SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between Mark and Carol Wrinn (“Homeowners”) and the “Guest” as indicated on the confirmation E-mail as of the dates set forth on that E-mail or as listed below. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

Property.

1. The property is located at: 10611 Front Beach Road #1401, Panama City Beach, FL 32407

2. The property is fully furnished and includes customary appliances, utensils, linens and towels.

  1. Rental Party: The rental party shall consist of the persons stipulated in the reservation confirmation E-mail or as listed below. You must be at least 25 Years of age and be present for the entire stay to faithfully execute this agreement. No additional persons may remain in the unit overnight without owner’s permission. Pets are not allowed. Maximum Occupancy: The maximum number of guests is limited to 8 adults (over the age of 16) and 5 children.

  1. Term of the Lease. The lease begins at 4 PM on the “Check-in Date”) and ends at 10 AM on the “Checkout Date” listed on the reservation confirmation e-mail unless modified in writing by owner.

  1. Rental Rules: Guest agrees to abide by this agreement and the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else the Guest permits on the property to abide by these rules at all times while at the property. You agree and fully understand that in the event that you or anyone in your party is evicted for breaking Ocean Ritz Property Rules and Regulations or Florida Statutes or the stipulations of this rental agreement, that you automatically forfeit your entire damage deposit as well as the nightly costs associated with your nonuse of my unit due to your eviction.

6. Access: Guest shall allow Homeowner and his agents access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

  1. Deposit: A deposit of 50% is due on booking unless other arrangements have been made. The remainder is due no later than 30 days prior to stay. Reservations will not be held if funds are due.

A $500.00 security deposit is required and will be fully refunded unless the following conditions occur:

  1. Theft or Intentional damage to the property or furnishings;
  2. Guest does not comply with unit signage concerning condition to leave unit in.
  3. Failure to depart unit at scheduled check out time
  4. Dirt or other mess requiring excessive cleaning; or
  5. Any other unusual cost incurred by Homeowner due to Guest’s stay.

  1. Cancellation Policy: If Guest wishes to cancel his/her reservation, deposits will be refunded as follows:

100 % if cancelled 30 days prior to the Check-in Date on rentals

Deposits on rentals are non refundable after 30 days prior to check in.

  1. Insurance: We encourage all renters to purchase traveler insurance.

  1. Payment: Preferred payment is by E check or credit card using the secure servers on our web sites. Other forms of payment may be used on a case by case basis. Payments made within 30 days of stay must be made by credit card.

The parties agree to the terms of this Short Term Rental Agreement, as evidenced by their participation in the on line booking process or by signature below.

RENTAL RULES

  1. Smoking is NOT allowed anywhere Ocean Ritz 1401 to include the balcony. An extra cleaning fee of up to $1000.00 may be charged if evidence of smoking is detected in the unit.
  2. People other than those in the Guest party set forth in the online reservation confirmation e-mail may not stay overnight in the property. Any other person on the property at the invitation of the guest is the sole responsibility of the guest. Unit may not be sublet.
  3. All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

4. Keep the property and all furnishings in good order

6. Pets are NOT Allowed

Parking passes and Armbands:

Parking pass and Armbands are located inside the unit. Guests should display Ocean Ritz parking passes while parked Ocean Ritz Parking. Failure to display parking pass may result in towing of vehicle at renter's expense. Wristbands should be worn you while in the common areas of the Ocean Ritz Resort.

Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We provide some beach towels. We do not permit bath towels or linens to be taken from the units

Hot Tub: No children under the age of 16 permitted in hot tubs without adult supervision.

Water and Septic: The septic system is very effective; however, it will clog up if improper material such as rice or grease poured down drains. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime.

Storms:

If there is a storm or hurricane, no refunds will be given unless:

Evidence of drug use and/or underage use of alcohol is grounds for immediate eviction. Names of responsible adults will be forwarded to police authorities for legal action.

SPECIAL COVID 19 RENTAL RULES AND SUGGESTIONS

Guests shall strive at all times to adhere to the following guidelines:

  1. Social Distancing
  2. Maintain a safe distance (at least 6 feet) and not to gather in groups of larger than 10 people unless wearing protective masks.
  3. Masks, gloves and other personal protection equipment in areas where social distancing is not possible, (Elevators, Hot Tub …)
  4. Appropriate cleaning/personal hygiene supplies are provided in 1401 and guests should clean as they go during their stay in 1401.
  5. Wellness Checks
  6. Guests who have a temperature of 100.4 degrees or higher should wear protective equipment, be evaluated by medical personnel and consider terminating their stay in 1401.
  7. Hygiene
  8. Wash/sanitize your hands frequently especially after touching frequently used items or surfaces
  9. Avoid touching your face
  10. Sneeze or cough into a tissue or inside your elbow.
  11. Disinfect your living areas frequently throughout the day.
  12. Individual hand sanitizers should be used when traversing the property and/or community.

OCEAN RITZ RULES AND REGULATIONS 2020

The following rules and regulations have been adopted by the Ocean Ritz (OR) Owners ' Association and are designed to ensure that all unit owners, guests and renters have a safe and pleasant stay at our resort. Unit Owners are responsible to ensure that everyone they allow on the property understands their requirement to comply with these rules and regulations.

PARKING (All vehicles parked on OR property must display proper parking passes)

RECREATIONAL FACILITIES AND USE OF COMMON ELEMENTS

SMOKING/VAPING is not allowed in pool area, elevators, hallways and elevator lobbies. Unit smoking policies established by individual owners

CRIMINAL BEHAVIOR: Criminal Behavior such as trespassing, throwing objects off balconies, disorderly conduct, disturbing the peace, use of illicit drugs or underage consumption of alcohol should be immediately reported to PCB police. (911 or (850) 233 5000)

BEACH RULES: Ocean Ritz HOA exercises control of the beach front of its property. Shade canopies and tents are not allowed on the beach side of the line of chaises set up by beach services. There are gaps left in the lines of chaises to accommodate privately owned beach equipment. CAUTION! High winds are common on the beach and tents and other beach equipment blown away by the wind have caused many injuries. Unattended items on the beach between 7PM and 7AM are subject to being removed and discarded.
