Terms and Conditions for Island Oasis

Check in: is at 4:00 p.m. EST or later. Please do not attempt to check in early unless prior arrangements have been made. Early check in is rare, especially during peak season.

Check Out: Check out is at 10 a.m. EST. No exceptions, please. Housekeeping must be able to enter the house at 10 a.m. Realize that they only have a limited amount of time to get the house ready for the next guests, so please be on time. If you have not left the house when housekeeping arrives, you will be charged a fee of $100. If your late check out prevents the next guest from checking in, then you will be charged for an additional night.

Damage: If you find damage upon your arrival, please report it to Tennessee Cabin Rental immediately. We provide damage insurance that covers ACCIDENTAL damage up to $1000. If there is intentional damage to the house the cost will be charged to you.

Additional Fees/Eviction

- You may be charged additional fees or evicted from the property if:

- Your occupancy is greater than what is listed on the agreement.

- Pets that have not been approved are in the house.

- Excessive damage caused by pets.

- Pets relieving themselves inside the house.

- Not cleaning up after your pet.

- Linens are missing.

- Movies, Play station II games, and board games are missing or damaged.

- Smoking has taken place inside the house.

Number of Guests: The number of guests may not exceed the number listed on your reservation. Additional guests in the house without prior written may result in eviction or additional fees.

A list of names and ages must be provided prior to check in.

Sub-leasing is not permitted.

Payment Schedule: The deposit is due upon booking. The balance of the total rent is due no later than 60 days prior to your arrival date. Payments can be made in the form personal check, credit card or debit card. If payments are not received by the due date, the reservation may be canceled and the deposit forfeited.

Cancellation Policy: We highly recommend CANCEL FOR ANY REASON Travel Insurance to protect your trip in case of any unforeseen, unplanned, unexpected event that happens to prevent you from staying at our house or from coming to the house.

If you need to cancel, please notify us immediately by sending an email to allaboutview@bellsouth.net and ensure that the email has been received.

Being we are holding the dates for you and not accepting any other reservations for that time period at Island Oasis, the deposit is not fully refundable. We will make every effort to rebook your reserved dates and possibly refund part of your payment.

For cancellations made 61 days or longer before arrival: If the house is rebooked for your reserved dates, your deposit will be refunded less a $150 cancellation fee and less any discounts/expenses required to rebook your dates.

For cancellations made within 60 days of your arrival date: the entire amount of the reservation will be forfeited unless we are able to rebook your reserved dates. If we are able to rebook your reserved dates, your payments made will be refunded less your initial deposit and less any discounts/expenses required to rebook.

If Island Oasis is not rebooked for your reserved dates, you will not be entitled to reimbursement for any payments/deposits made.

We do not offer refunds for any reason including but not limited to no shows, cancellations, bad weather, late arrival, early departure, illness, death, terrorist attack, pandemic, evacuations, financial hardships, strikes, riots, travel bans, travel restrictions or any other unforeseen event. We highly recommend cancel for any reason travel insurance, which is a great way to protect the money you have invested in your vacation. We will not be financially responsible.

Catastrophic Events: If a natural or human caused catastrophe (such as – but not limited to pandemic, infectious disease outbreaks, mandatory evacuation, adverse weather, hurricane, tornado, mass trauma, human caused disaster, political or community unrest, riots, strikes, earthquake, flood, fire, tidal wave, red tide, wild fire etc.) or any situation simply beyond our control which impairs your stay, we are NOT responsible for your financial losses related to your stay at our home, transportation or alternate lodging. There will be NO REFUNDS OR CREDITS FOR ANY EMERGENCY, EVACUATIONS OR AREA CLOSURES or any other causes. Therefore, we highly suggest you research and purchase Cancel for Any Reason (CFAR) Travel Protection Insurance to secure your vacation investment and eliminate your financial risk. NOTE: There will be no refunds of any kind for any reason.

