RESERVATION DEPOSIT

A reservation deposit of $400.00 is required to hold your reservation on nightly and weekly rentals. Monthly rentals will require a $450.00 deposit. We must receive a credit card charge for the reservation deposit at time of booking. Once the reservation deposit is paid, your week will be reserved. A returned signed copy of the Rental Agreement is required to complete the reservation or online click on the agree on the button.

Upon receiving your reservation deposit, a confirmation receipt will be emailed to you.

In order to avoid conflicts, our policy is first paid, first booked.

PAYMENT TERMS

We accept payment by personal check, money order or credit card over the phone or online invoice. Payment in full must be received 30 days before check-in date. Full payment shall include the total rental fee plus taxes. The $400.00 reservation deposit will be credited towards your final payment.

DAMAGE WAIVER PROTECTION

There is a non-refundable damage protection fee of $35.00 which provides $1500.00 level of coverage. No need for damage deposit. Any intentional damage to the property will result in additional charges to the tenant’s credit card. Any damage or notable conditions found by Tenant upon check-in should be reported to owner immediately after check-in time.

CANCELLATIONS

If you cancel more than 60 days before check-in, your reservation deposit will be returned, minus a $50.00 service fee. Cancellations between 31 and 60 days prior to the arrival date will forfeit the reservation deposit.

If you cancel 30 days or less from check-in, you will forfeit your entire funds unless the unit can be rebooked at the same rate.

All monthly rentals require a 60-day notice for a full refund of the reservation deposit, minus a $50.00 service fee. Cancellation 30 days or less from check-in, you will forfeit your entire funds unless the unit can be rebooked at the same rate.

No credit will be given for shortened stays due to late arrival or early departure for any reason.

No cancellations due to inclement weather or marine life. (See Hurricane or Tropical Storm Section)

CHECK-IN / CHECK-OUT PROCEDURES

Check-in procedures:

Check-in time is no earlier than 4:00 pm CST. If by some chance the cleaners are falling behind and have not cleaned the room prior to your arrival, please contact the owner. Sometimes issues arise that are uncontrollable and we ask for your patience in these circumstances.

Check-out time is no later than 10:00 am CST the day you are scheduled to leave. We must be able to enter the unit at 10:00 am CST. If you do not vacate the premises on time, you may be charged for one (1) additional night’s stay.

Check-out procedures:

Prior to check-out, all dishes should be washed and put away. Beds may be left unmade and sheets and pillowcases left on. Towels should be placed in the bathtub. All food shall be removed from the freezer, refrigerator, and pantry. Trash shall be emptied so it does not cause a smell in the unit for the next guests. Before leaving, set the thermostat to 70 degrees in the cooler months and 78 degrees during the warmer months. Make sure all doors are locked and shut.

We will not be liable or responsible for personal items left behind, lost or stolen. If you leave an item after check-out and wish to have it returned, call us as soon as possible and we will try to arrange for shipment. We will inform you of the shipping cost so you can send us a check to cover the expense.

HURRICANE OR TROPICAL STORM

If the National Weather Services issues a mandatory evacuation to the area due to a Tropical Storm/ Hurricane to include Panama City Beach Area, we will refund:

a. Any unused portion of rent from a guest currently registered minus a $50.00 service fee.

b. Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted minus a $50.00 service fee.

c. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the “Hurricane Warning” period minus a $50.00 service fee.

The above “clause” is intended ONLY for HURRICANES OR TROPICAL STORMS as declared by the National Weather Service. There are no refunds for normal bad weather conditions.

HOUSEKEEPING

NO DAILY MAID SERVICE is provided. When you arrive, the unit will be clean, linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the unit. As a courtesy we have included the following list of supplies to accommodate guests:

Bath towels, hand towels, dish towels, paper towels (1) and a garbage bag (1), toilet paper (1)per bathroom, soap (1) per bathroom.

