Terms and Conditions of Rental for Top of the World Condo
GENERAL TERMS
1. CHECK IN TIME IS 4 PM and CHECK OUT TIME IS 11 AM local time. NO EARLY CHECK –INS unless pre-approved or initiated by Rick and Teresa Freeman. Failure to check out by 11 AM may result in an additional night charge.
2. Our property is a NON-SMOKING condo. Any evidence of smoking in our condo or on our balcony will result in an additional cleaning fee of $100. Smoking is allowed outside at the picnic tables across the parking lot; however, our guest is responsible for the removal of butts, ashes, etc.
3. All properties are privately owned and maintained. Rick and Teresa Freeman, the owners of Top of the World condo, shall not be liable for damage or injury to guest or any other person, or to any property occurring on the premises or any part thereof, and guest agrees to hold Rick and Teresa Freeman harmless for any claims for damage, no matter how caused. Rental agent nor owner will be held responsible for acts of theft, vandalism or other damages to guest’s personal property. Guest agrees to hold harmless and indemnify the owners and their agents from any loss or damage, including attorney fees, incurred as a result of any and all claims, demands, causes of action, suits, judgements, fines or penalties arising out of the guest use or occupancy of the property. Guest agrees to pay all court costs, and reasonable attorney fees incurred by the owners in the enforcement of its rights under this agreement.
4. Guests agree to act in such a manner as to allow those nearby the peaceful enjoyment of their properties. We do not allow parties in our condo and any guests who create a private or public nuisance may be ejected from the property and no refunds will be due. Please respect our quiet time ordinance from 11 pm until 8 am.
5. MAXIMUM OCCUPANCY: The maximum number of overnight guests for each property is strictly enforced. Guest must adhere to the number of guests listed on the rental contract. Changes to the number of guests listed on the contract must be approved prior to check in date. An increase in guest number may result in a higher rental rate and there is no guarantee of approval.
6. RATE CHANGES: Rates are subject to change until deposit and contract acknowledgement are received.
7. Guest is not permitted to sublet the property.
8. Use of the property, amenities, appliances, accessories and pools are at your own risk.
RESERVATION & PAYMENTS
9. RESERVATION DEPOSIT: A reservation deposit of half of the full rental amount due is required and is due at the time of booking. Reservation deposits are applied towards the total rental amount due.
10. Reservations are on a first come, first served basis. Bookings are not guaranteed until payment is received along with an electronically acknowledged contract and confirmation is provided.
11. Guests must be at least 25 years of age to secure a reservation. A copy of a valid government issued photo id may be required to prove age and identity. Top of the World Condo rents strictly to families, couples, and responsible adults. Guest must occupy the property for the duration of the reservation and is responsible for any and all damages and the actions of your party. Any guests under the age of 25 must be traveling with their parents or legal guardians. Under no circumstances do we provide bookings to groups under the age of 25. Any reservation booked with false information will be cancelled immediately without refund. Prohibited groups will be ejected without refund.
12. PAYMENT SCHEDULE: Rental balances are due thirty (30) days prior to arrival. Upon receipt of full payment, access instructions including key code and directions to Top of the World will be emailed to you. Failure to make the final rental payment by the due date may result in immediate cancellation of the reserved dates and forfeiture of the reservation deposit.
13. CANCELLATIONS: Cancellations made at least 30 days prior to check in will result in a 100% refund minus the administrative cancellation fee of $45. Early departure does not warrant any refund of rent.
14. PETS: Pets are NOT permitted .
15. At the time of check-out, please put all trash in the outside garbage bins. Place all dirty dishes in the dishwasher and turn it on. Please place all towels in the laundry basket located in the master bedroom closet. Please do not make the beds, as our cleaning service will take care of the linens.
16. Internet & TV: Wireless internet and cable/satellite television is provided. Our Wi-Fi password is highchalet2. NO REFUND shall be given for outages, content, lack of content, speed, access problems or personal preferences with regard to such services.
17. Guests may use the pool at their own risk. No lifeguard is on duty. Pool Rules are posted in the pool area and must be followed at all times. Children should NEVER be left unattended inside of the fenced pool area. No glass inside of the pool area.
Access to the property may be needed by the property owner, manager, or independent contractors. The guest agrees to allow access as needed. Notice will be given when possible.
The laundry facility is across the hall from our condo. Remember to bring quarters and laundry detergent if you plan to wash your personal items.
BY ACKNOWLEDGING THIS AGREEMENT AND CONFIRMING WITH PAYMENT, YOUR ELECTRONIC ACCEPTANCE OF THESE TERMS AND CONDITIONS HAS BEEN RECORDED AS YOUR SIGNATURE. NO WRITTEN SIGNATURE IS NECESSARY.
