This is a vacation rental agreement for Mountain Hideaway Cabin Rental (MHCR) owners for the rental of A Peaceful Getaway Cabin. The rights and obligations of the parties to this agreement are defined below and provisions permitting the disbursements of rent prior to tenancy and expedited eviction of tenants. Your signature on this agreement, electronic acceptance signature on this website, or payment of money, is evidence of your acceptance of this agreement (4 total pages) and your intent to use this property for a vacation rental. The tenant understands the responsibilities hear written and agrees to abide by all terms of this agreement. The tenant will be provided an electronic copy of this said contract,

The tenant will be required to complete all contract information and provide driver’s license information. The contract must be signed by the tenant, failure to do so will result in termination of this said contract. Any legal dispute of this said contract from either party will be held in the State of Alabama/Walker County.

Property Damages

An inspection crew will inspect the property after each stay. If damages are reported, the tenant will be financially responsible for any damages/repairs and labor charges. If items must be replaced, the items will be charged at the actual replacement cost, plus any charges related to delivery. The NO PET, NO SMOKING policies must be followed. Failure to follow these policies will result in a $500 deep cleaning charge. This is the cost to remove the allergens from the log cabin. Damages to the hot tub cover will result in a replacement charge of $350. The tenant’s signature on this contract authorizes Mountain Hideaway Cabin Rental/Owner to charge their credit card for any damages/repairs that occurred during their stay.

INDEMNIFICATION AND HOLD HARMLESS, RIGHT OF ENTRY, ASSIGNMENT

Tenant agrees to indemnify and hold MHCR or property owners from and against ANY liability for any reason as a result of any cause, sustained by any person (including tenant guests) that may result on the premises, inside the unit, or while traveling to the property. MHCR or property owner assumes no responsibility for damages to any vehicle that may occur from storms, animals, or any other cause or reason while on the premises. MHCR or property owners assume no responsibility for road conditions to your cabin.

CANCELLATION POLICY:

1. A refund of monies paid to MHCR (minus a 3% credit card fee) will be given if you cancel your reservation 60 days before your arrival date. MHCR will not trip insurance premiums. * Contact Travel Companies regarding refunds*
2. No refunds of any kind with less than 60 days to your arrival date.
3. No refunds are given for weather, road conditions, Acts of God, Pandemics, Covid-19, mechanical failures at the rental, or any health or personal reasons.
4. The property owner has the right to cancel reservations due to uncontrollable circumstances, such as a natural disaster or any other cause that the rental may be unsafe or uninhabitable. If this should happen before your arrival date, you will be issued a refund. If this should happen during your reservation dates, a refund will be granted for all remaining nights left on your reservation. If you received discounts of ½ off nights or free nights these nights are rated on your last night of the reservation.
5. No refunds of any kind for winter weather before or during your reservation. Winter weather conditions are always a factor in the Smoky Mountain area. Four-Wheel drives are recommended during snowy conditions. Travel insurance is recommended on all reservations.

OCCUPANCY LIMIT: 5 Total Guests. Termination of the tenancy (eviction with no refund if the occupancy limit is not followed. Adults not to exceed (4) Beds: 1 king, 1 queen, 1 twin (not recommended for adults)

NO SMOKING & NO PET POLICY

SMOKING: NO SMOKING OR VAPING OF ANY KIND INSIDE THE UNIT. If smoking is detected inside the unit a $500 deep cleaning fee will be charged. PETS: ABSOLUTELY NO PETS ALLOWED! Tenant breach of the no pet policy shall result in termination of the tenant’s tenancy without a refund, plus the additional $500 deep cleaning fee will be charged. The tenant will be charged for any damages caused by the pet. The damages are accessed at the total replacement cost plus the labor expense for such repairs.

ARRIVAL/DEPARTURE:

Check-in time is 3:00 PM (EST)

Check-out time is 10:00 AM (EST) and is STRICTLY ENFORCED (Cleaners arrive at 10:05 to clean)

Rent: Tenant agrees to pay rent for the premises in the amount designated on the invoice that was accepted online. If a payment plan was selected as a form of payment, all payments must be made by the due date listed on the payment schedule. 50% due at booking remaining balance due 60 days prior to your arrival date. If your payment is late, your reservation will be canceled and the cancellation policy will apply. Return checks will be subject to a $25 NSF fee. Guests will also be fully responsible for any chargeback fees.

Travel Insurance

We recommend all guests consider the purchase of travel insurance. Mountain Hideaway Cabin Rental or Owners are not affiliated with the insurance providers. Any questions or disputes regarding travel insurance will be directly between the tenant/guest and the insurance provider. Mountain Hideaway Cabin Rental doesn’t collect these premiums and will not refund these purchases under any circumstance.

Winter Weather: MHCR or property owners holds no responsibility for winter road conditions. MHCR or property owners will not be held responsible for assisting guests to and from their rental cabin at any time during their stay.

Minimum Age for Leaseholder: Tenant must be at least 23 years or older at the time of booking. We do not accept reservations made by parents on behalf of their children who are under the age of 23. Any reservation obtained under false pretense will be subject to no refunds of any kind. The tenant/guest will not be permitted to check-in or evicted from the property.

