Starry Nights Condo
Please print these Terms and Conditions for your records.
Please read this carefully. By making a reservation and/or staying at Starry Nights, you are agreeing to these conditions. Your booking legally binds you to acceptance and adherence of the policies listed below.
The property will be ready for occupancy at 3:00PM local time on the beginning date of the lease and must be vacated between 10:00 AM local time on the ending date of the lease. If you have not left the condo when our manager and housekeeping staff arrives, you will be charged a fee of $50.00. If your late check out prevents the next guest from checking in, then you will be charged an additional night. Please be on time. During high season, some units may not be ready by 4 p.m., your patience is appreciated.
The PREMISES is located at: 1380 Ski View Drive,Building 5- Unit #5303, Gatlinburg, TN 37738. This is the 3rd (top) floor unit, no elevators, and is not handicap accessible. This is located at the top of Ski Mountain, 3.5 miles from traffic light#10 in Gatlinburg, about an 8-10 min drive. Elevation approx 3500 ft.
After you reserve your dates for Starry Nights you will receive 2 more separate emails.One with the directions and one with the keyless access code (no keys). There is no formal check in as the owner knows that you will be arriving.Please do lock the door when leaving the condo to protect your belongings as well as the interior of the condo.
CANCELLATIONS: A sixty day notice is required for cancellation and a complete refund will be issued. Cancellations or changes that result in a shortened stay that are made less than 60 days notice of the arrival date forfeit the full rental fee. To protect your vacation investment you must purchase Travel Insurance. Therefore, we strongly recommend that you purchase Travel Insurance for your protection which can be purchased online through Travel Guard. Cancellation or early departure does not warrant any refund of rental fee without Travel Insurance.

INCLUSIVE FEES: Rates include a one-time linen setup and cleaning service at the time of departure. A starter supply of trash liners, paper towels, toilet paper, dishwashing soap, dishwasher detergent and bathroom soaps are provided. Extra items needed are the responsibility of the guest. (ie Bring your tooth paste, shampoo, laundry detergent, dryer sheets, beach towels for the hot tub, extra toilet paper etc.) There is NO DAILY MAID SERVICE.

SECURITY: We do not hold a security deposit, but you agree to pay for any damages that are reported. We reserve the right to charge your credit card for the damages and will report to you immediately when this occurs.

Any damage noticed upon arrival should be reported to the owner immediately. If damage is not reported, your deposit may be charged for the cost of the repair. All general maintenance should also be reported so the cabin is kept in good repair. Should there be anything taken from cabin you will be charged. Inventory is done at every arrival and departure of guests. You will not be charged if:

1.) No damage is done to the cabin or its content including linens and cabin is left in neat condition.

2.) No items are missing upon the inventory check.

3.) All debris, garbage and discards are placed in outside dumpsters.

4.) All soiled dishes are hand washed or placed in the dishwasher and started to wash cycle on departure. * Use the dishwasher soap provided.* Regular dish soap can ruin the dishwasher.

5.) There was no exceeding the maximum occupancy of the cabin.

6.) There was no smoking or evidence of smoking in the cabin. You are responsible for any damage caused by smoking.

7.) Fireplace is electric log, no dangerous or noncombustible material has been thrown in.

8.) No fireworks permitted on premises. No outdoor fires permitted on premises.

Heat/Air Conditioning:

Prior to departure in the summer please leave air on cool @ 75 and in winter heat @ 65.

Please turn off all lights inside and close blinds.

If these regulations are not met you will be charged an extra cleaning fee of $50.00 and depending on how messy or what has been damaged you will be charged accordingly to applicable repair quotes.

SEVERE WEATHER: We do not refund rents or deposits due to cancelled or shortened stays because of weather. It is advisable you come prepared for snow during the winter months with 4 wheel drive and/or snow chains. We highly recommend getting TRAVEL Insurance for your trip. It is up to the Guest to purchase this coverage for their trip. Coverage is available for health and weather related problems. Please call them direct or order online to purchase this in your name. Travel Insurance is available on this site, simply check the travel insurance box on our reservations page.

DAMAGE FEES: We understand that "things happen" and do make allowances for minor damages. However more extensive damages cannot be overlooked. Re-arranging the electric fire logs can cause damage and requires a maintenance call, with a minimum charge of $50 to reset the logs...more if the logs break. Damage to the property by guests will be charged according to the cost of repairs and we will provide you with a copy of the actual receipt.

HOT TUBS: Please shower before using the hot tub if you have used tanning oils or body lotions as these will impact the water quality and may damage the motor. Do not use bubble bath, soap or similar products in the hot tub or you may incur a fee for additional hot tub cleaning service, as the residue can be time-consuming to clean from the lines.

NO SMOKING PERMITTED: This is a smoke-free property and indoor smoking of any kind is strictly prohibited. You may smoke outdoors on the decks and cigarette butts must be disposed of properly. We take this very seriously and if you smoke inside the condo, you will be charged for any remediation costs, usually $300-600.

ABSOLUTELY NO PETS: No Pets are permitted. You will be asked to vacate immediately with no refund of rent or damage deposit.

THEFT OR LOSS OF PROPERTY: You are solely responsible for all personal items brought to the property. Please secure valuables while you are gone by placing them out of view, closing window blinds, locking all entry doors, etc. Our property insurance will not cover items brought into the cabin by outside parties. When you are away from the condo, check that all doors are locked and curtains or window blinds are closed.

FORGOTTEN ITEMS: If you believe you have left an item behind, contact Patti Smith, 419-349-3397 as soon as possible so we can have housekeeping search for your item. If they have to make a special trip, there will be a $25.00 service call fee plus the cost to ship the item back.

MINIMUM STAY: Minimum stay is 2 nights. We do require a 3 night stay for holidays.

UTILITIES: The landlord will provide water, heat, electric, and trash removal.

MAXIMUM NUMBER OF OCCUPANTS: The cabin is to be occupied by no more than 6 (Six) persons at a maximum. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups VIOLATION OF THIS PROVISION SUBJECTS GUEST TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM VACATION RENTAL.PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION: VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEWER .THEREFORE, IN THE EVENT GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN EIGHT PERSONS, GUEST SHALL BE RESPONSIBLE TO PAY LESSOR THE SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS

FALSIFIED RESERVATIONS; Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.

CREDIT CARD and/or CHECK AUTHORIZATION:

I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by "clicking" or sending a deposit check that I have read the terms and conditions of this property, I am bound by this agreement and I have signed electronically, and that this Credit Card Authorization and/or deposit check cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not limited to: unauthorized TV charges; damages beyond normal wear and tear; unreturned keys, and parking violations. YOUR ELECTRONIC SIGNATURE MEANS YOU AGREE TO ALL TERMS AND CONDITIONS AND WILL PAY ANY DAMAGES OR FEES WITHIN 10 BUSINESS DAYS OF NOTIFICATION

By renting and/or staying in our property, you acknowledge that there are potential dangers that can be life-threatening in and around our condo. You agree that you will not hold us responsible for anything that happens to you, any members of your party or to any of you and your party's personal property during your stay.

GUEST agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the GUEST, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.

These Policies and Procedures above are meant to protect you, our guests, and the owners alike. All guests, as well as owners are required to conform to all Policies and Procedures. We want you to have an enjoyable rental experience from Great Smoky Escapes!
