We accept 1 and 2 night rentals when they are left open between existing bookings.

Failure to comply with the following rules will result in non-return of security deposit and possible additional charges.

Security Deposit - if you damage the home, you may be charged up to $150.

RENTAL AGREEMENT FOR MAJESTIC MOUNTAIN CABINS LLC

This agreement is entered into by and between the rental owner, Majestic Mountain Cabins LLC and the guest(s)
who are defined as the person(s) renting the property located at 1935 Foxview Lane, Sevierville,
Tennessee, 37876 and any of their guest(s) and invited. The premises is a vacation rental. The rights and
obligations of the parties to this agreement include unique provisions permitting the disbursement of rent
prior to tenancy and expediting eviction of tenants. Your electronic signature to this agreement, or
payment of money or taking possession of the property is evidence of your acceptance of the agreement
and your intent to use this property for a vacation rental.

CANCELLATION POLICY: If you must cancel your reservation, the first payment and any
advanced payments received are refundable if you provide notice at least 30 days prior to your
check in date. A cancellation fee of $100.00 will be subtracted from your payment(s) and the
balance returned to you within ten (10) days.
No refunds are given with less than 30 days notice for any reason, including weather, road
conditions, Acts of God, mechanical failures at the rental and health or personal reasons.
We strongly recommend that you purchase trip insurance or you will have no financial protections of your
vacation investment.

PETS: No pets are allowed for any reason. Family member has allergic reactions to dogs/cats. If a pet is
found on premises during your stay you will be immediately evicted and a $250.00 cleaning fee will be
assessed.

FINAL PAYMENT: The balance of your lodging payment is due 30 days prior to arrival. If you book 30
days or less, prior to your arrival date, payment is to be paid in full at the time of booking. As part of the
registration process we do require a copy of your drivers license. Upon receipt of your final payment and
photo ID, we will email you the welcome package PDF file with all the information for your stay.
Look over directions to the rental prior to your arrival and call if you have any questions or concerns.
Please go by the written directions that we provide to your rental. GPS systems can lead you in
the wrong direction once you get into the mountainous areas.

ARRIVAL/DEPARTURES:
Check in time is 4:00 PM Eastern Time or later. Early check in is NOT available during holidays, the
summer or the month of October. During non-peak periods, your cabin may be ready earlier than 4:00
PM. Please call Dave Robilotto at (813) 679-4990. We cannot guarantee an early check-in, but if it's
available sooner than 4:00 PM we'll let you know.
Check out time is by 10:00 AM Eastern Time. NO REFUNDS will be given for early departure or any
other reasons, including inclement weather, road conditions, or malfunctions in equipment (i.e. hot tubs,
jacuzzi, fireplace, DVD players etc.). If you are traveling to the area during the winter season, we advise
that you keep a check on the local weather. In order to help keep the cabin maintained for the next renter
we ask that you adhere to the following rules: On the day of your check-out, please refer to the checklist
provided in the rental information PDF. We ask that you leave the house in good condition, thermostats
set to the requested settings and ALL doors are locked. If these procedures are not followed an excessive
cleaning fee will be charged.

WHAT WE PROVIDE: Your rental includes the set up of the cabin with towels and bed linens, There's a
starter supply of toilet paper and paper towels. We provide hand soap, liquid dish detergent, dish washing
detergent, laundry detergent and basic cleaning supplies.

NOTIFICATION OF OWNER: If you find that something is not operating correctly, appears damaged or
needs housekeeping attention, you agree to contact us as immediately. If warranted, we will make every
attempt to repair or correct the situation as promptly as possible.

If repairs are required, you agree to provide access to the property.

ELECTRICITY OUTAGES: If basic utilities such as electricity experience a lengthy outage of more than
eight (8) hours, we will refund the portion of your stay that is impacted by the outage. These situations
are rare but we want you to know that we will do everything possible to address the outage promptly with
your comfort and safety in mind.

WATER AND SEPTIC: The cabin is on well water and septic system. We have provided a new ultra-violet
cleaning system along with a water softener. The septic system is very effective; however, it will clog up if
improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products
should be flushed at any time. If it is found that any products other than toilet paper have been flushed
and clog the septic system, you will be charged for damages.

STORMS: No refunds will be given for storms and road conditions. Mountain roads can be curvy and steep
so we highly recommend four wheel drive and/or chains during the winter months.

INTERNET AND PHONE SERVICE: We offer high speed internet and free long distance phone service.
However, if there is an outage beyond our control, no refunds or rate adjustments will be made. We will
do our best to expedite any service calls, if necessary, and replace routers promptly if our equipment
should fail.

HOT TUBS: Hot tubs are drained, cleaned and refilled after each guest stay. Hot tubs should not be used
if you are pregnant or have a health condition where extended periods in hot water may not be safe.
Children under the age of 16 should not use the hot tub. No food or drinks are permitted in the hot tub.
Covers should remain on the hot tub at all times when not in use. Jewelry may become discolored from
the hot tub chemicals. Please shower before using the hot tub if you have used tanning oils or body lotions
as these will severely impact the water quality and may damage the motor. Do not use bubble bath, soap
or similar products in the hot tub or you may incur a fee for additional hot tub cleaning service, as the
residue can be time-consuming to clean from the lines. Hot tub use is strictly at your own risk. There will
be a minimum charge of $50.00 of misuse is discovered upon your departure. Damage to any cover will
result in a $300.00 charge.
By using the hot tub, and electronically signing the rental agreement, you agree to hold harmless Majestic
Mountain Cabins LLC, its owner, employees and agents.

