NOTICE

Please be aware that Vacations by Dana (Dana and Timothy Flynn) has no control over, and cannot be responsible for, conditions which may affect your planned vacation. This includes the closing of, or limitations on, use of the beach or waters as result of weather, health or other conditions; limitations on and/or interruption of travel whether by private vehicle or public transportation; or the closure or unavailability of local facilities such as restaurants, stores, pools, parks and other attractions. None of the foregoing conditions are grounds for cancellation of your rental and the cancellation policy will be enforced as written. We strongly encourage you to obtain trip insurance or other similar protection, in the event any of these types of conditions, limitations or closures are in effect at the time of your planned travel or vacation.

1. CHECK-IN TIME IS AFTER 3 P.M. CST, AND CHECK-OUT IS 10 A.M. CST. NO early check-ins or late check-outs unless expressly permitted in writing prior to check-in. We will provide early/late check-in/check-out as it is available, but this is not guaranteed and may depend on last-minute bookings that abut the dates of your stay. Please check-out ON TIME at 10AM. Your credit card authorization we have on file allows me to charge your credit card $100 flat fee if your late check-out affects the next check-in.

2. This is a NON SMOKING unit. You will forfeit your entire deposit if there is ANY smell of smoke in the unit! If you choose to smoke on the balcony, DO NOT LEAVE THE SLIDERS OPEN WHILE YOU SMOKE, and please dispose of your cigarette butts properly.

3. PETS are not permitted, under any conditions. This is a COA rule, not mine as the owner, and you will immediately be evicted if found with a pet.

4. AGE MINIMUM: We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. If you are an 'all-adult' group, every guest staying overnight in the condo must be 25 years of age or older. I reserve the right to charge an additional but refundable security deposit based on perceived risk.

5. BUNK BED CAUTION: All top bunks are used at your own risk. Queen bunks have no weight limit but they are meant for ADULTS ONLY. They are lacking some safety rails at end of bed which twin/twin bunks would nornally have. In the TWIN bunk room, NO persons over 12 years of age and/or over 150 lbs in top bunks as directed by manufacturer, for your safety! Please be aware of ceiling fans also in twin/twin bunk room, due to proximity to top bunk.

6. POOL TABLE POLICY: If you have young children who are not old enough to responsibly use the pool table, please hide the pool balls in top of laundry room and put away cue sticks to take away any temptation. Although you will have a damage insurance policy (see #7 below) this only covers ACCIDENTAL damages, and $3,000 will not even cover the cost of the pool table. Negligence is not covered by below insurance policy (see #7), and we have provided this as an upscale amenity, so please play by the RULES:
a) lower roller shades on west windows to protect the windows
b) break the racked balls AWAY FROM ANY WINDOWS, not toward them
c) no food, drinks, etc on the pool table – period! Rings where you have left your drink or food stains are NOT accidental and won't be covered by the damage insurance. Never sit on the pool table.
7. REQUIRED $49 ONE-TIME DAMAGE INSURANCE POLICY: In lieu of a large security deposit, we require a one-time $49 purchase of Travel Guard Accidental Damage Insurance, purchased automatically for you at the time of booking and the $49 is NON-refundable (unless your stay is canceled prior to check-in date).
Accidental Rental Damage Insurance
Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.
Please call the (866) number in the pamphlet for more info: TRAVEL GUARD DAMAGE INSURANCE TERMS. Please realize that if you practice negligence in any way and we cannot recoup the cost of damages using the insurance policy, we will pursue recompensation through a court of law.

Completing the CHECK-OUT LIST is still MANDATORY, and is outlined in the check-out details (found on the reverse of your welcome letter upon arrival) and also listed in #21, (a) through (i) below.

7A. ADDITIONAL SECURITY DEPOSIT DUE - discrectionary and by request only: in certain circumstances, we may request a security deposit IN ADDITION TO the $49 one-time damage insurance policy. This security deposit will be ADDITIONAL to rental charges, cleaning, parking, taxes, and the 1-time damage insurance policy charge. AS LONG AS RENTAL RULES ARE FOLLOWED, no damages are incurred, and check out requirements 22a - 22i are completed, the full secuirty deposit will be returned to same credit card within 48 hours of check out. In cases where secuirty deposit is required, we will WAIVE the credit card authorization form mentioned in #8 below - but the policies in 8A - 8D still apply and your security deposit will be docked accordingly per those rules.

8. CREDIT CARD AUTHORIZATION: at time of final payment, you will be provided a PDF credit card authorization to complete/sign, and email or fax back. This authorization must be returned before access details are provided. This authorizes me to charge your credit card for any of the reasons/amounts below:

A) $75 per electronic elevator key fob that is not returned - total of NINE provided
B) $100 late check-out charge if your late check-out affects the next guests’ check-in. ALL LATE CHECK-OUTS must be authorized in writing via email.
C) up to $100 for non-completion of the check-out list if it causes me to incur additional cleaning fees
D) any damages that are not covered under your Chartis Travel Guard Damage Insurance policy which covers up to $3,000 in accidental damages; this policy is emailed to you
upon booking.

9. RESERVATION DOWN PAYMENT: Approximately 20% of total due required to book but this may vary based on how far advance you book. Once you have committed to the dates, you will fill in the booking page provided by email, and use the credit card screen to pay a DOWN PAYMENT via credit or debit card. The down payment is applied toward your total rental charges due. BALANCE is due by credit/debit card OR personal check is accepted, as long as you are more than 10 days from your check-in date. My TEXAS mailing address for the check appears in your confirmation.

