Standard Rental Terms: In addition to the specific terms of Booking and all Booking Charges, this reservation is subject to and incorporates all of our standard terms and conditions for our rental guests which are described in the attached Appendix A and incorporated herein by reference (the “Standard Rental Terms”). By signing this letter (whether manually or by electronic acceptance by clicking a box indicating acceptance), you agree to comply with the terms of this letter, including all of the terms, conditions, fees and agreements set forth in the Standard Rental Terms and Schedules 1,2,3, & 4.

Appendix A
Standard Rental Terms
These Standard Rental Terms and the letter agreement above between the owners William R. and Melody A. Dunn of “Livin' The Dream” (“Livin' The Dream,” “we,” or “our”) and the individual submitting payment and all occupants of the Premises during the stay (hereinafter jointly and severally referred to as “Guest” or “you” or “your”), constitute the entire understanding and agreement (the “Agreement”) between the parties with respect to your rental of the Premises. If there is a conflict between these Standard Rental Terms and the remainder of the Agreement, these Standard Rental Terms will govern, unless otherwise clearly stated.
- Reservation Deposit
A reservation deposit equal to 50% of the total booking charges is due at the time of reservation along with full payment for Damage Protection Insurance.
- Payment of Balance
The balance of the total booking charges is due no later than 60 days prior to your Check-In Date.
- Age Requirements
The individual signing this Agreement must be at least 25 years old and occupy the Premises during the entire stay. Reservations may not be made by or for any person under the age of 25, and no key will be issued to anyone who is not at least 25 years of age. The Premises will not be rented to vacationing students or young adults unaccompanied by a responsible parent or guardian at a ratio of one adult over the age of 25 staying at the Premises for the entire stay for every five guests between the ages of 15-25. For reservations in March or April, one adult over the age of 25 must be present and staying in the Premises for the entire stay for every three guests between the ages of 15 – 25. Proof of age is required by all guests and the Premises are subject to inspection during your stay to ensure compliance. Reservations made under false pretense are null and void and check- in will not be allowed and all booking charges will be forfeited. If a violation is discovered after check-in, you will be subject to immediate eviction and forfeiture of all booking charges in addition to liability for additional charges for damages incurred. This policy includes reservations made by a person over age 25 who does not check-in and/or who leaves overnight during any portion of a stay.
- Property Damage Protection/Accidental Damage
In lieu of a security deposit, guests are required to purchase the $49 Property Damage Protection that relieves you of the cost for unintentional and incidental damage to the Premises and its contents, not to exceed the amount of coverage of $3,000 reported prior to Check-Out.You agree to the express terms and conditions set forth in Schedule A-4(Damage Protection Waiver Terms and Conditions).
- Cancellations and Changes
You may change or cancel your reservation if you notify us at least 60 days prior to your Check-In Date. In such instances, your reservation deposit will be refunded less a $199 administrative cancellation/change fee. No refund of your reservation deposit will be given for any cancellation or change for any reason inside of 60 days of your Check-In Date.
- Check-In / Check-Out Times
Check-In begins at 4:00 p.m. (CT). Check-Out time is 10:00 a.m. (CT). Late Check-Out requires special arrangements and may be subject to additional fees. No refunds will be given for late arrivals or early departures. Prompt on-time departure on your check-out date is required to allow the cleaning service to prepare the house to meet our standards before the next guest arrives.
- House Rules
It is the responsibility of the Renter to inform every person or guest within the rental party of all House Rules and Policies not limited to those listed in this agreement. You and all within your rental party agree to the express terms and conditions set forth in Schedule A-3 (“Livin’ The Dream House Rules and Policies”).House rules are subject to change without notice.
- No Smoking
Smoking or vaping of any substance is not permitted indoor or outdoor on the Premises, porches, patios or balconies. Due to this house being surrounded by pine straw, any flame or fire lit substance is prohibited. If you violate this policy, or the smell of smoke is found inside the property you will be charged an additional $500, plus the expense of any cleaning we deem necessary. Violations may also result in immediate eviction and forfeiture of all booking charges.