These items are provided as a courtesy. Replacements cannot be provided during the stay. Guests are required to bring soap, shampoo, paper towels, laundry detergent, garbage bags, and toilet paper for use during the stay. A washer and dryer are provided in the unit to wash clothes and towels as needed during your stay.

No pets allowed. Guests who bring a pet may be evicted from the property without a refund.

This is a non-smoking unit. Any violation of the smoking policy will result in additional charges to the tenant. If additional cleaning is necessary to remove smoke odors from the unit and/or linens, costs will be charged to a tenant as well.

Free wireless internet service, and Netflix movies.

BALCONY

Parents should watch kids at all times while on the balcony. No towels are allowed to hang over the railings on the balcony. Resort Management monitors this and will come to your room to ask you to remove them. Kids should not stand on chairs while out on the balcony. Please DO NOT feed the birds from the balcony. No items shall be thrown from the balcony, you may hit and injure some below. Resort Management can evict guests for throwing items from the balcony and no refund will be granted by the owner.

MAINTENANCE PROBLEM DURING YOUR STAY

If any appliances or equipment should malfunction or break during your stay, please call 850-691-5764. If any security problems, the security desk phone number is 850-596-0657.

ADDITIONAL TERMS

You must be 25 years of age to rent this unit and provide proof of age if requested. Onsite security/owners will check ages and if found breaking those rules you will be forced to leave and your money will not be refunded.

The unit has a maximum occupancy of six (6) guests

House parties are strictly prohibited and grounds for immediate eviction.

Illegal substances are strictly prohibited and grounds for immediate eviction.

"YOU AGREE AND FULLY UNDERSTAND THAT IN THE EVENT THAT YOU OR ANYONE IN YOUR PARTY IS EVICTED FOR BRAKING SPLASH PROPERTY RULES AND REGULATIONS OR FLORIDA STATUTES, THAT YOU, AUTOMATICALLY FORFEIT YOUR ENTIRE DAMAGE DEPOSIT AS WELL AS THE NIGHTLY COST ASSOCIATED WITH YOUR NONUSE OF MY UNIT DUE TO YOUR EVICTION"

If a personal check is returned to us for non-sufficient funds, you will be charged the amount levied by the bank for NSF charges.

Any exceptions to the rules and regulations as written here must be approved in writing in advance.

RATES, TERMS, AND CONDITIONS ARE SUBJECT TO CHANGE WITHOUT NOTICE.

FORCE MAJEURE

There may be circumstances beyond our control and contemplation, in which the property might not be available for your booking. Examples of these include (but not limited to) destruction of or severe damage to the property. (Fire, Hurricane Damage, Flooding…etc.) In the event of Force Majeure, we will do our best to make alternative arrangements for you where possible. If we cannot, or if the alternative arrangements are not acceptable to you, then we will refund all monies paid. This will be the full extent of our liability to you in such circumstances, and we will not be responsible for any other costs connected with any such cancellation, howsoever arising.

I HAVE READ AND UNDERSTAND THE RULES AND REGULATIONS STATED ABOVE IN THIS ENTIRE RENTAL AGREEMENT. I CERTIFY THAT I AM AT LEAST 25 YEARS OF AGE AND THAT I WILL BE HELD RESPONSIBLE FOR THE CARE OF THIS PROPERTY BEING RENTED UNDER MY NAME. I ACCEPT FULL RESPONSIBILITY FOR DAMAGES OR EXTRA CLEANING CHARGES, SHOULD THEY BE DISCOVERED DURING OR AFTER DEPARTURE.

I ACKNOWLEDGE THAT SPLASH HAS MULTIPLE SWIMMING POOLS AND IT IS MY RESPONSIBILITY TO WATCH OUR KIDS AND FAMILY MEMBERS TO ENSURE THEIR SAFETY EITHER IN THE SWIMMING POOLS OR IN THE OCEAN. IT IS ALSO MY RESPONSIBILITY TO WATCH KIDS WHILE ON THE BALCONIES TO ENSURE THEY DO NOT FALL OR CLIMB OVER RAILING. ALL LIABILITIES AS MENTIONED ABOVE SHALL BE THE GUESTS AND NOT THE UNIT OWNER.

