This Short Term Rental Agreement (the “Agreement”) is made by and between Mark and Carol Wrinn (“Homeowners”) and the “Guest” as indicated on the confirmation E-mail as of the dates set forth on that E-mail or as listed below. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
Property. The property is located at: 10611 Front Beach Road #1401, Panama City Beach, FL 32407
The property is fully furnished and includes customary appliances, utensils, linens and towels.
Rental Party: The rental party shall consist of the persons stipulated in the reservation confirmation E-mail or as listed below. You must be at least 25 Years of age and be present for the entire stay to faithfully execute this agreement. No additional persons may remain in the unit overnight without owner’s permission. Pets are not allowed. Maximum Occupancy: The maximum number of guests is limited to 8 adults (over the age of 16) and 5 children.
Term of the Lease. The lease begins at 4 PM on the “Check-in Date”) and ends at 10 AM on the “Checkout Date” listed on the reservation confirmation e-mail.
Rental Rules: Guest agrees to abide by this agreement and the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else the Guest permits on the property to abide by these rules at all times while at the property. You agree and fully understand that in the event that you or anyone in your party is evicted for breaking Ocean Ritz Property Rules and Regulations or Florida Statutes or the stipulations of this rental agreement, that you automatically forfeit your entire damage deposit as well as the nightly costs associated with your nonuse of my unit due to your eviction.
Access: Guest shall allow Homeowner and his agents access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
Deposits, Rental Rate and Fees are as published on our web sites
Deposit: A deposit of 50% is due on booking unless other arrangements have been made. The remainder is due no later than 30 days prior to stay. Reservations will not be held if funds are due.
A $500.00 security deposit is required and will be fully refunded unless the following conditions occur:
Theft or Intentional damage to the property or furnishings;
Guest does not comply with unit signage concerning condition to leave unit in.
Failure to depart unit at scheduled check out time
Dirt or other mess requiring excessive cleaning; or
Any other unusual cost incurred by Homeowner due to Guest’s stay.

Cancellation Policy: If Guest wishes to cancel his/her reservation, deposits will be refunded as follows:
100 % if cancelled 30 days prior to the Check-in Date on weekly rentals
Deposits on rentals are non refundable after 30 days prior to check in
If you booked through Home Away/VRBO that sites refund policy takes precedence.
Insurance: We encourage all renters to purchase traveler insurance.
Payment: Preferred payment is by E check or credit card using the secure servers on our web sites. Other forms of payment may be used on a case by case basis. Payments made within 30 days of stay must be made by credit card.
The parties agree to the terms of this Short Term Rental Agreement, as evidenced by their participation in the on line booking process or by signature below.

Smoking is NOT allowed anywhere Ocean Ritz 1401 to include the balcony. An extra cleaning fee of up to $1000.00 may be charged if evidence of smoking is detected in the unit.
People other than those in the Guest party set forth in the VRBO reservation confirmation e-mail may not stay overnight in the property. Any other person on the property at the invitation of the guest is the sole responsibility of the guest. Unit may not be sublet.
All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
Keep the property and all furnishings in good order
Only use appliances for their intended uses
Pets are NOT allowed.
Parking passes and Armbands:
Parking pass and Armbands are located inside the unit. Guests should display Ocean Ritz parking passes while parked Ocean Ritz Parking. Failure to display parking pass may result in towing of vehicle at renter's expense. Wristbands should be with you while in the common areas of the Ocean Ritz Resort.
Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We provide some beach towels. We do not permit bath towels or linens to be taken from the units.
Hot Tub: No children under the age of 16 permitted in hot tubs without adult supervision.
Water and Septic: The septic system is very effective; however, it will clog up if improper material such as rice or grease poured down drains. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime.
If there is a storm or hurricane, no refunds will be given unless:
The state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or
A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest.
The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
Any unused portion of rent from a guest currently registered;
Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and
Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.
Evidence of drug use and/or underage use of alcohol is grounds for immediate eviction. Names of responsible adults will be forwarded to police authorities for legal action.
