Check -in and Check-Out Times

Check in time is no earlier than 4:00 PM Eastern Standard Time, and premises must be vacated no later than 10:00 AM Eastern Standard Time on the ending date of the rental, so that housekeeping may enter promptly at 10:00 AM. For each 30 minutes you are late leaving, you could be charged $50.

Damage Deposit: We may require a separate deposit for damages. If there are any damages during your stay, you will be notified and statement will be sent to you via email. Your credit card could also be charged for the damages, if damages exceed deposit amount. By accepting the terms of this lease, you agree that your credit card may be charged. We return any damage deposits we may have requested..within 48 hours of your departure where no damage is found.

Damages:

In order to not have damages deducted from your deposit, and/or your credit card charged, the following must occur:

a) No damage is done to the unit or any of its contents including the linens.

b) No items are missing upon inventory check.

c) All debris, garbage and discards are placed in proper containers and all soiled dishes are placed in the dishwasher.

d) The maximum occupancy of the unit was not exceeded and there was no smoking or any evidence of smoking, or pets or any evidence of pets.

e) Unit is left in neat condition and all doors and windows are locked.

f) The Guest(s) is not evicted by the owner (or representative of the owner), the local law enforcement, or any security personnel.

Deposit: On a 2 payment ..A deposit may be due at the time the cabin is booked if your stay is more than 60 days away. You will be asked to pay the deposit by credit card at the end of the online booking process. Balances not paid when due are subject to forfeiture of deposit, and cancellation. An email will be sent as a reminder when the payment is due.

Cabin Set Up: When you arrive, the cabin should be clean and set up with linens and supplies. If the cabin has any cleaning issues, please call 361-387-4105 immediately. We will do our best to correct problems, but we must be made aware of the problem when you arrive. Any damage noticed on arrival should also be reported. If damage is not reported, your deposit may be charged for the cost of the repair after notice to you.

Check Out Procedure: If housekeeping finds the home has been left excessively dirty, you can be billed for the additional cleaning at a rate of $50 per hour. Beds should be left unmade with sheets and pillowcases left on the beds. Used towels/washcloths from bathrooms and kitchen, even pot holders if soiled should be placed in the nearest bathroom. All trash, and anything in the refrigerator you are not taking should be placed in the outside trash cans. Before leaving, please set the thermostat to 55 degrees in cooler months and 80 degrees in warmer months. Close and lock all windows. Make sure the keypad is set to lock icon, before you leave, and tv controllers are positioned in the correct room, as designated on the back of the remote. If there was any accidental damage, or something is not working, please email owners with a picture and details.

Supplied Items: Linens for 4 king beds. For maximum 8 guests, 8 bath towels, 8 wash cloths, 4 hand towels, 2 dish towels, 2 dish cloths, laundry detergent, dish detergent, automatic dishwasher detergent, bath soap, hand soap 1-2 roll paper towels, 1-2 roll(s) toilet paper per bathroom, and 2 trash can liners. You may need to replenish these start up supplies during your stay.

Hot Tub: If there is a problem with the hot tub, please contact me. Bromine is used to maintain water quality. Please note all safety warnings posted by the hot tub before using it. Use of hot tub is at your own risk. Pregnant women and those with pre-existing health conditions, or infected wounds are advised against using the hot tub. Children under 12 are prohibited from using the hot tub without supervision of their legal guardian. Guests should shower both before and after hot tub use. No oil or soap should ever be added, and if inspection reveals residue from oil, soap, food, alcohol, etc, guest can be charged a cleaning fee up to $100. Please do not stand or sit on the hot tub cover, as replacements are $400, and will be charged for replacement. Do not eat or drink in hot tub! Temp should be set at 100 degrees.

Gas Fireplace: The cabin has a gas fireplace. The fireplace is operable October 1 through February. Please do not put any items in the fireplace, rearrange or tamper with logs or associated timers. Turn on FP by timer on side. Do not touch anything except timer. If evidence of tampering, minimum fee for fireplace technician is $150, and you will be responsible.

OWNERS CLOSET or other Locked Areas May not be entered and criminal charges will be filed!!

Severe Weather: We do not refund rents or deposits due to canceled or shortened stays because of weather, including snow/ice. Departures, canceled stays, or late arrivals due to inclement weather do not warrant refund of rent or deposit. We highly recommend getting travel insurance for your trip. We also recommend 4 wheel drive and/or snow chains during Winter months.

Smoking Policy: Absolutely no smoking is permitted inside the cabin- NO EXCEPTIONS, and can result in immediate eviction, and a $300 fee for deodorizing. If you smoke on the deck, please do not throw butts on the ground. Make sure the butt is out and place butts in the outside ash can on the deck. If housekeeping has to pick up butts, there will be extra charges. Evidence of smoking inside will result in a charge of $300 to deodorize the home. This policy is STRONGLY ENFORCED.

Pet Policy: WE HAVE AND DO EVICT WITH NO REFUND FOR ANY PET IN CABIN!! PLEASE DO NOT RISK RUINING YOUR VACATION!! Absolutely no pets are permitted- NO EXCEPTIONS. If any evidence of pet(s) is found inside the cabin or on the premises, you will be asked to vacate immediately with no refund of rent and your credit card will be charged an additional $200 for violating the lease agreement will be added to your credit card. This policy is STRONGLY ENFORCED.