- Pet-Free Property
Pets are not allowed. If you violate this policy by bringing a pet to a non-pet friendly property, you will be charged an additional $500 fee for each unauthorized pet, plus the expense of any cleaning we deem necessary in our sole discretion. Violations may also result in immediate eviction and forfeiture of total booking charges.
- Occupancy
People other than those specifically listed by name and age in the Rental party set forth may not stay overnight on the property without permission. Each and every person on the property is the sole responsibility of Renter. The maximum number of occupants for the Premises is based on the Premises’ ability to comfortably and safely house our guests (“Livin’ The Dream” Main house 10 persons, “Poolside Paradise” Carriage house 4-6 persons). For safety reasons, if the number of individuals on the Premises at any time during your stay EXCEEDS THE NUMBER AND NAMES OF GUESTS YOU REGISTERED UPON THIS AGREEMENT or exceeds the MAXIMUM 16 PERSON OCCUPANCY, unless otherwise approved, you may be evicted from the Premises immediately and forfeit all booking charges, in addition to liability for additional charges for damages incurred. There will be a $500 fee per night during your stay for each unregistered guest occupying the premises.
- Events and Parties
You may not have parties or events at the Premises without obtaining our prior approval and paying additional fees. All approvals shall be in our sole discretion. Violation of this provision may result in immediate eviction, forfeiture of all booking charges, event charges and liability for additional charges for damages incurred.
- Multi-Party Occupancy.
If two or more parties reserve or occupy the Premises, and one or more of the parties cancel, the primary guest whose name appears on the reservation is financially responsible for all booking charges associated with the reservation. In addition, each party, jointly and severally, is required to be in compliance with all of the terms and conditions of this Agreement and will be liable for any and all damages which may be caused during a stay.
- Vehicle Guest Pass
Renters must check in at the Carillon guard gate and receive a vehicle guest pass for their entire stay. A Carillon Letter of Authorization (LOA) form will be provided. We allow for the parking of 4 vehicles. Print 1 per vehicle in advance of your arrival. Renters must display the parking pass on the dashboard where the Carillon guard can see it at all times. Failure to display the parking pass may result in towing of vehicle at the Renter’s expense. Leave the parking passes in the Carillon guard gate mailbox at departure.
- Parking.
Our property allows for parking of 4 vehicles. Vehicles must be parked in the driveway . Parking is allowed in front of the house on the gravel area between the sidewalk and the street. Vehicles cannot block the sidewalks or driveway. Limit to no more than 2 vehicles in front. Do not park vehicles across street, in front of other properties, empty lots or other driveways. Additional parking is available at the Carillon Meeting House or Carillon Village Market parking lot. Towing is enforced by neighborhood security and will be the responsibility of the Renter.
- Buses, boats, RV’s and Trailers
Buses, boats, RV’s and trailers including motorcycles, bicycle and/or golf cart trailers are NOT allowed. Please make storage arrangements prior to your arrival. Contact Surfside Storage at (850)233-5505 for a storage location.
- House Access.
Prior to your arrival, the Homeowners will provide you with the access code to retrieve house keys from the Lockbox on the property. The houses should be locked at all times when not occupied. If locks, doors or entry are damaged during your stay, Renter will be responsible for locksmith, repair and door repair. Contact Homeowner prior to contacting a locksmith. House keys are to be returned to the lockbox upon your departure. You will be charged for missing keys and costs to re-key locks
- Owner Areas
The Premises have certain areas that are off-limits to you and your guests, including owners’ closets, cabinets, trunks, garages (that may be locked) or areas marked, or indicated, as off- limits to guests. Do not attempt to access these areas during your stay. Do not unplug any electrical cords from outlets that are secured, used for WiFi , Alarm and Barrier Systems, appliances, audiovisual equipment or other Smart Home Devices.
- Housekeeping.
