SHORT-TERM LODGING AGREEMENT

Annie Switzer, the Owner, (Address: 5811 Ipswich Road, Bethesda, MD 20814, Annie cell (240)498-0074) agree to rent Property (Sunset Bay Villas, 6321 Captains Lane Unit #213, Chincoteague Island, VA 23336) to (Name, Address, Home Phone, Cell Phone, Email) from Date1 to Date2 for the sum of Rental Rate plus a refundable security deposit of $500 (payable by credit card hold).


Person reserving this property must be the person checking in, or Owner has the right to refuse occupancy and treat this reservation as a cancellation and retain deposit. The Property must be occupied by the Guest identified herein and all occupants of the premises shall be supervised by that Guest for the entire duration of the rental period. The occupancy shall not exceed 8 persons (or the number of persons listed above) without written approval from Owner. Guest agrees that this Agreement may not be assigned or the Property sublet for any reason. Renting on behalf of minors or bringing pets on premises is prohibited. Violation of this provision shall be grounds for immediate eviction.

Payment
A deposit of one-half the rent is due when the reservation is made. Please pay by personal check or through online payment link. If a reservation is made less than 30 days in advance, full payment is required. Receipt of your deposit along with a signed Agreement is confirmation of your reservation. Review the Agreement for accuracy and return a signed copy to us by email. Payment in full is due 30 days prior to check-in. Mail your balance payment at least 30 days in advance to the following address (or use online payment link): 5811 Ipswich Road, Bethesda, MD 20814.

Security Deposit
A security deposit of $500 is required and is due no later than 30 days prior to arrival. The security deposit will be processed within 30 days of check-out (or earlier) and will be returned to guest less any costs for repairs or excessive housekeeping charges if property is not left as required. Any pre-existing damage must be reported to the Owner upon check-in. Otherwise, Guest is responsible for damage by himself, any family member, or other guest.

Here are some examples of damage that renters will be responsible for:

• Damage to the walls, floors, or upholstery. In recent years, we have had children draw on our walls intentionally or do art projects on our bedding. We have even had furniture pushed into the wall. We love kids (ours & yours) but they need to be supervised. Please try to avoid moving furniture (and especially dragging furniture on the hardwood floors).
• Breaking a piece of furniture due to misuse (for example, jumping on a rattan chair that has no springs).
• Violation of the no smoking or no pets policy will result in forfeiture of the entire security deposit and may result in eviction from the premises if owner becomes aware of this during your stay.
• Damage to the washing machine or dishwasher or any other appliance due to misuse.

We want our guests to enjoy their vacation. Unfortunately, in recent years we have found that a few of our guests have caused quite a bit of damage due to their general disrespect for our vacation home, which is surprising since we speak to each of our guests during the booking process. Please refer to Check-Out Time regarding cleanliness of the unit and possible excessive housekeeping charges.

Check-In Time
After 3:30 PM, unless otherwise noted in your Agreement. Property is cleaned between 11:00 AM and 3:30 PM. Please note that our cleaner reserves the right to charge $25 per interruption for arrivals prior to 3:30 PM when the cleaning team is still there working. This means you may not store your luggage or food in the unit during the cleaning. Restroom and outdoor shower (seasonal) and are available in the gym/pool area. If there is a problem with the cleanliness of the unit at check-in, please call our cell phone at (240)498-0074, so we can address it with the cleaner during business hours.

Check-Out Time
Checkout time is 11:00 AM. There will be an additional charge if the property is not vacated by the time the cleaners arrive. The cleaner may charge $25 per 15 minutes of waiting time. Guest agrees to pay an excessive housekeeping fee of $100 if property is not left in the following condition:

1. Remove all food from refrigerator and all trash from property
2. Clean dishes and utensils and store them properly
3. Make beds (i.e. mattress pads, pillows, and comforters arranged)
4. Leave furniture arranged properly
5. Check all drawers and closets for personal items
6. Close windows and lock the doors when leaving; return the keys to lock box by specified date/time.

* Ladder on Boat Slip #49 should be pulled out of the water if boat slip was part of the rental.

Guests are responsible for the property until all keys are returned (per agreement with Owner) and property is vacated.

Our cleaner does not routinely find surfaces such as counters, tables, cabinets, and floors covered with spills and trash strewn about the house. They will report this to the homeowners who will decide if the excessive housekeeping fee will apply. Guests are expected to tidy up after themselves during the week. Our cleaners have a minimum expectation of how to find our place, and it is not often that they report issues for excessive housekeeping or damage.

Cancellations
Cancellations will be charged 15% of the gross rent if the property is re-rented for the full amount. If property is not re-rented for the full amount, the full rental deposit is forfeited. All cancellations must be in writing. Your reservation will be in effect upon receipt of your deposit and the cancellation policy will apply. No refunds will be given for inclement weather, including hurricanes, or for activities beyond control of Owner. We strongly recommend purchasing trip insurance.

Linens, Cribs, Supplies
Guest must provide their own towels, cribs (a Pack N Play is available), paper products and soap. Kitchens are equipped with dishes, flatware, glasses, pots and pans. Bath towels in the condo are provided as a convenience year round. Laundry service is not included. Linen service for the sheets is included. Simply place the used linens on top of the washing machine.

Parking
There are unassigned parking spaces outside the building. Owner is not responsible for illegally parked vehicles. Boat trailers, or any other type of trailers, are not permitted to park in the Sunset Bay Villas parking lot.

Pets & Smoking
Pets are prohibited on premises. This is a non-smoking property.

Swimming Pools
The outdoor pool is open from Memorial Day to Labor Day. Please make sure that everyone in your group observes the rules posted in the pool area. Pool may be closed periodically for maintenance without notice. The exercise room is available to guests. To enter, please enter 1,9,8,6 on the keypad lock. The blue light will indicate the door is unlocked.

Telephones
We do not offer a land line in this unit. We do have DSL internet with WiFi. Please see the instructions in our guestbook for accessing our network.

Grills
Fire Ordinance: Grills of any kind are not permitted in any multiple unit buildings or on decks or balconies. Charcoal grills are available for use in the picnic areas by the Coast Guard station and the parking lot in front of the building by the pool. PLEASE REMEMBER TO CLEAN UP THE GRILL & EATING AREAS.

Special Comments
No reduction of rent will be issued for a mechanical failure of any appliance, tv, or interruption in cable or phone service (due to the utility company). If such a failure occurs, Owner will make every effort to have appliance repaired or corrected. Replacement of tv’s, dvd/vcr, and microwaves cannot be guaranteed.

There is no implied Landlord/Tenant relationship (subject to laws of the State of Virginia) by virtue of this Short Term Lodging Agreement.

If for any reason the Guest is denied access to the Property, the Owner’s liability is limited to the return of monies received.

This is a legally binding contract.
