RENTAL AGREEMENT

1. CANCELLATION/REFUND POLICY:
A. Cancellations made more than 60 days (90 days for 4th of July, Thanksgiving, Christmas & New Years rentals) of arrival will receive a full refund if you desire not to reschedule. There will be a $50 cancellation fee if less than 4 nts, $100 for 4-7nts, $200 for more than a wk, and $300 for more than 2 weeks,$400 for more than 3 wks, etc. Refund will be returned via check.
B. No refund will be given for cancellations made within 60 days of arrival
(90 days of arrival for 4th of July, Thanksgiving, Christmas & New Years rentals). Please realize that the Smoky Mountain area can have treacherous driving conditions. Please anticipate this in your travel plans. See insurance that is offered.
C. Guests cancelling before 60 days of arrival date will be given the opportunity to reschedule anytime within 1 year. A $75 processing fee will be incurred. Rescheduling to a time that rents for a higher rate will require additional funds from the guest. Rescheduling during a time that rents for a lesser rate does not warrant refund of difference. For peace of mind regarding cancellations, purchasing private travel insurance is recommended. See insurance that we offered on our site.
D. No refunds will be given for any kind of unpleasant weather conditions. Encountering less than ideal vacation weather in no way entitles the guest to any kind of refund. See insurance that is offered.
E.An email receipt from owner with date of your cancellation will be required in order to obtain cancellation funds.
F. We employ a personal friend, with many years of Hospitality experience to maintain and clean our cabin. She can deal with any problem that should arise with the cabin. Her phone number is located inside the cabin and supplied to you in the information you will receive upon receipt of final payment. Please contact her immediately if any maintenance related problems arise such as: appliance breakdown, electrical problems, leaking pipes, cable outage, etc. The occurrence of any mechanical breakdown of any kind, of any duration, does not entitle the guest to any kind of refund. Cable TV or wireless internet service outage does not entitle the guest to any kind of refund. If the cabin has not been cleaned upon your arrival, please notify her. Also, if you feel the cabin was not cleaned sufficiently, please contact her directly, so she can correct the discrepancy. Neither situation entitles the guest to a refund.
G. The final decision regarding any and all refunds, full or partial, rests entirely with the cabin owners.
2. GUEST RESPONSIBILITIES:
A. Beary Awesome is our actual vacation home. Please respect our property and treat it as you would your own.
B. Housekeeping cleans the cabin after your departure. They will notify us of any damage to the unit beyond normal wear and tear. Please be honest and inform us of any such occurances. An offer for fair payment for any damage will be determined. Failure to do so will result in denial of future rental privileges and possible legal remedy. To avoid extra cleaning charges, please leave the cabin neat and orderly. If the cleaning crew finds the cabin has been left excessively dirty, you will be responsible for the extra cleaning costs.
C. Our cabin is not to be used for any 'wild parties'. We are renting to you and whomever you bring with you. Do not leave 'party-prone' people unattended at our cabin. Respect your neighbors and keep the noise level down. Our Housekeeper does periodic drive-by inspections of the property. If she sees anything unusual, we will be notified and the appropriate action will be taken.
D. By agreeing to these rental terms, you are agreeing that the owners or their legally designated representative will have access to the cabin at any reasonable time of day or night. We would not dream of dropping in on you unannounced. We would attempt to contact you prior to the visit. However, you never can tell what could come up. Also, you agree to give admittance to pest control technicians who treat the cabin on a scheduled basis.
E. Check-In time is after 4:00pm, Check-Out time is by 10:00am. Housekeeping requires adequate time to prepare our cabin for the next guests. We will be immediately notified of failure to vacate the cabin and will attempt to handle the situation over the phone. If unsuccessful, local law enforcement will be contacted. Any and all legal remedies will be used to rectify the situation and prosecute the violator. At the very least, your security deposit will not be returned. Also, do not attempt to arrive earlier than 4:00pm arrival time.
F. The cabin is not pet friendly. If evidence of pet is found in cabin you will be charged a minimum of $200.00.
G. Please do not add anything into the Hot Tub. Any kind of soap, bubble bath, oils, etc., can damage the pump and/or filter system. The Hot Tub is checked, cleaned, and sanitized after each guest departure. The guest is expected to pay for the repairs of any damage found. Please abide by the Hot Tub rules listed on the hot tub.
H. Do not place food or drink on the pool table. Do not sit on the pool table. It too is inspected for damage. The guest is responsible for any damage found.
I. *****NO SMOKING INSIDE OF CABIN. **********Your security deposit will not be returned if Housekeeping finds evidence of smoking inside the cabin. Smoking is allowed outside the cabin only.
*********NO PETS- SEC DEP WILL NOT BE RETURNED IF PET HAIR IS FOUND.
J. YOU MUST BE OVER 21 YEARS OLD TO RENT AHHH...THE VIEW!!! CABIN. No minors are to be left in the cabin unsupervised.
K. Cabin Accommodations: 8 guests maximum - 3 Kings/1 Queen Sleeper Sofa/1 Queen Futon. If it has been determined more than the approved number of guests are staying at the cabin - you will be asked to vacate immediately. No refund or security deposit will be returned.
3. HOLD HARMLESS AGREEMENT:
A. Anyone renting property from the owners hold the owners or MBD Management completely harmless for any accident, injury, or sickness whatsoever that may occur on the rental property during occupancy. This includes, but is not limited to, any Acts of God, wildlife encounters, swimming accidents, use of the hot tub, bicycle mishaps, accidents on ice or snow, etc.
B. We are not responsible for guests' personal belongings that are lost, stolen or left behind. Please check your belongings carefully before leaving.

4. Access Information will be sent when payment in full is received by owner.