SPLASH OWNERS ASSOCIATION RULES

The pleasantness of staying at a condominium resort is greatly enhanced by a congenial atmosphere in which all in residence have proper regard for the comfort of others. For this reason, these House Rules have been adopted by the Splash Owners Assoc. All owners and guests are subject to these rules.

1) Throwing anything off of balconies is a FELONY OFFENSE. Violators will be prosecuted to the fullest extent of the Law and will be subject to immediate eviction. No sweeping debris or water from balconies.

2) State Law prohibits feeding birds from balconies.

3) Shade canopies and tents will not be allowed on the beach side of the line of chaises set up by Beach Services. High winds are common on the beach and have sent structures rolling down the beach, causing injuries to beachgoers. Please erect tents or canopies along the fence next to the sea oats berm.

***Tents/canopies cannot remain on the beach overnight and must be removed by sunset. ***

4) Per Local, State, and National Fire Codes, gas or charcoal grills are not allowed in the buildings. Gas grills are on each pool deck. Please ask one of our Pool Attendants for help lighting the grills.

5) ONLY OWERS MAY HAVE PETS. Guests are not allowed to bring pets on property at any time.

6) Splash is a NO-SMOKING RESORT. Smoking is strictly prohibited in all common areas, to include pool decks, walkways, stairwells, sky-bridges, restrooms, exercise room, lobbies, and condo unit balconies.

7) QUIET TIME is 10 PM to 8 AM. The pool decks, exercise room, and arcade will be closed during these hours. No one may play musical instruments, radios, CD players, or television set in condo units or common areas between the hours of 10 PM and 8 AM if it shall disturb any occupants of the buildings.

8) Igniting fireworks anywhere on Splash property including the beach and beach access is prohibited.

9) All vehicles parked in the Parking Garage must have a valid Splash Guest Parking Pass clearly displayed on the dashboard or hanging from the rear-view mirror or an owner decal on the windshield. Any vehicle not displaying a valid pass or decal is subject to being towed without notice.

10) Luggage carts are not permitted inside the condo units. Please return the carts immediately after use to the storage area on the 2nd floor of the parking garage building.

POOLS, SPA, and WATER PARK

1) ALL PERSONS 12 YRS OR OLDER MUST BE WEARING A SPLASH WRISTBAND WHILE USING ANY OF THE FACILITIES. ANYONE NOT WEARING A WRISTBAND WILL BE ASKED TO LEAVE THE POOL DECKS. Swimming pools and all Splash facilities are for use by Splash Owners and Guests only. Guests using the facilities must be registered, over-night guests (staying at Splash) or accompanied by an Owner. Guests may not invite guests to use the facilities.

2) Anyone in violation of any of the pool rules may be asked to leave the pool decks.

3) Children under the age of 12 years must be at all times accompanied by an Adult who is responsible for them. Parents: Please don’t leave children at one pool while you are at another, or on the beach.

There are no Lifeguards on site. It is your responsibility to supervise your children.

4) Due to health risks, children under the age of 3 may not use the spa. Additionally, children between the ages of 3 and 12 must be accompanied by a parent or guardian while in the spa. Parent/Guardian must be in the spa with the child or sitting on the edge.

*TO ENSURE THE SAFETY OF OUR OWNERS AND GUESTS, THIS RULE IS STRICTLY ENFORCED. *

5) The placement of towels or clothing on chairs, tables, or lounges does not “RESERVE” them.

6) Radios, CD players, etc. are prohibited except as used with earphones.

7) Infant floats are the only flotation devices allowed in the pools, except for the Lazy River.

8) EVERYONE MUST RINSE OFF BEACH SAND & DRY OFF COMPLETELY BEFORE ENTERING THE BUILDINGS.