Travel Insurance: We will not take financial responsibility for your trip interruption or cancellation. We highly recommend purchasing CANCEL FOR ANY REASON INSURANCE for your trip. You can shop for Travel Protection Insurance for a couple of weeks after you secure your vacation. There are many travel insurance websites such as ardvarkcompare.com, www.insuremytrip.com, www.squaremouth.com, www.travelexinsurance.com or www.travelinsurance.com (we do not endorse any site, these are merely examples of the sites that can use to compare different insurance plans) or you can call an insurance agent who has an understanding of travel protection insurance. It is up to you to purchase this coverage for your trip. Coverage is available for many types of situations. Please check with insurance companies directly so you purchase the insurance that best suits your needs. Be sure to purchase all insurance in your name.

For losses to be covered, travel insurance must be purchased before a storm advisory or disaster is forecasted or predicted.

What We Supply: When you arrive, the house should be clean and ready for your use. If there is a problem, please call us immediately at 786-229-4649 or 786-200-9378 and we will do our best to correct the situation. If you do not notify us upon your arrival of any issues, we cannot be held responsible for not rectifying them.

We supply the house with the following items: linens for each bed and convertible bed (if applicable), bath towels, wash cloths, hand towels, dish towels,sponge and dishcloths. We stock the house with starter supplies of dishwashing liquid, dishwasher detergent, paper towels, toilet paper, soap, tissues, napkins and trash can liners. We provide games and books for our guests. Some of them may not be suitable for children an some games may have small parts that aren't suitable for very small children. Please do not allow young children to play unsupervised with the games.

Garbage Pick-up: Trash will be picked up from the large containers located in front of the house.

Please DO NOT put trash outside on decks or leave it next to the containers for extended periods of time.

Please do not throw anything from the decks.

House Parties, Receptions, and Noise: House parties are strictly prohibited and are grounds for immediate eviction. Disturbing the peace is also grounds for eviction.

Maids: There is no daily maid service.

Hot Tub Warnings

1. Use of the hot tub is at your own risk.
2. The following persons should not enter the hot tub without doctor's consent: Pregnant women, babies and young children, or people with heart disease, diabetes, high or low blood pressure.
3. Children must be supervised at all times!
4. Shower before and after entering the hot
5. Limit use to 20 minutes at a time to prevent nausea, dizziness, and fainting.
6. Never put more than 5 people in the hot tub at one time.
7. Do not use while under the influence of alcohol, narcotics, or other drugs that can cause drowsiness or influence blood pressure.
8. Discoloration of jewelry and fabrics can occu
9. Never sit or stand on the hot tub cove
10. Never put lotions, oils, bubble bath or soaps in the hot tub. This could cause severe damage.
11. Enter and exit the tub slowly and carefully.
12. Glass and bottles are not allowed in the hot tub/
13. No dogs or pets are allowed in the hot tub.
14. Always put the hot tub cover back on the hot tub after each use.

Swimming Pool Warnings

1. Use of the Swimming Pool is at your own risk.
2. Children must be supervised at all times!
3. Shower before entering the swimming pool.
4. No running or rough playing in/around the swimming pool.
5. Maximum number of people allowed in and around the swimming pool is 8.
6. Do not use the swimming pool while under the influence of alcohol, narcotics, or other drugs that can cause drowsiness.
7. Glass and bottles are not allowed in the pool area.
8. No dogs or pets are allowed in the pool.
9. Never swim when it is raining or if there is thunder and/or lighting.
10. Use the ladder and hold the hand rail when entering and exiting the swimming pool.
11. Food and drink are not permitted around the swimming pool
12. Do not swim if you are ill or have open sores.

Pets:

• We allow well behaved dogs- any size. No other pets may stay at the house.
• No dogs without prior approva
• Please ensure that dogs are crated when left alone in the house.
• Watch your dog when they are on the deck, you wouldn't want them to fa
• If your dog sits on the furniture, please bring a sheet or towel to cover the area where they lie.
• Please clean up after your dog outside and dispose of it in the trash containe
• If any dog feces or urine is found inside the house or on the decks, the house will need to be specially sanitize Please do not leave your dog unattended!
• Do not allow your dog to claw or chew any furniture, walls, doors or fixtures in the house or on the dec
• No dogs in the hot tub or pool. NO EXCEPTIONS!
• Please do not allow your dog to roam free. This is dangerous to your dog as well as for the wild life.

