company to recoup funds.

CREDIT CARD AUTHORIZATION:

I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by "clicking" that I have read the terms and conditions of this property, I am bound by this agreement and I have signed "electronically”, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but are not limited to: damages beyond normal wear and tear; theft of property by anyone occupying premise during your stay (includes outside visitors), excessive cleaning charges, cable TV movie charges, shipping charges for forgotten items plus Concierge fee (trip fees etc), unreturned keys and fobs, and parking violations.

OWNER agrees to provide a statement of the damages and the cost of the repairs (if insurance does not cover damage) after they have been completed. If there is a refund due it will be returned after all repairs have been made.

Written Exceptions - Any exceptions to the policies contained within this agreement must be approved in writing in advance.

This Agreement shall be governed by the laws of the State of Florida.