COMMUNITY RULES: Guest agree to abide by community rules and not to cause nuisance to any
neighbors by theirs actions, noise or other. You risk being evicted if neighbors call the police to complain
about nuisances. Remember that there are permanent residents living in the area and you must respect
their rights. House parties are not permitted and will be cause for immediate eviction with no refund.

ACCIDENTS, THEFT OR LOSS OF PROPERTY: Owner is not responsible for any accidents, injuries or
illness that occurs while on the premises and guest(s) agree to hold Majestic Mountain Cabins LLC, it owners,
employees and agents harmless for any accident, injury or illness that occurs on the premise. You are
solely responsible for all personal items brought to the property. Please secure valuables while you are
gone by placing them out of view, closing window blinds, locking all entry doors. Our property insurance
will not cover items brought into the cabin by outside parties. If you are gone for awhile, we recommend
you leave on a radio or TV and a couple of lights so the house appears occupied.

FORGOTTEN ITEMS: If you believe you have left an item behind, contact Dave Robilotto (813) 679-4990
as soon as possible so we can have housekeeping search for your item. If they have to make a special
trip, there will be a $25.00 service call fee plus the cost to ship the item back.

OCCUPANCY: Due to strict fire codes, cabin is not to be used for parties and gatherings that exceed
sleeping capacity of the cabin. Use is restricted to the official occupancy limit of 4 with maximum of 2 adult guests. Immediate eviction will be enforced if capacity is exceeded.

SMOKING: Smoking is not allowed. Smoking while not allowed in cabin is permitted outside. Dispose of
all cirgarettes in disignated containers only.

PESTS AND ENVIRNMENT: To ensure the best guest experience, we perform regular pest control
maintenance on the cabin. Because the cabin is located in wooded and mountainous areas we cannot
guarantee that the cabin will be pest free. We do not offer refunds for pests. Unfortunately, ladybugs and
other pests are a part of our environment and we are unable to prevent them from occasionally visiting
the cabin. Please contact us if the need arises and we will do out best to resolve the issue.

MINIMUM AGE: We require the responsible party who signs the lease to be at least 23 years of age at
the time of booking. We do not accept rentals made by parents on behalf of their children under the age
of 23. Any reservation obtained under false pretense will be subject to forfeiture of lodging payment(s)
and the party will not be permitted to check-in or evicted if already at the property.

SECURITY: There is a onsite security system with cameras to ensure a safe environment.

RENTAL TERMS: Majestic Mountain Cabins LLC unilaterally and at its sole discretion reserves the right to change or
cancel the reservations for any reason with refunds made accordingly, in the event the property becomes
unavailable to rent.

PROPERTY: Renter(s)/guest(s) acknowledge that there have been no representations, warranties,
promises and guarantees with respect to the building or property. Warranties as to the fitness for a
particular purpose or merchantability are expressly disclaimed.

INDEMNITY CLAUSE: The registered guest agrees to indemnify Majestic Mountain Cabins LLC, its owner,
employees and agents of any damages to the building, contents property and ground which result from
the renters occupancy including furnishings and household items and/or damages found upon arrival. The
registered guest is the person responsible for any damages his/her group cause to the building, contents,
property and ground. Majestic Mountain Cabins LLC, its owners, employees and agents will not be responsible for
accidents or injury to guests or for loss of money or valuables of any kind. The registered guest assumes
full responsibility for any and all damages that his/her party causes, such as, but not limited to , excessive
cleaning charges for problems caused by his/her parties visit, including linens and towels. Your electronic
signature on this document means you agree to be responsible for any damages, missing items and/or
excessive cleaning that are made necessary by your stay. The persons name on the reservation will be
billed.

DISCLAIMER: Guests for themselves and their respective heir, personal representatives, successors, and
assigns, hereby release Majestic Mountain Cabins LLC, its owners, employees and agents of all claims, demands or
cause or thing whatsoever resulting from or in connection with the property of this rental contract,
including without limitation any claim, demand or cause of action for personal injury or death and any and
all loss, liability, cost and expense resulting from any claim, demand, suit or cause of action which may be
asserted.

JURISDICTION AND VENUE: Guest(s) agree that Sevier County, Tennessee has jurisdiction over any
issue or claim arising under this agreement and venue is proper and exclusive to Sevier County,
Tennessee.

DEFAULT: If the guest defaults under this agreement then Majestic Mountain Cabins LLC shall be entitled to the
remedial outlined herein and any remedial available to it at law or equity and it shall be entitled to recover
all costs incurred in the enforcement of the agreement including but not limited to reasonable attorney
fees.
These Polices and Procedures above are meant to protect you, our guest, and the owners alike. All guests,
as well as owners are required to conform to all Policies and Procedures. We want you to have an
