This Rental Agreement (the “Agreement”) is made by and between Lax Consulting, LLC (the “Homeowner”) and guest (the “Guest”) as of the date Agreement is accepted online at the time the reservation is made. For good and valuable consideration, the sufficiency of which is acknowledged herein, the parties hereby agree as follows:

PROPERTY: The property is located at Holiday Surf & Racquet Club, 510 Gulf Shore Drive, Unit #419, Destin, FL 32541 (the “Property”). The Property is furnished and includes a full kitchen with cookware and eating utensils.

RENTAL PARTY: The Rental Party shall consist of Guest and members of Guest’s party, not to exceed five (5) total occupants.

MAXIMUM OCCUPANCY: The maximum number of guests is limited to five (5) persons.

TERM OF THE LEASE: The lease begins at 4:00 PM on the date of check-in (the “Check-in Date”) and ends at 10:00 AM on the date of departure (the “Check-Out Date”).

ARRIVAL: Guest will receive a check-in code from the Homeowner to enter the condo. The code will work after 4:00 PM on the day of check-in, unless otherwise stated, and will not work after 10:00 AM on the day of check-out. Upon arrival, please stop at the gate and follow the posted instructions to contact Guest Services. They will “buzz” you in.

RESORT AGE REQUIREMENT: Guest understands and agrees that at least one member of the Guest Party is 25 years of age or older, and that Guest ID will be checked upon arrival by Guest Services. This is a requirement of Holiday Surf & Racquet Club and Holiday Isle. They will deny the rental if this age requirement is not met and all moneys paid will be forfeited.

GUEST PARKING PASS: Guest agrees to register with Guest Services upon arrival to obtain a Guest Parking Pass and to provide other registration information as required by Holiday Surf & Racquet Club. The Guest Pass must be displayed in the dashboard of your vehicle to ensure that your vehicle is not towed.

MINIMUM STAY: This property requires a three (3) night minimum stay. Longer minimum stays may be required during peak and holiday periods.

RENTAL RULES: Guest agrees to abide by the Rental Rules incorporated herein at all times while at the Property and shall cause the Guest’s Party and anyone else Guest permits on the Property to abide by the Rental Rules at all times while at the Property. Failure to comply could result in Guest being fined or, in extreme cases, asked to leave by the Holiday Surf & Racquet Club Homeowners Association.

HOUSEKEEPING RULES: Guest agrees to abide by the Housekeeping Rules while at the Property and shall cause Guest’s Party and anyone Guest permits on the Property to also abide by the Housekeeping Rules, or be subject to deductions from the Damage Deposit. Guest also understands and agrees to empty the trash and refrigerator and to run the dishwasher upon departure. Failure to do so may result in forfeiture of the $40 incidentals deposit.

PETS: Pets are NOT allowed. If evidence of a pet is found inside the condo, you will be asked to leave and an additional cleaning charge of $250 will be assessed for cleaning and disinfecting the condo.

SMOKING: Smoking is strictly prohibited inside the condo and on the balcony. If evidence of smoking is found in the condo, you will be charged an additional fee of at least $250 to clean and deodorize the condo.

SWIMMING POOL: The in-ground swimming pool may pose an inherent risk to Guest and Guest’s Party. Guest agrees to accept full responsibility for the safety and supervision of Guest’s Party and specifically agrees that no minor children will be allowed in the pool area without continuous adult supervision. Guest is aware that there is no lifeguard on duty at the pool.

BEACH SAFETY: Please be aware of and follow the beach flag warning system for swimmers and surfers at all times. Flags are positioned at all public beach accesses with descriptions posted at the entrance of the access. It is vital to the safety of Guest and Guest’s Party that the warning system is understood and adhered to. Further, Okaloosa County does not permit beach chairs, tents, umbrellas, etc., to be left on the beach overnight. Any such items left on the beaches of Okaloosa County are subject to removal.

ACCESS: Guest shall allow Homeowner access to the Property for purposes of repair and/or inspection, and Homeowner shall exercise such right of access in a reasonable manner.


  1. Deposit: A fee of $549 is due at the time the reservation is made to hold the reservation, and will be applied to the total rental amount.
  2. Rental Rate: Payment in full of the fees quoted to you with your registration shall be due at least 60 days prior to Check-in Date.

ACCIDENTAL DAMAGE INSURANCE: Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

TRAVEL INSURANCE: Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or Please refer to product number 008573/008574 P1 & account # 97908. CANCELLATION POLICY: If Guest must cancel the reservation, payments will be refunded as follows:

  1. If cancelled 61 days or more prior to Check-in Date, your deposit, less the cost of the travel insurance, will be refunded.
  2. If cancelled 60 days or less prior to Check-in Date, the entire rental fee will be forfeited. We highly recommend purchasing the optional travel insurance, described above, to protect your investment should your plans change unexpectedly. No refunds will be given 60 days or less prior to your scheduled arrival date.

PAYMENT: Homeowner will accept payment by credit card or eCheck through the website.

The parties acknowledge and agree to the terms of this Rental Agreement as set forth above and the Holiday Surf Rental Rules below.


  1. Smoking is NOT allowed inside the condo or on the balcony. Smoking IS allowed in designated areas outside the building.
  2. People other than those in the Rental Party set forth above may not stay overnight in the Property. Any other person in the Property is the sole responsibility of Guest.
  3. All of the condominium units in this building are privately owned. Homeowner is not responsible for any accidents, injuries or illnesses that occur while on the premises or its facilities. The Homeowner is not responsible for loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that Rental Party is expressly assuming the risk of any harm arising from their use of the Property or others whom they invite to use the Property.
  4. Rental Party must keep the Property and all furnishings in good order.
  5. Rental Party will only use appliances for their intended purposes.
  6. Pets are NOT allowed.
  7. Parking passes are issued at the registration desk in the lobby of the building. Guest must display parking pass on the dashboard of his/her vehicle at all times. Failure to display the parking pass may result in the vehicle being towed at Guest’s expense, per resort policy. Please deposit the parking pass in the slot as you exit the gate after check-out.
  8. There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. PLEASE REMEMBER TO BRING YOUR OWN BEACH TOWELS, as we do not permit towels or linens to be taken from the unit. Please check inside bathroom vanities for extra towels and wash cloths.
