Please print these Terms and Conditions for your records.
The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 11:00 AM local time on the ending date of the lease. During high season, some units may not be ready by 4 p.m., your patience is appreciated.
The PREMISES is located at: 1258 Bear Cub Way, Gatlinburg, Tennessee 37738
There will be two payments: $250.00 is due at the time of your reservation and the balance is due 30 days prior to checkin.
Cancellation policy: Any monies received will NOT be refunded.
Travel Insurance provided by TRAVEL GUARD:
Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). Please refer to product number 008573/008574 P1 & account # 97908.

TRAVEL INSURANCE: We offer and HIGHLY recommend Travel Insurance. A link is found on the reservation page.
ACCIDENTAL DAMAGE INSURANCE: In lieu of a security deposit, a $39.00 Accidental Damage Insurance Policy is applied to each lease. This policy provides coverage for up to $3000.00 in accidental damages. We reserve the right to charge your credit card for damages that exceed $3000.00 or for any damages not covered under this policy. You will be notified prior to any charges being placed.
Accidental Rental Damage Insurance

Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.
PETS are NOT permitted in this cabin. No exceptions. If you are found to have a pet in the cabin during your stay, you will be asked to vacate the property without refund and there may be up to a $500.00 charge for excessive cleaning.
CHECK OUT TIME IS AT 11:00AM. No exceptions please. Housekeeping must be able to enter the cabin at 11:00am. They only have a limited amount of time to get the cabin ready for the next guest, so please be on time. If you have not left the cabin when housekeeping arrives, you will be charged a fee of $100.00. If your late check out prevents the next guest from checking in, then you will be charged for an additional night. In the event that the guest has not vacated the property by 11am on the date scheduled for departure and the owners or housekeeping find that the guest is not present, owner or housekeeping will remove the guests belongings and hold at another location for pick up. This will only happen in the event the guests late check out would prevent the next guest from checking in that day. This event would also incurr a $100.00 excessive cleaning fee.
NO FIREWORKS ALLOWED ON PREMISES.
NO OUTDOOR FIRES ALLOWED ON PREMISES.
NO SMOKING ALLOWED INSIDE THE CABIN.
DEPARTURE: Renter agrees to leave the cabin in a respectful state. Please load the dishwasher and start it prior to departure. All linens will be replaced by housekeeping. Please place all trash in the outside bear proof containers beside the cabin. Should the cabin need excessive cleaning, there will be a $100.00 charge.
SEVERE WEATHER:
We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of rent or deposit. We HIGHLY recommend Travel Insurance for your trip. It is up to the guest to purchase this coverage for your trip. Coverage is available for health and weather related problems. Please call them directly or order online to purchse in your name.
Bear Cub Cabin is located in the mountains and it is recommended that you come prepared for snow during the winter months with 4 wheel drive and/or chains.
Travel Insurance is available on this site and we highly recommend you purchase it.
COMMUNITY RULES:
Guest agree to abide by rules of the community. These may be posted in the unit or at the community pool or office. These rules may change from time to time.
MINIMUM STAY:
This unit has a 2 day minimum with the exception of Thanksgiving and Christmas and New Years which has a 4 day minimum.
INCLUSIVE FEES:
Rates include a one-time linen setup. There is NO DAILY MAID SERVICE. Guests will need to provide their own paper items except an initial set up of trash liners and a paper towel roll and toilet paper is provided. Extra items needed are the responsibility of the guest. (ie Bring your tooth paste, laundry detergent, soap, kleenex, and extra toilet paper etc.)
UTILITIES:
The landlord will provide water, heat, electric, trash removal and local telephone usage. GUEST is responsible for all long distance calls made during tenancy.
RESTRICTIONS:
No trailers, boats, jet skis.
ACCOMMODATIONS:
One king, one queen, 1 twin bed.
LOCKED AREAS: Guest agree not to tamper with or enter any locked areas containing owners own personal effects. If locked areas are found to be tampered with, guest agrees to pay for any damages, loss or repairs resulting from their entry of the locked area.
HOT TUB, JACUZZI, APPLIANCES, ETC: Should you have any trouble with any of these appliances, please do not attemp to repair yourself. Please contact property owner or maintenance man immediately should this occur.

MAXIMUM NUMBER OF OCCUPANTS:
The house is to be occupied by no more than 5 (five) persons at a maximum. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups VIOLATION OF THIS PROVISION SUBJECTS GUEST TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM VACATION RENTAL.
FALSIFIED RESERVATIONS;
Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
GUEST assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
GUEST assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).
GUEST agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
GUEST and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
GUEST agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
GUEST agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the GUEST, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.
GUEST agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.
Upon not less than 24 hours notice, GUEST shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs.
In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from GUEST.
GUEST may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.
If GUEST abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.
In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.
Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.
The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures.
GUEST assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the GUEST.
PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION: IN THE EVENT GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FIVE PERSONS, GUEST SHALL BE RESPONSIBLE TO PAY LESSOR THE SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF FIVE PERSONS PER DAY FOR EACH DAY THE GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FIVE PERSONS.
CREDIT CARD AUTHORIZATION:
I understand and consent to the use of the credit card provided without original signature on the charge slip. I understand that by "clicking" that I have read the terms and conditions of this property, I am bound by this agreement and I have signed "electronically, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not limited to: unauthorized long distance telephone and satellite TV charges, damages beyond normal wear and tear, unreturned keys, excessive cleaning required after your departure, damage to towels and/or linens, damage of any kind to owners personal property, furniture, appliances, locked areas and parking violations.