All stays will be subject to a cleaning fee. Daily housekeeping service during your stay is not provided. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate or housekeeping rate. If your stay is greater than 1 week, additional cleaning fees will apply. You will be responsible for the cleaning of the Premises during your stay and for leaving the Premises in good condition at check-out. We respectfully request you remember that you are staying in someone’s home during your vacation; please treat it with the care you would your own. If the Premises are found abnormally dirty at check-out, you will be charged for performing a deep cleaning of the Premises.
- Amenities/Supplies
We provide an initial complimentary set of personal and household amenities You are responsible for the purchase of any additional items you may require during your stay.
- Hurricane Doors
All exterior doors are six pronged Hurricane Doors and require the handles to be lifted in order to latch or lock. Refrain from slamming or extreme pressure on the doors. Failure to fully latch doors will cause the HVAC system to shut off. Maintenance and damage fees will be charged if there is any evidence of door , window or sensor tampering.
- Thermostat
Do not alter, tamper with, or modify the pre-programmed settings. Doors or windows left ajar will cause HVAC units to shut off. Immediately upon closing a door or window that is left ajar, the HVAC unit will resume. Maximum and Minimum thresholds are set to keep the HVAC running optimally and prevent the A/C from freezing up during your stay. Note: Gulf Power may implement “critical” periods that force the thermostat setting to a safe level to avoid brown-outs.
- Door and Window Sensors
Door sensors and alarms are installed as a pool safety barrier feature. Damage and maintenance fees will be charged if there is any evidence of door or window sensor tampering.
- Pool/Hot Tub/Spa
Heating of the Pool and/or Hot Tub is seasonally and temperature restricted and requires additional fees to be paid in advance at booking. The spa jets without heat are available at normal temperatures without extra fees. The pool and hot tub are waterfall and flow connected and maintain similar temperatures unless heated separately. Contact owner for pricing. YOU AND EACH OTHER OCCUPANT USE THE POOL/HOT TUB AND SPA AT YOUR OWN RISK AND AGREE TO ALL “LIVIN’ THE DREAM” POOL/HOT TUB/SPA RULES AND POLICIES. You agree to the express terms, conditions and waivers set forth in Schedule A-1 (“Private Pool/Hot Tub/Spa Agreement”).
- Damage Policy
You are responsible for the Premises, its contents, and yourself during occupancy. You must lock windows and doors securely when not in the Premises. We are not responsible for any acts of theft or vandalism, or other damages to any personal property or for personal items you leave in the Premises at departure. Rearranging the furniture or removing any items from the Premises is prohibited. After Check-Out, we will inspect the Premises for damage, rearranged furniture, missing items, and abnormally dirty appearance. If we determine that damage has occurred, items are missing, or the Premises are abnormally dirty, we will repair the damage, replace the missing items, and/or perform a deep clean of the Premises at your expense. By signing this Agreement, you authorize us to file claim for up to $3,000 damages, or charge the credit card or checking account on file to reimburse us for any such expenses, or expenses exceeding that amount.
- Maintenance
Please notify the Homeowners (1-615-766-2777/Randy or 1-630-234-4866/Melody) of any maintenance issues. We will make every attempt to fix the issue ASAP! If the premise appears dirty or damaged upon check-in, Renter shall inform Homeowner immediately by phone. No refund or rate adjustment will be made for maintenance failures, including any disruptions or failures related to the supply of electricity, water, pool systems, air conditioning, television or cable service, appliances, wi-fi, etc., regardless of whether such issues were reported to us.
- Entry by Owners and Service Personnel
We or our agents may enter the Premises in case of an emergency, to make any repairs, alterations or improvements, to supply services, to show the Premises to prospective purchasers, renters or contractors, or upon reasonable suspicion that you have breached any of your obligations hereunder.
