AGREEMENT: Guest agrees as follows: Above Guest is married and is at least of the age of 21, or if un-married at least twenty-five (25) years of age and will be an occupant of the “Premises during the entire reserved dates. In addition to Guest, other authorized occupants may be family members or friends of Guest. The maximum occupancy of this property is 8 guests and in no event shall it exceed that. Should any unauthorized persons occupy or use the Premises, Guest shall vacate the Premises immediately without refund. Occupants will be asked to vacate the Premises if found to be used for any illegal activity, or if engaging in any other acts which interferes with neighbors’ right to quiet enjoyment of their Premises. Violation of the age requirement constitutes a rental under False Pretenses and is in violation of this Agreement.

A RENTAL DEPOSIT of $250 is required to secure your reservation and due within 7 days of making the reservation. The deposit can be paid by check and mailed to the Pell City, AL address shown above along with a copy of this signed agreement. This deposit is applied to the total Rental Fee and the balance of the RENTAL FEE is due 3 weeks prior to your Arrival Date. We accept payment in the form of personal check or money orders. The rental fee quoted to you at time of reservation is a cash price. We can also accept MC or VISA but impose a 4.0% service fee for use of a credit card. Upon receipt of the Rental Fee balance, check-in instructions and directions will be emailed to you.

DAMAGE DEPOSIT—You can either purchase damage insurance or in lieu of provide a $250 damage deposit. We hope to never have a need for this but in the event it were to be necessary you would be notified immediately following check-out and a detailed damage description provided to you. We have a No Smoking policy in place inside the unit and our Guests rent with the understanding that this is a No Smoking unit. Damage will include any affects of smoking inside the unit and the cost of removing smoke fumes.

CHECK IN TIME begins at 3 p.m. and every effort will be made to have the Premises ready on time. Key codes will be provided closer to check-in date once all the reservation requirements are met and you will be able to check-in directly at the condo when you arrive.

CHECK OUT TIME is promptly at 10 a.m., so that we may prepare for our next arrival. Checkout includes Guests, luggage and all of Guest’s belongings.

LINENS/TOWELS/SUPPLIES: The Owners furnish all bed linens and bath towels. Any lost or damaged linens will be deducted from your deposit. An initial supply of trash liners, bathroom tissue and soap is provided. Extra items needed are the responsibility of the Guest. We do not supply beach towels, only bath towels. Linens are not exchanged during your stay

WASHER & DRYER: For your convenience, a washer and dryer are in the unit

PARKING Upon arrival, guests will need to purchase a parking pass from the front desk at Phoenix VII, for each vehicle that is parked at the premises. Parking at the Premises is limited to two (2) cars. No boats, jet skis, trailers or RV’s are allowed. The cost of each parking pass per vehicle (good for the entire stay) is $21.00 (subject to change by the association at any time) PLEASE NOTE: there are times when 3 cars are allowed, but please check with me first so I can talk to the property management company.

ENTRY BY OWNER: Owner or Owner’s agents may enter the Premises under the following circumstances: in case of an emergency; to make any necessary or agreed upon repairs, alterations, or improvements; supply necessary or agreed upon services or show the Premises to prospective purchasers, renters or contractors. Owner will provide renter with at least 2 hours notice of Owner’s intent to enter except in the case of an emergency.

RULES AND REGULATIONS:

  1. Guest agrees to leave the Premises and its contents in the same condition, as found upon arrival.
  2. Check out Procedures: Beds should be stripped of linens and placed in a pile in each bedroom for housekeeping. All food should be removed from the refrigerator and cabinets. All dishes are to be washed and all garbage must be removed from the Premises and placed in outside trash receptacles.
  3. The maximum number of occupants shall not exceed ten (10) people, not including children in crib’s.
  4. Furnishings are not to be removed from the Premises
  5. No Pets are allowed in the condo
  6. Smoking is not allowed inside the Premises.
  7. Guest and any guest of Guest shall obey all laws of the state of Alabama, as well as local laws, at all times while they are on the Premises. Failure to abide by the laws of Alabama or the above rules may cause Guest to be asked to vacate the Premises and forfeit all rents and security/damage deposits.
  8. Occupancy of premises shall not be the cause of any disturbance or offense to surrounding neighbors. The use of fireworks and/or firearms is prohibited as well
  9. House parties, keg parties or any disruptive behavior will result in guest(s) vacating the property immediately without refund

CANCELLATIONS: For any cancellation,a 60 day notice prior to arrival must be given. In those cases, a full refund is allowed. Otherwise, full rental fee is due unless owner is successful in re-renting the unit.

REFUNDS of the Rental Deposit and/or Rental Fee will not be given except in the event of a hurricane, and then only in the event of a mandatory evacuation by governmental authorities. Voluntary evacuations will not receive a refund. Rental Fee refunds will be pro-rated from the day of the issuance of any mandatory evacuation

REPAIRS/SERVICE CALLS: All repair needs for inoperative equipment should be reported to us at (205)492-9461. We will make every reasonable effort to have repairs completed quickly. Guests understand and agree that our repair technician may enter the rental property at any reasonable time for the purpose of making needed repairs.

ADDITIONAL TERMS & CONDITIONS: The undersigned Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all liabilities, claims, demands, and causes of action by reason of any injury, loss of damage by whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result, or in connection with the occupancy of the Premises and agrees to hold Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorneys fees and costs. Owner reserves the right to terminate this Agreement upon his discretion at any time.

HOLD HARMLESS: Owner does not assume any liability for loss, damage or injury to persons or their personal property. Neither does Owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, electricity or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond its control. Guest accepts and assumes all risks involved to Guest and all of Guest’s guests related to the use of the pool and patio areas, or any other common area’s of the Premises.
