Dear Vacationing Guests,

Thank you for choosing our property for your beach vacation. Tropic Winds is located beach front on the “BEAUTIFUL GULF OF MEXICO”. This is the quiet west end of Panama City Beach, Fl. When planning your travel time, please keep in mind that we are located in the “Central Standard Time Zone – CST”. The address of your vacation property is: 17643 Front Beach Road Panama City Beach, Florida 32413. When your final payment is processed you will receive the “Arrival Directions” with your unit number, parking assignment, door code and travel directions.

RENTAL AGREEMENT: The reservation process is not complete until this agreement is returned and an initial payment is processed. You need to initial each page and fill out and sign the last page. Please include a copy of your driver’s license. You can scan and email it to:

THIS UNIT IS PRIVATELY OWNED: Neither the Homeowner nor the Manager is responsible for any accidents, injuries or illness that occurs while on the premises nor its facilities. Neither the Homeowner nor the manager is responsible for the loss of personal belongings or valuables of the guest. By accepting and signing this agreement; it is agreed that all registered guests and invitees of registered guests are expressly assuming the risk of any harm arising from their use of the unit, the premises and the facilities.

1 - TROPIC WINDS IS A “FAMILY VACATION DESTINATION”: Tropic Winds has a minimum age requirement for a rental guest. We cannot rent to vacationing students or singles under the age of 25 years old, unless accompanied by an adult guardian or parent, who also must be the registered guest. Guardian or parent must be present at all times, for the duration of the contracted dates of stay. The Homeowner of this property prefers to NOT rent to chaperoned groups. Please remember that this is the Homeowner’s vacation home.

2 - MAXIMUM OCCUPANCY: The maximum number of people for this unit will be listed on the reservation confirmation. Prior approval is needed for any additional guests beyond the number listed on the reservation confirmation. Unauthorized extra guests could result in eviction.

3 - CONDITIONS: The unit will be clean and in working condition. No compensations will be given for non-working items outside of the owner’s control, including but not limited to power outages, cable TV outages, internet outages, etc., nor for non-working items in the common areas such as pool, elevators, false alarms, etc. The Homeowner and Manager will make every attempt to rectify problems that may occur while you are staying with us. It is the registered guest responsibility to notify the Manager immediately, if there is any problem in the condo. No refunds or any other compensation will be given for any problem that the Homeowner/Manager is able to rectify in a reasonable time.

4 - CHECK-IN: In order for housekeeping to have the unit ready for you and our next guests, our policy is: NO EARLY CHECK-IN – OR – LATE CHECK-OUT. CHECK-IN TIME: 4:00 PM CST. CHECK-OUT TIME: 10:00 AM CST.

5 - NON-SMOKING UNIT: This is a non-smoking unit; any violations of this policy can result in a fine of $400, which will be charged to your credit card. If no credit card is on file or charge is denied, you agree to remit immediately, upon notice, all monies due as determined by the owner.

6 - NO PETS ALLOWED: Tropic Winds HOA policy does not allow guests to bring pets on the property. It is also the Homeowners desire to not allow pets in the unit; any violations of this policy can result in a fine of $400, which will be charged to your credit card. If no credit card is on file or charge is denied, you agree to remit immediately, upon notice, all monies due as determined by the owner.

7 - NO DAILY HOUSEKEEPING: Rental rates include a one-time linen/towel set-up. We do not allow any towels or linens to be taken out of the unit. We do not provide beach towels.

WE SUGGEST YOU BRING YOUR OWN BEACH TOWELS.

8 - AMENITIES: The use of any Tropic Winds amenities is limited to rental guests, homeowners or their personal guests. Please observe Tropic Winds Policies (included in your welcome packet) or any posted rules when using the pool, hot tub, steam room, sauna, or exercise room. As a renter you agree to hold Tropic Winds 1109 harmless from, and you accept all swimming risk, for yourself and all property occupants. Furthermore, you agree that no minor children will swim unaccompanied by an adult. You agree to abide by all posted beach warning flags, rip current warnings, pool, sauna, steam room, hot tub, and exercise room policies.

9 - BEACH SERVICE: Our Rental Unit comes with beach service provided by another company between March and October. We cannot be held accountable for the unavailability of beach service or for the actions of the beach service company whether or not beach service applies to your specific unit.