- Carillon Neighborhood Rules and Bay County Beach Rules
You and all members of the Rental Party are required to follow the Carillon Neighborhood Rules and Policies and Bay County Beach Regulations while renting “Livin’ The Dream.” Please be polite of your neighbors while at the house or on Carillon beach. Quiet times are from 10 pm to 7 am daily throughout Carillon. Hanging towels, clothing or articles over railings may result in a fine by Carillon Security. Homeowners are not responsible for associated fines assessed during Renter’s stay.
- Electric Car Charger
This home is equipped with a high powered 240v outdoor electric car charging outlet and is intended for the use of one registered guest per rental period (at the Homeowner’s discretion and approval). You must obtain permission to charge with listing of vehicle, make, model and license # and type of charging cord used. The user of this outlet does so at their own risk, agrees to follow all rules and regulations as stated in “Livin’ The Dream” House Rules and Policies and assumes responsibilities and repair costs for any fire or electrical damage that may result to the vehicle or the property.
- Bicycles
If you rent bicycles or bring your own bicycles, do not lean, prop, chain or lock the bicycles to our property, fences or fixtures. Use the Carillon provided bicycle racks or place bicycles in the back driveway.
- 3rd Party Rental Items
All rental items for a 3rd party (i.e. bicycles, golf carts, baby gates, furniture, etc.) must be returned or picked up by the rental company prior to 12 pm CT on the same day of your departure.
- Rate Adjustments After Booking
All specials and promotional offers apply to new bookings only and not to existing reservations and are available for a limited period of time. We reserve the right to correct or adjust rates to the published rates at the time of reservation if the rates have been misquoted due to human and/or computer error.
- Preferences; Conditions.
The Premises are individually owned and furnished to the owner’s taste.. Inventories and furnishings are subject to change without notice. We do not give refunds or rate adjustments if the Premises do not meet your preferences or expectations. We are not responsible for errors on our website or brochure, for changes to property or furnishings made by owners, or for any conditions beyond our control upon arrival.
- Travel Protection Insurance (optional)
In case of certain unforeseen events, this insurance may help protect amounts you have paid towards your stay. Depending upon where you booked your reservation, Travel Protection insurance may or may not be automatically added as a separate item on your total booking charges. If your total booking charges do not include a separate line item for travel insurance, then you are not purchasing travel insurance and you are not covered. Travel insurance is optional.
- Interference with Stay
We are not liable for any disturbance or interruption that may occur during your stay that is outside of our control, including noises, disturbances or facility closures, whether due to construction on nearby properties, neighbors, events or other circumstances beyond our reasonable control. You are not entitled to a refund relating to any such disturbances or interference nor entitled to be moved to another property. With respect to construction, the rules regarding acceptable noise levels, start and finishing times, and other restrictions relating to any such construction are governed by local ordinances and/or community specific rules and regulations beyond our control. However, we will notify the appropriate parties and request appropriate remedial action be taken in the event that we receive notice that the construction at issue may be in violation of any such regulations or ordinances.
- Accidents or Illness
All units are privately owned. The Homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guests. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
- Hurricanes and Severe Weather
We do not issue refunds for cancellations or shortened stays due to actual or anticipated hurricanes, tropical storms, other inclement weather or acts of God under any circumstances. If you purchase Travel Protection insurance, you may be entitled to a refund or partial refund in the event that the National Hurricane Center and our local governing officials issue “Mandatory Evacuation” order for the location of the Premises, provided you purchased coverage before the storm was named.