10. FINAL PAYMENT – The balance due of base rental charges, plus the one-time cleaning fee of $275, plus $25 parking pass per vehicle, plus Alabama lodging tax of 13% on that sub-total, THEN add one-time $49 damage insurance policy -- is due 45 days before your arrival date or by the timeframe we agreed to if I provided you more time to pay. Your final payment DUE DATE appears on your rental confirmation. I will e-mail you the reminder with balance due and payment details within a few days of your payment due date. Personal checks for balance due can be mailed to my TEXAS address that appears on your confirmation. After final payment, a lengthy PDF document is provided by email and it contains all check-in details along with local area info.

11. CANCELLATIONS -
Review the policies carefully for complete understanding. Call us if you have any questions.
We have two policies: one for short-term renters; another for long-term renters. All cancellations will result in payment of cancellation/administrative fees.
A) For Vacations less than one month in duration:
Cancellations that are made MORE THAN 60 DAYS PRIOR TO ARRIVAL will be refunded their initial down payment, minus an administrative fee of $200.
Cancellations made WITHIN 60 DAYS OF ARRIVAL or changes to contract that result in a shortened stay, will forfeit all payments. Early departure does not warrant any refund of rent or deposit.
B) For Vacations more than one month long in duration: Cancellations made MORE THAN 120 DAYS PRIOR TO ARRIVAL will be refunded the initial down payment refunded, minus an administrative fee of $250. Cancellations made WITHIN 120 DAYS OF ARRIVAL or changes to contract that result in a shorter stay, will forfeit full payment. Early departure does not warrant any refund of rent or deposit.
AS A COUTESY TO OUR GUESTS WHOSE CANCELLATION RESULTS IN FORFEITED PAYMENTS (does not apply to the administrative/cancellation fee), we will make the unit you had rented available on the rental market, and, if we secure another booking, we will issue a refund minus the admin fee. However, any differences in rental revenue will also be deducted from the refund. (We often must reduce our nightly rental price to entice guests to book on short notice.) There are no guarantees that we will be able to rebook your dates or refund your money.
We reserve your dates for you in advance, and we must assume you are coming - in good faith. When you cancel, we have already declined other opportunities to rent those dates to potential guests.

12. WEATHER/HURRICANE/STORM POLICY - No weather refunds are given - no exceptions. Weather is out of our control and predictions are unreliable. At time of booking, you will be offered the below policy.

13. BEACH AND WATER CONDITIONS - Our area is prone to hurricanes which may change the topography along the beach from year to year. Therefore, we cannot be responsible for "Beach Access." Steps and boardwalks may be missing or may not be replaced due to storm damage. The Department of Environmental Protection sometimes regulates the reconstruction of steps in narrow beach areas. There are many conditions that can affect or possibly close our Gulf waters, including but not limited to red tide, algae blooms, rough surf, seaweed, high bacterial counts, and oil spills. We are not responsible for water OR beach conditions and no refunds will be given for any beach access, boardwalk, or water condition problems.

14. CHANGES to your dates - will need approval but are usually possible as long as the dates are open and you have given me sufficient notice to rebook your previously booked dates.

15. MAXIMUM OCCUPANCY- The maximum number of guests for this condo is (14) persons, but max of 8 adults. NO ADULTS IN TWIN BUNK BEDS.

16. MINIMUM STAY: This condo requires a THREE (3) NIGHT MINIMUM STAY. Longer minimum stays may be required during holiday or peak periods. If a rental is taken for less than three days, the guest will be charged the three-night rate. This may be waived in the shoulder/off season or at last-minute, all at my discretion.

17. INCLUSIVE FEES - Rates include a one-time linen and towel setup, your parking passes, and departure cleaning. Amenity fees are included in the rental rate. We are happy to set up occasional cleaning for longer term rentals and you can pay the cleaning crew directly.

18. NO DAILY MAID SERVICE - While linens and bath towels are included in the unit, daily maid service is not included in the rental rate but is available at an additional rate. We provide several beach towels but please bring extras of your own if you have a full house. We do not permit bath towels or linens to be taken from the units for use on the beach.

19. RATE CHANGES - Rates subject to change without notice but not after you have completed your booking form and received a confirmation.

20. FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to forfeiture of down-payment, and/or rental money, and the party will not be permitted to check-in. If it is determined that you have more than the maximum number of guests in the condo, I reserve the right to force eviction or collect additional fees due to your faslifying the booking information.

20. WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance. Please make sure you have early or late check-in/check-out approval IN WRITING.

21. CHECKING OUT - make sure the CHECK-OUT LIST is completed (posted in the unit and on reverse side of your laminated WELCOME letter). Your credit card authorization allows me to charge up to $100 in excessive cleaning fees if you do not complete and the cleaning crew cannot get the condo clean in time for the next guest. Please be prompt at 10am for check-out.

a) empty all bagged trash into trash chute (in closet in hallway)
b) load and start dishwasher (no need to unload it)
c) load and start washing machine with bath towels and dishcloths (no need to unload or dry)
d) make sure rolling cooler and rolling beach cart have been rinsed and returned to hallway closet – do NOT leave them with food, trash, etc. inside – there are two outside showers on ground floor
e) pull back bed linens that were used – do NOT remake the beds that were used
f) if you used our beach towels, please wash and dry those the NIGHT BEFORE check-out, roll and put away in laundry room
g) pack or dispose of any perishables in fridge or pantry
h) make sure all (15) pool balls plus the cue ball and all cue sticks are returned to the pool table
i) MOST IMPORTANTLY: on your way out, leave EIGHT electronic key fobs hanging next to elevator – and put one back in the lockbox on the way out – a total of NINE FOBS should be returned. Your card will be charged if any fobs are missing as it’s very inconvenient for the next group and I will spend hours ordering/paying rush charges/picking up a new fob on short notice.
22. EVICTION - If guest is evicted by the owner, representative of the owner, local law enforcement, or the security company employed by the complex, there will be no refund of rents.
