SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between

Majestic Dream Vacation Condo Rentals (“Property Owner”)

and (“Guest”)

as of the date set forth on the signature page of this Agreement.

For good and valuable consideration, the sufficiency of which is acknowledged,

the parties are entering into the agreement as follows:

  1. Rental party agrees to the Maximum Occupancy Rule:

The maximum number of guests is limited to 8 persons.

(under certain circumstances 9 may be allowed with permission)

  1. Term of the Lease:

The lease begins at 4 p.m. on (the Check-in Date”).

and ends at 10 a.m. on _ (the “Checkout Date”).

Your condo entry code will only be valid during these times and will be sent prior to your stay.

  1. FEES: Your total fee is payable as follows:

**Note we do not have control over the fees charged by booking sites

  1. Rental Rules:

Guest agrees to abide by the Rental Rules attached as “Exhibit A”, and those provided via email in “Welcome letter” at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

  1. Access:

Guest shall allow Property owner and/or maintenance access to the property for purposes of repair and inspection should the need arise.

  1. 7. Rental Rate and Applicable Fees

Deposit:

A deposit of one half of your rental total is due immediately to secure the reservation. The remainder of your balance is due within 5 Weeks of your arrival.

Damage Insurance: A $59 non refundable fee is due with the final payment if making payments. Majestic Dream self insures our guests. This fee will cover you for accidental damages up to $250. You are solely responsible for any damages exceeding $250. Failure to make full restitution will result in criminal charges being filed. Renter agrees to notify us immediately of any damages that occur during your stay. We will do our best to get damages taken care of immediately, but some damages may require scheduling of contractors or ordering of equipment that are beyond our control. There is no refund for a delay in repairs.

Guest ID Bracelets: There is a $25 replacement cost for each wrist band not returned upon departure. This is not considered “Accidental Damage” and is NOT covered by your $59 damage waiver fee.

Check out Procedures: Failure to vacate unit by the assigned checkout time which results in our cleaning crew being unable to clean the unit timely for our next guest will incur a $25/hr fee (clock starting at 10am). This is not considered “Accidental Damage” and is NOT covered by your $59 damage waiver fee.

  1. Cancellation Policy:

If Guest wishes to cancel his/her reservation, the deposit will be refunded as follows:

Cancellation Policy:

**A $150.00 cancelation fee will be assessed regardless of time frame in relation to arrival.**

If we are able to rebook the unit for the dates of your canceled stay, a full refund (minus the $150 cancelation fee) will be made to you. There are no guarantees that we will be able to rebook the unit, however, all efforts will be made to do so.

We strongly encourage licensee to purchase Travel Insurance along with their reservation. A ‘Cancel for any Reason’ Travel Insurance Policy protects the licensees investment in the event of unexpected and catastrophic events such as (but not limited to): earthquakes, fires, flood, death, illness, injury, travel restrictions/bans, border closures, grounded flights, civil unrest, protests, pandemics, war and terrorism. If the Licensee cancels the reservation before the Check-in date, The Owners will make every attempt to book another reservation for the same time period. If the Property is re-booked at the same rate or greater, Licensee will receive a full refund if within the refund periods specified.

  1. Refund Policy:

No refunds will be provided due to inoperable appliances, hvac, pools, hot tubs, elevators, weather, traffic, etc. The Owner will make every reasonable effort to assure that appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, snow, or construction. It is HIGHLY suggested that guests purchase travel insurance to protect them from acts of nature or medical emergencies.

  1. 10. Proper Identification:

Condo Owner reserves the right to retain copies of legal documentation (driver’s license, state issued ID etc) on all occupants. Minimum age for rentals is 25.

Exhibit A” – RENTAL RULES

  1. Smoking is NOT allowed inside the unit. Renter understands that evidence of smoking inside the unit will result in loss of the damage deposit.

  1. People other than those in the Guest party set forth above may not stay overnight in the property. Renter will be held responsible for any damages due to over crowding of the unit and unauthorized guests.

  1. Our unit is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The property owners are not responsible for the loss of personal belongings or valuables of the guests. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

  1. Renter agrees to keep the property and all its furnishings in good order and notify owner immediately of any mechanical, electrical, plumbing or other problems with the premises.

  1. Renter agrees to only use appliances for their intended uses.

  1. Renter acknowledges that owner is not responsible for malfunctions in appliances that may cause damage to personal property.

  1. Absolutely NO PETS, smoking inside the unit and NO house parties allowed.

  1. The maximum occupancy for this unit is 8 persons (occasionally, 9 may be permitted).

  1. Please LIMIT SAND in the unit by using showers provided at the pool decks to rinse shoes, feet, shells, coolers, beach items. DO NOT put wet Beach towels into the washing machine without first shaking sand off outdoors and WASHING the towels. Excessive sand will destroy the washer and dryer and those repairs costs are NOT considered accidental damage.

  1. Please leave TV Remotes next to the TV’s for the next guest.

  1. Please have all dishes washed and put away before departure.

  1. Please have linens off beds, dirty towels should be placed on floor or on washing machine for housekeeping to handle.

  1. You will be charged $25 for lost or missing armbands. Armbands are to be worn while on the property. Failure to do so may result in issues with Security staff. Armbands should be left in the unit before heading home.

  1. PARKING PASSES – Renters must display the parking pass on the rear view mirror at all times. Failure to display may result in towing of vehicle at renter's expense. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. (One parking pass is included at no cost, additional passes are available for $15/each)

  1. HOUSEKEEPING: Renter understands that there is NO daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included. Starter trash bags, dish soap, toilet paper etc. are provided, however, you are responsible for purchasing or bringing your own essentials of this kind, to include laundry detergent, for your stay. This is a personal home, not a hotel and such items are not provided for you. You must bring your own beach towels (there will possibly be beach towels in the unit, if so you are welcome to use them). We do not permit bath towels or linens to be taken from our unit. Per Majestic Beach Tower rules, towels etc. may NOT be hung to dry on the balcony railings. **Excessive cleaning post stay is defined as cleaning in excess of 3 hours with a 2 people team to return the condo to the level of clean guest experienced upon arrival. OR failure to vacate unit at checkout time (10am) will result in a $25/hr charge.
  2. Storms: If there is a storm or hurricane, refunds will only be given as follows:
    1. The state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or
    2. A "Mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest.
    3. The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
      • Any unused portion of rent from a guest currently registered;
      • Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and/or
      • Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.
    4. Pandemics etc: If for whatever reason Bay County and City of Panama City Beach close the beaches, we will offer a full refund. However, should the beaches be open, our usual cancelation policies remain in effect.

I have read and completely understand all articles in “Exhibit A” and agree to comply with the rules and regulations set forth in this lease agreement. To include:

I agree that all rental monies are non-refundable per the above stated cancellation policy.

I agree to accept full responsibility for any possible damages to the property that may occur during my stay and I agree to make full restitution.

The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the signatures set forth below.