- Compliance with Laws, Rules and Regulations
You shall abide by and observe all applicable federal, state and local laws during your stay, as well as any rules and regulations governing the use of the Premises and the Carillon neighborhood you are occupying. These rules apply to both owners and guests. IF YOU OR OTHER OCCUPANTS (A) FAIL TO STRICTLY ABIDE BY THE LAWS OF THE UNITED STATES, THE STATE OF FLORIDA, LOCAL LAWS AND/OR NEIGHBORHOOD RULES AND REGULATIONS, OR OTHERWISE FAIL TO STRICTLY ABIDE BY THE TERMS OF THIS AGREEMENT, (B) CAUSE DAMAGE TO THE PREMISES OR ANY SURROUNDING AREA, OR (C) ENGAGE IN ANY OTHER ACT(S) WHICH INTERFERE WITH OTHERS’ RIGHTS TO QUIET ENJOYMENT OF THEIR PREMISES, YOU SHALL BE SUBJECT TO IMMEDIATE EVICTION FROM THE PREMISES WITHOUT ANY REFUND OF BOOKING CHARGES AND LIABILITY FOR ADDITIONAL CHARGES FOR DAMAGES INCURRED. ALL SUCH DECISIONS SHALL BE IN OUR SOLE DISCRETION.
- Indemnification
You and all occupants shall, jointly and severally, defend, indemnify and hold Livin' The Dream (including its members, managers, officers, employees, subcontractors, agents and representatives) and the owner of the Premises (the “Livin' The Dream Parties”), harmless from any and all claims, liabilities, losses, costs and expenses (including, but not limited to, reasonable attorneys’ fees and costs of suit) incurred by the Livin' The Dream Parties related to, as a result of or arising from your actions and any occupants, including any negligent acts or omissions, willful misconduct, violations of laws or any obligations in this Agreement, except to the extent such claims, demands and actions arise from the gross negligence or willful misconduct of the Livin' The Dream Parties.
- LIMITATION OF LIABILITY
YOU UNDERSTAND AND AGREE THAT NO Livin' The Dream PARTY ASSUMES ANY LIABILITY FOR LOSS, DAMAGE, CLAIM OR INJURY TO PERSONS OR THEIR PERSONAL PROPERTY WHILE ON THE PREMISES, NOR FOR ANY INCONVENIENCE, DAMAGE, CLAIM, LOSS OR INJURY ARISING FROM OR RELATED TO ANY TEMPORARY DEFECTS OR STOPPAGE IN SUPPLY OF WATER, GAS, CABLE SERVICE, ELECTRICITY, INTERNET SERVICE OR PLUMBING; CHANGES TO RENTAL ASSIGNMENTS; WEBSITE OR BROCHURE ERRORS; WEATHER CONDITIONS; NATURAL DISASTERS; ACTS OF GOD; OR OTHER REASONS BEYOND THEIR CONTROL.
- RELEASE OF THE “LIVIN’ THE DREAM” PARTIES/HOMEOWNERS (WILLIAM R. AND MELODY A DUNN)
In addition to the other specific releases set forth in this Agreement, you, for yourself, your heirs, assignors, executors, and administrators, and on behalf of each occupant of the Premises, and such occupants’ heirs, assignors, executors and administrators (each a “Guest Releasing Party”), fully release and discharge the Livin' The Dream Parties/ Homeowners,William R. And Melody A Dunn from any and all liabilities, claims, demands, and causes of action which any Guest Releasing Party has or may have in the future by reason of any injury, loss or damage by whatever nature which has or have occurred, or may occur to any Guest Releasing Party during the stay as a result, or in connection with the occupancy of the Premises or in use of any item provided during your stay, including bikes, golf carts or other recreational items, including any claims, damages, costs or causes of action due to the negligence, breach of contract or wrongful conduct of any Livin' The Dream Party, and agree not to sue and to hold the Livin' The Dream Parties free and harmless of any claim or suit arising there from.
BY SIGNING THIS AGREEMENT, YOU UNDERSTAND, INTEND AND DESIRE TO RELEASE, ON BEHALF OF EACH GUEST RELEASING PARTY, THE LIVIN’ THE DREAM PARTIES FROM ANY AND ALL LIABILITY ARISING FROM OR RELATED TO THE OCCUPANCY OF THE PREMISES TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE STATE OF FLORIDA.
- Recreational Items
If the Premises provides complementary golf cart(s), bicycles or other recreational items (collectively, “Recreational Items”), you further agree to the express terms, conditions and waivers set forth in Schedule A-2 (“Recreational Items Waiver and Damage Addendum”).