Tenant Duties: Tenant agrees to comply with all obligations imposed by the vacation rental act. Tenant agrees not to use the premises for any activity or purposes that violates any criminal law or government regulations. NO PARTIES ALLOWED. The tenant’s breach of any duty contained in this paragraph shall be considered material and shall result in the termination of the tenant’s tenancy. ALL MONEY WILL BE FORFEITED AND TENANT WILL BE EVICTED.

Internet, Phone Services, Utilities, and Hot Tub: If there is an interruption of service of the WIFI, Cable, Phone,

Power or hot tub failures, this is out of the owner’s control. The owner will expedite any service calls to the providers to help get the utility service restored, no refunds or rate adjustments will be made. Any service interruptions will depend on the severity of the issue as to when the provider will get the service restored. Hot tub repairs that may be required during your stay are out of the owner's control. If the hot tub requires repairs during your stay, the maintenance technicians will work promptly in getting the unit repaired and available for your use as quickly as possible. If the hot tub requires additional parts to be ordered the time frame of repair will depend on the vendor and technician as to how long the unit will be out of working order. The hot tubs are well maintained however, mechanical issues can occur that are out of the control of the owners. No refund or rate adjustments will be made.

Notification of Owner: The tenant agrees to contact the owner promptly if they find something not working correctly. The owner will make every attempt to repair as promptly as possible. If repairs are required, the tenant agrees to provide access to the property.

Entrance to Premises: Tenant agrees that the owner/Mountain Hideaway Cabin Rental or their respective representative may enter the premises during reasonable hours to inspect the premises, to make such repairs, alterations or improvements thereto as the owner may deem appropriate.

Inventory: All items in the cabin are to remain in the cabin. Please do not remove items from the cabin. If items are missing after your departure the tenant will be charged for these items at replacement cost.

Movie Purchases: No pay per-view movie orders are allowed during your stay.

THEFT OR LOSS OF PROPERTY:

Guests/Tenants are solely responsible for all personal items brought onto the property. Mountain Hideaway Cabin Rental or the property owners will not be responsible for any type of theft or loss of any kind. MHCR or property owners assume no responsibility for any items that you may leave at departure.

Security Cameras will be active in the parking area. If the camera is altered or covered for any reason during your stay, the tenant will be evicted with no refund.

Wildlife: Wildlife is becoming very popular in our areas. DO NOT FEED THE WILDLIFE! It is illegal to feed wildlife in the area. It is recommended by the wildlife departments to keep all car windows rolled up and remove any and all food/candy from inside your vehicles. Bear are attracted to food and they have a very keen sense of smell. Mountain Hideaway Cabin Rental/Owners will not be held responsible for any damages from wildlife to the tenant’s property or vehicle.

Departure Checklist: The tenant agrees that they are responsible upon departure for securing all doors and windows, turning off all appliances, and alarming the security system if one is active inside the unit. The tenant agrees to complete a departure checklist upon their departure. The departure checklist is located with all guest information in the cabin.

VOLUNTARY TRANSFER (SALE) OF PROPERTY:

If this rental unit is transferred to new ownership (sold) during this contract, the tenant will be notified as soon as possible and will be issued a refund of all paid money.

Guidelines by the State of Tennessee, Sevier County Tennessee, and the CDC:

The tenant takes full responsibility for his/her guest adhering to all guidelines and regulations recommended and or imposed by the CDC, the State of Tennessee, and Sevier County Tennessee, including all municipalities therein. Mountain Hideaway Cabin Rental/Owner or their employees/contractors shall not be liable to any guest who fails to adhere to these guidelines.

HOT TUB USE AND LIABILITY RELEASE:

Mountain Hideaway Cabin Rental or Owners assumes NO RESPONSIBILITY for hot tub use. USE OF THE HOT TUB IS AT THE TENANT/GUESTS OWN RISK. Mountain Hideaway Cabin / Owners will not be responsible for any accidents, injuries, illnesses, deaths, or damages caused by hot tub use.

DO NOT use the hot tub if you are under the age of 16, pregnant, suspect that you are pregnant, have high/low blood pressure, heart conditions, or ANY medical illness, medical condition, or skin allergies. ALWAYS CONSULT WITH YOUR PHYSICIAN PRIOR TO HOT TUB USE!!

**DO NOT SUBMERGE IN HOT TUB WATER**

**NO PERSON UNDER 16 YEARS OF AGE ALLOWED IN HOT TUB**

1. Keep hot tub covered while not in use
2. Supervise all children while on the deck/porch
3. DO NOT leave children unattended for any reason
4. Lift hot tub cover using center handles not the corners
5. Shower before entering hot tub
6. DO NOT use any products in the hot tub, such as bubbles, soaps, lotions
7. Limit hot tub use to 15 minutes per use
8. DO NOT wear jewelry in the hot tub
9. WARNING: Hot tub chemicals may discolor clothing, jewelry, or hair USE AT YOUR OWN RISK!

10. DO NOT enter the hot tub with food, glass, or while under the influence of alcohol or drugs

11. DO NOT use electrical appliances near the hot tub
12. NO DIVING or roughhousing in the hot tub
13. DO NOT allow water levels to get below the black filter area. Excessive use of the hot tub may require the guest to add water to the unit
14. Use CAUTION when exiting the hot tub, the deck may be slippery when wet.
15. Turn JETS OFF after use
16. Cover Hot Tub Immediately after use
17. Shower immediately after hot tub use
