This agreement made this of 2019 between James & Kathy Head d/b/a HCM Beach Rentals. (Herein after called the Tenants) and {James & Kathy Head} (hereinafter called the Landlord) concerning the short term rental of the property located at (16701 Front Beach Road, Panama City Beach, FL 32413 Unit #1201 in Sterling Breeze.)

ivacationonline.com Warranty Protection (IWP) is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

If the condo check out policies are not adhered to and the condo is left where my cleaning personnel has to spend extra hours to clean, they your card will be charged accordingly.

Cancellation Policy:

Cancellations: A thirty (30) day notice is required for cancellation unless you are a snowbird renting for a month or more, then a (120) day cancellation is required. Cancellations that are made more than thirty (30) days prior to the arrival date are subject to a 5% cancellation fee or $50 whichever is greater. Cancellations or changes that result in a shortened stay, or that are made within 30 days of the arrival date, forfeit the full advance payment and reservation deposit. Cancellation or early departure does not warrant any refund of rent or deposit.

Additional Terms of the Agreement:

  1. The Landlords or their agents, have the right to inspect the premises at any time to enforce the terms of this agreement. Should the Tenants violate any of the terms of this agreement, the rental period shall be terminated immediately. The Tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenants shall vacate the premises at the expiration time and date of this agreement.
  2. Any Tenant caught throwing objects off the balcony will be evicted from the premises immediately with no refunds of rents. The Tenant is also subject to arrest per the laws of the State of Florida. Sterling Breeze security strictly enforces this law.
  3. Tenants shall maintain the air conditioning no lower than 68 degrees in the summer and 78 degrees in the winter. Tenants shall keep all windows and doors closed in the summertime while the air conditioning is running.
  4. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We provide some beach towels. A $20 fee will be deducted from your refundable deposit for any missing beach towels. We do not permit bath towels or linens to be taken from the units.
  5. The Tenants shall maintain the premises in good condition using the premises only in a careful and lawful manner. The Tenants shall leave the premises in good, clean condition as to be immediately habitable by the next tenants.
  6. The Tenants shall dispose of all waste material generated during the rental period in a lawful manner by placing all waste material in the trash chute located on the other side of the building. Leaving trash outside the unit is not permitted.
  7. The Tenants agree pay for any damage done to the premises over and above normal wear and tear.
  8. No animals or pets of any kind will be brought onto the premises. This is grounds for immediate expulsion which will result in loss of all rental fees, including any deposits.
  9. The Tenants shall not sublet the property.
  10. The Tenants shall have no more than (10) people residing or sleeping on the premises.
  11. The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises.
  12. There shall be NO SMOKING inside the premises or on the balcony. If this rule is violated this is considered damage to the property and you are subject to losing your entire REFUNDABLE DEPOSIT.
  13. Landlord shall provide towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by the Landlord’s family. We supply initial Toilet paper, soap and dish detergent. Shampoo and other consumables are to be purchased by the Tennant. No reimbursement will be made for unused consumables left at the premises. If consumables exist at the premises when the Tenant arrives the Tenant is free to use them.
  14. The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired.
  15. Tenants agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Landlord enforcing this agreement.
  16. Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household.
  17. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
  18. There shall be no refunds of rents because of shortened stays or ruined expectations due to work and family emergencies or other commitments.
  19. It is the tenant’s responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the pool. Tenant agrees to have a responsible adult SUPERVISING MINORS while they swim in the pool. Tenant is hereby notified that the pool can be dangerous and tenant accepts fully the risks involved.
  20. Only legally owned and permitted firearms shall be allowed on the premises according to State and local laws.
  21. Tenant agrees that Fireworks and other hazardous materials shall not be used in or around the property.
  22. Tenant shall use the property for legal purposes only and any other use, such as but not limited to, illegal drug use, abuse of any persons, harboring fugitives or any other criminal activity; shall cause termination of this agreement with no refund of rents or deposits.
  23. The property has fire alarms installed and they are believed to function properly at the time of rental. Tennant will notify management without delay if a fire alarm “chirps” or has a low battery condition.
  24. Tenant shall see to their own security while in the property by locking doors, windows, garage doors, etc. when it’s prudent to do so.
  25. Valuable items left behind by tenant will be held for the tenant and every reasonable effort will be made to contact the tenant for return. If items are not claimed for longer than 6 months they shall become the property of the Landlord. The Landlord shall not be held liable for condition of said items.
  26. Cable TV is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content or personal preferences with regard to cable TV service.
  27. The property has WiFi as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
  28. The property supplies one landline with complimentary long distance within the United States and Canada.

Parking Policy:

VERY IMPORTANT: PARKING PASSES & GUEST WRISTBANDS– Parking passes and guest armbands will be available at the concierge desk Located on the 3rd floor walkover. There is a $20 resort fee for the passes and armbands that must be paid when you arrive. Renters must display parking pass on the dash of the car or rear view mirror at all times. Failure to display may result in towing of vehicle at renter's expense.

You may obtain a Valet cart by leaving a driver’s license at the concierge desk. When you return the cart they will return your license.

This Rental Agreement shall be signed and dated via docusign to the Landlord along with a check for 50% of rents unless the Tenant is paying online or with echeck or a credit card. All signed copies received via docusign will be considered legally enforceable and as sound as original documents. This written agreement constitutes the entire agreement between the parties, and no other verbal statements or promises are included herein, unless reduced to writing and signed by both parties to this agreement.