10 - PARKING: This unit has one assigned parking space that is designated on your arrival directions. ANY ADDITIONAL VEHICLES MUST PARK IN A NON-RESERVED SPACE. All non-reserved spaces are located across the street in the North Parking Garage. All non-reserved parking is first-come, first-serve basis. We CANNOT guarantee any additional parking. You will be provided with proper vehicle parking placards, that must be displayed & visible at all times on Tropic Winds property. Failure to display parking placard can result in vehicle being towed at the vehicle owner’s expense. Failure to park in the correct assigned parking space or improperly parked vehicles can result in the vehicle being towed at the vehicle owner’s expense. No unauthorized vehicles are allowed on Tropic Winds property. Clearance inside the garage is 7 ft.

11 - FALSIFIED RESERVATIONS: Any reservations obtained under false pretense will be subject to forfeiture of all advanced payments, deposits, and/or rental money and the registered guest and invitees will not be permitted to check-in or may be subject to eviction. This policy includes reservations made by guests who do not check-in, are not physically present and/ or who leave during the stay. If it is discovered before or during your stay, that this reservation was made under false pretense, you agree that you will be subject to immediate eviction and you agree to forfeiture of all rental payments and or deposits and NO refund will be due and you will vacate the property immediately.

12 - HURRICANE POLICY: We will refund only if there is a mandatory evacuation as follows: **The day the State of Florida and/or local authorities order a mandatory evacuation for the “Hurricane Warning Area” of Tropic Winds located in Bay County/Panama City Beach, FL. We will refund: ** any unused portion of rent collected from a currently registered guest ** any unused portion of rent collected from a guest who is scheduled to arrive and wants to delay their arrival until the Hurricane Warning has been lifted ** any advance rents collected for a reservation that is scheduled to arrive during the Hurricane warning period. (All refunds or credits will be made in the same manner as original payment).

13 - EARLY DEPARTURES: Early departures because of your choice or because of non-compliance of Tropic Winds Rules and Regulations that result in eviction of the registered guests and any invitees of the registered guest; will not warrant any refunds of the unused portion of rents, fees or taxes collected.

14 - PAYMENT POLICY: We require a non-refundable reservation fee and a minimum initial down payment of $400 to make a reservation; of which is applied to the total rents due. If payments are not received by the documented agreed upon dates or your credit card is declined, the reservation may be cancelled. All or a portion of previous payments may become non-refundable in compliance with the cancellation policy listed below. All rental balances must be paid on or before 30 days of the arrival date. Any reservations made within 30 days of arrival will require full payment and collection of all rents, fees and taxes. I agree that all rental monies are non-refundable per cancellation policy. All payments must be paid in US funds. Personal checks for rental payments must be received within Thirty (30) days prior to arrival.

15 - CANCELLATION POLICY: *****THE RESERVATION FEE IS NON-REFUNDABLE*****

** 100% refund for cancellations more than 60 days before check-in date.

** 50% refund for cancellations more than 30 days before check-in date

** There is no refund for cancellations less than 30 days before check-in date.

(All refunds or credits will be made in the same manner as the original payment)

16 - WRITTEN EXCEPTIONS: From time to time all policies need to be altered to fit time constraints or other needs. There may need to be variations from the policies in this document that are acceptable. Any exceptions allowed in regards to any variations of the policies: MUST be documented in writing.

17 - RESERVATION COMPLETION: Reservation will be complete once this agreement is signed and returned and the initial payment is processed. ***REMEMBER: include a copy of your driver’s license. *** Any reservations are subject to be cancelled for non-payment of agreed upon terms.

18 – SECURITY/DAMAGE DEPOSIT: A $400 security/damage deposit is required to confirm your reservation and is not part of the $460 reservation deposit. The security/damage deposit it NOT applied toward the rent and will be refunded within seven (7) days after departure providing there is no loss or damage to the unit or missing items as determined solely by Tropic Winds 1109. You, the renter, agree that if the amount of damage, losses or missing items exceeds the deposit, the balance (for cost of repair of all damages, losses, and/or replacement of all missing items, whatever they may be) will be charged to the credit card on file. If no credit card is on file or charge is denied, Renter agrees to remit immediately, upon notice, all monies due for full cost of replacement and repair as determined solely by Tropic Winds 1109. In the event that the registered guest, or any invitees of the registered guest, should cause intentional damages or negligent damages, the registered guest will be held responsible for the amount of the damage

You are stating that you understand and will comply with the following statement:

I, the registered guest, understand that if I, or anyone in my party, should be cause for any damage, that I, the registered guest will be fully responsible for the charges, and further agree that Tropic Winds 1109 can charge my credit card on file for any cost. If no credit card is on file or charge is denied, I agree to remit immediately, upon notice, all monies due as determined by Tropic Winds 1109. I, ALSO, HEREBY STATE AS THE REGISTERED GUEST: that I have read this entire Rental Agreement.

I understand that this agreement is binding for the requested reservation stay that you have requested that is on file with this agreement.