Accommodations: The cabin includes 4 king size beds. There are three full bathrooms with tub and/or shower, one 1/2 bath, one hot tub. Under no circumstances are furniture, bedding, mattress pads, utensils or any other item supplied with the rental property to be taken out, moved, or rearranged. Locked locations are used by the property owner, and are not included with this rental, nor are they to be tampered with. Driveway accommodates 5-6 vehicles, depending on vehicle size. Bringing a trailer or RV is not recommended. If you have a trailer or RV, you should look to alternate parking.

Satellite, and Internet:

We cannot guarantee any programs, events, or subscription levels. Guest(s) should not attempt to use Pay Per view services, remove/add any locked channels, nor remove/reattach any existing audio/visual cables including but not limited to TV’s, DVD players, movie projector or CD players. Guest(s) will be responsible for all service call charges at $200 Fine per occurrence if you have violated any of these provisions.

Internet Access:

Internet access is unlimited. Please do not download illegal materials that could threaten our access, or place us or you in a position of patent violation.

High Definition Audio and Visual Equipment:

Bella Vista Lodge is equipped with a High Definition movie projector in the theater. Guest(s) are strictly prohibited from tampering with, or interfering with, the sensitive components, cables, and interface of the system. No cables, plugs, DVD players, or stereo receivers are to be manipulated in any way from the original setup. No Xbox, Nintendo, Playstation, Wii, or any other similar gaming device is to be connected to the theater components. Doing so will result in an immediate NO EXCEPTION fine of $500, a high definition bulb replacement at $475 minimum, and an additional technician trip charge applied to the Primary Rental Guest(s) credit card. Service calls start at $149.00 and are charged by the hour. The nearest service center is in Sevierville, TN which operates Monday thru Friday 8 am to 5 pm. They charge a minimum of two hours round trip plus labor and parts. Charges for a High Definition Theater projector service call will be charged to the credit card on file. NO EXCEPTIONS.

Maintenance:

While owner cannot offer refunds or discounts for any amenity malfunctions (appliances, hot tubs, TVs, fireplaces, etc.), we do perform regular maintenance to insure good working order. Upon arrival, guests must report any maintenance issues immediately. If there is a problem, we will make every effort to correct it as soon as possible during regular business hours. Emergency issues (i.e., lack of power or water in cabin, severe leaks, fire, security issues, accidents, locked-out of cabin, etc.) should be reported immediately. Under most circumstances Sevier County Electric will know of outage due to smart metering. All non-emergency issues (i.e., appliance/amenity issues, etc.) should be addressed during regular business hours. Should a repair technician make a call to a rental property unit and find equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for service can be at the Guest(s) expense. Please note: AREA MINIMUM SERVICE CALL FEES START AT $75.00. Guest(s) understands and agrees that owners and/ or contractor may enter the rental property with prior notice at any reasonable time for the purpose of making any repairs.

Cleaning: Rates include initial linen setup and cleaning service at time of departure. There is no daily maid service. Additional paper items beyond the initial supply will be the responsibility of the guest. For longer stays, trash pickup and a hot tub check can be performed on the fourth day of the stay if you require and request this.

Maximum Number of Occupants: The cabin is to be occupied by no more than 8 persons at any time. Over 8 on premises anytime is prohibited. House parties/Events are not allowed. We will not rent to vacationing students or to anyone under 25 years of age unless accompanied by an adult guardian or parent. Any reservation obtained under false pretense will be subject to forfeiture of deposit and/or rental money and the party will not be permitted to check in, and/or subject to immediate law enforcement eviction with no refund of funds paid.

Left or Lost Items: If you realize you left something, please notify us, and if your item is found it can be shipped to you at your expense via UPS. We are not responsible for lost, left, or stolen items.

Cancellation Policy: THERE IS NO CANCELLATION OR NO SHOW OR EARLY DEPARTURE REFUND GIVEN FOR ANY REASON! We strongly recommend you purchase trip insurance offered at booking to protect your vacation investment.

Indemnification and hold harmless:

Guest(s) agree to indemnify and hold harmless the Owner for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property. This is including, but not limited to, any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The term “Owner(s)” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms “Guest(s),” “Licensee of Guest(s)” as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be at the rental property), where the context requires or permits.

Disputes: This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas, and shall be treated as though it were executed in the County of Nueces, State of Texas. If action relating to this Agreement is instituted in Nueces County, Texas, guest(s) specifically consents to such venue and jurisdiction and to extraterritorial service of process.

Directions:Will be provided with your Welcome Packet, which you should receive mid month prior to your check in month. Access information will be provided on your arrival date, but may not be provided prior to check-in time.

I have read and understand the above rules and regulations. By booking this property, I am agreeing to all terms and conditions in this document, including any and all cancellation terms and damage responsibility terms. I am at least 25 years old, of sound mind, and I am responsible for any and all damages that occur to the property or it's contents by me or any other member of my group, or any guest's licensee while I am the registered occupant of the property. I accept full responsibility for damages, fees, or extra cleaning charges should they be found during or after my departure. I understand and consent to the use of the credit card provided without original signature on the charge slip, and that this credit card authorization cannot be revoked and will not terminate until 30 days after the leased premises are vacated.