Items Left Behind: We are not liable or responsible for items left behind. If you leave an item after checking out and wish to have it returned, please call us as soon as possible. We will inform you of the shipping cost and after receiving payment for shipping, we will send it to you.

Items Lost or Stolen: We are not liable or responsible for items lost or stolen. Always secure all doors, windows, gates and game room when you leave the house.

Maintenance: It is impossible to guarantee that all appliances, swimming pools, hot tubs, water heaters, AC, etc., will be in working order 100% of the time. We do guarantee to make every effort to correct any problem as soon as possible. Please call us at 786-229-4649 or 786-200-9378 within 24 hours of your arrival if there are any problems. Non-emergency maintenance issues will be handled during normal business hours.

Smoking Policy: This is a Non-Smoking house. Smoking is only allowed outside. We have provided ash cans on the decks. Please use them. Don't throw butts on the ground or off the deck. You'll not only be endangering the environment, house, but possibly your own life.

Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of deposit and/or rental money and the party will not be permitted to check in.

Vacation Rental Liability Waiver

I, a visitor to and short term vacation renter (“renter”), acknowledge that I am informed and aware that:

I am aware that my stay at Island Oasis (“Property”) may involve risks that include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Property during my stay. I understand that the description of the risks in this Release of Liability, Waiver of Claims and Assumption of Risk (the “Waiver”) is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury and or/death.

In consideration of being permitted to rent and stay at the Property, I agree on my own behalf and on behalf of my family and guests and on behalf of my children and all minors in my care, custody or control (hereafter also included in “I” or “my”) to assume full responsibility for the risks identified herein and those risks not specifically identified.

I hereby release from liability and waive any and all claims that I have or may have in the future against Thomas and Lucinda Roenicke or Tennessee Cabin Rental, LLC and its members, principals, agents, officers, employees, and representatives (collectively “Releasees”) as well as the owner of the Property.

I understand and acknowledge that being in or near the ocean present various risks and hazards, including strong currents, unexpected wave activity, floating debris and other potential hazards. I assume all such risks associated with being near or in the ocean.

I agree to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including property damage that may result from arise out of or be related in any way to my rental and stay at the Property. If any portion of this Document shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Waiver and the remainder of the Waiver shall not be affected and shall be valid and enforceable to the fullest extent permitted by law.

By "clicking" that I have read the terms and conditions of this property you are virtually signing this waiver, and assume all risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with activities and events during or related to the stay in the subject property.

Additional Terms and Conditions

1. You must be 25 years old to rent Island Oasis. A copy of your drivers license needs to be provided for verification.
2. Younger renters may be allowed with prior approval and additional requirements.
3. Pets by prior approval only. Guests who bring pets who have not been approved will we charged double the pet fee and may be subject to eviction.
4. If a personal check is returned to us for non-sufficient funds, you will be charged the amount levied by the bank for NSF charges.
5. Any exceptions to the above-mentioned policies must be approved in writing in advance.
6. Rates, terms, and conditions are subject to change without notice.

CREDIT CARD AUTHORIZATION:

I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by "clicking" that I have read the terms and conditions of this property, I am bound by this agreement and I have signed "electronically, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not limited to: unauthorized satellite TV charges; damages beyond normal wear and tear; late departures or missing items.

AGREEMENT TO WAIVER AND TERMS AND CONDITIONS: By "clicking" that I have read the terms and conditions of this property, I understand the rules and regulations as well as the vacation rental liability waiver. I acknowledge that I have read the entire document and understand its terms and conditions and agree to be bound by them. I understand that I am waiving my right to sue releases I certify that I am at least 25 years old and that I will be held responsible for the care of this property. I accept full responsibility for damages not covered by damage insurance or extra cleaning charges. I understand the cancellation policy and take full responsibility if I need to cancel.

Please note that the dates will be blocked upon receipt of the deposit and completed reservation form. Codes and directions will be sent after final payment is received.