- Private Pool/Hot Tub/Spa
This property has a private pool/hot tub/spa, you further agree to the express terms, conditions and waivers set forth in Schedule A-1 (“Private Pool Addendum”).
- Use of Personal Data and Private Information
Your privacy—and the protection of your private information, such as your email address, credit card information, bank account information, physical address, and name is important to us. We will only use your financial information (including your credit card or check account information on file) as necessary to process payment for booking charges and other authorized fees and damages in accordance with this Agreement. We will only use your other private information that we may collect to (i) fulfill, offer, or further develop (or improve) our products, services, and offers or those of our affiliates, (ii) communicate with you or our applicable employees, agents, and third-party service providers, and (iii) provide you information about new and existing products, services, and offers that may interest you related to Livin' The Dream or our affiliates. Additionally, we may also collect “cookies” (small files that contain unique identifiers that allow our computers to identify your web browser, though not you specifically, each time you visit our website) and anonymous information about you, such as how long you stayed on the website, the name of your internet service provider, and the portions of our website you viewed. Any cookies or anonymous information we collect will only be used to improve functionality of our website, or for research and analytical purposes (though no personal information about you will be included for research and analytical purposes). Your personal information will not be shared or sold to third parties for the purpose of their telemarketing or selling their products or services, unless you otherwise consent to such disclosure or sale.
While utilizing our website, or any internet access made available during your stay at the Premises, you agree not to engage in any activity that violates any federal or state privacy, copyright, or criminal law, or that could be considered malicious or unethical. If you become aware of such activity by yourself, or by another, you must immediately notify us. Likewise, you agree not to share or disclose any password created by you, or made available to you, related to internet access or our website, or internet based devices in the home.
Despite our continual and evolving efforts to maintain appropriate protections, we cannot guarantee the security of your private information. Accordingly, you acknowledge and agree that we make no such guarantee. You recognize and accept that we have no control over the unauthorized interception or breach of any communications or data once it has been sent or has been subject to unauthorized access, notwithstanding all reasonable security measures employed by us or our third-party vendors. You consent to our use of these electronic devices and applications and submission of confidential client information to third-party service providers for your reservation. Similarly, our website may provide links to other websites or resources, of which we have no control over. We are not responsible for the availability of such external websites or resources, and we do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such website or resource.
- Applicable Law
This Agreement shall be deemed to have been made and entered into in the State of Florida, and will in all respects be governed by, construed under, and enforced and interpreted in accordance with the laws of the State of Florida, excluding its principles of conflicts of laws.
- Venue, Jurisdiction, and Attorneys’ Fees
The exclusive venue for any civil action related to this Agreement or the course of dealings between the parties is the courts sitting in Walton County, Florida. The parties hereby submit to the personal jurisdiction of all the courts in the previous sentence and agree not to challenge such jurisdiction. In any action, suit, or proceeding to enforce or interpret the terms of the Agreement or to collect any amount due hereunder, the prevailing party shall be entitled to reimbursement for all costs and expenses reasonably incurred in enforcing, defending or interpreting its rights hereunder, including, but not limited to, all attorneys’ fees and the costs expended in determining entitlement to and amount of such fees.
- Waiver of Jury Trial
BY ENTERING INTO THIS AGREEMENT, THE PARTIES KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A JURY TRIAL AS TO ANY CLAIMS A PARTY MAY CLAIM TO HAVE AGAINST THE OTHER WHICH ARISES OUT OF THIS AGREEMENT OR THE COURSE OF DEALINGS BETWEEN THE PARTIES.
- Force Majeure
Notwithstanding any other provision of this Agreement, no party to the Agreement shall be deemed in default or breach of this Agreement or liable for any loss or damages or for any delay or failure in performance (except for the payment of money) due to any cause beyond the reasonable control of, and without fault or negligence by such party.
- Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes any prior understanding, marketing or agreement among them respecting the subject matter hereof. There are no representations, arrangements, understandings or agreements, oral or written, relating to the subject matter of this Agreement, except those fully expressed herein. No waiver of any provision hereof shall be valid or binding on the parties hereto, unless such waiver is in writing and signed by or on behalf of the parties hereto, and no waiver on one occasion shall be deemed to be a waiver of the same or any other provision hereof in the future.
- Severability
If any term or provision of this Agreement is held illegal, invalid or unenforceable, such illegality, invalidity or unenforceability shall not affect the legality, validity or enforceability of the remainder of this Agreement.
- Binding; No Assignment
All of the terms, covenants and conditions of this agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, legal representatives, successors and assigns. The Premises may not be sublet, and you may not assign this Agreement without our consent. Your reservation is personal to you and is not transferable to any other party. Any attempted assignment shall be null and void.
- Headings
Section and other headings contained in this Agreement are for reference purposes only and are in no way intended to define, interpret, describe or limit the scope, extent or intent of this Agreement or any provision hereof.

Private Pool Agreement
Waiver of Claims and Assumption of Risk
The Premises at 208 Dune Crest Ln., Panama City Beach, FL. 32417 has a private pool/Spa/Hot Tub
As a visitor to and short term vacation renter, upon completing the rental agreement you agree and acknowledge you are informed, aware and agree to comply with this Waiver of Claims and Assumption of Risk, the policies as follows and all “Livin’ The Dream” Pool/Hot Tub Rules and Policies.
As the Responsible Renter of the property you are required to share the information within thisWaiver of Claims and all “Livin’ The Dream” Pool/Hot Tub Rules and Policies with every other occupant/guest to be on the premises during your stay and are responsible for yours and their agreement to the policies as follows:
- YOU AND EACH OTHER OCCUPANT USE THE POOL AT YOUR OWN RISK AND AGREEE TO ALL “LIVIN’ THE DREAM” POOL/HOT TUB RULES AND POLICIES.
- The owners of the property (William R. And Melody A. Dunn) do not assume any responsibility in the event of damage or bodily harm to you or any other occupant.
- At no time is there a lifeguard on duty, you (the renter and all occupants or guests) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay.
- You assume all responsibility for and charges incurred from misuse or negligence of the pool/hot tub/spa equipment, the pool/hot tub/spa itself, pool furniture and any pool accessories on the Premises that occur during your stay.
- You are to comply with posted instructions for use of pool/spa/hot tub control buttons and agree not to allow children to use these control buttons.
- Neither you nor any other occupant should disable, disarm or otherwise remove or compromise any pool safety feature, including any barrier or exit alarm.
- All doors leading to the pool area should be kept locked at all times. Use the child proof latches provided on exterior doors leading to the pool area when children are present.
- You should notify us immediately if any pool safety feature is not working properly during your stay.
- Only you and other occupants are permitted in the pool or pool area.
- All policies applying to the Premises include the pool/hot tub/spa and pool area, as well.
- The maximum number of people in the pool or pool area should not exceed the number of the reservation party and never exceed the 16 person maximums capacity of the Premises at any time.
- Children under the age of ten (10) regardless of swimming ability should be supervised at all times by an adult when in or near the pool or pool area.
- No diving or jumping off edges or the water fall is allowed. Always enter the pool feet first.
- Do not move or remove the pool lounger from its position. Do not move to the deep water position or to the pool deck. No standing on or jumping from pool lounger.
- No glass containers are permitted in the pool or pool area. You may be charged an additional cleaning fee if broken glass is found in and around the hot tub and pool area.
- Impaired individuals should not enter the pool or pool area.
- No riding equipment of any kind including bicycles, skateboards, skates, roller blades or scooters, is permitted in the pool or pool area.
- Only single-person flotation devices are permitted in the pool except for devices used to aid individuals with a handicap.
- Do not leave floatable or other objects in the pool when not present in the water. These may block the pool filtration systems and cause system malfunction.
- Rough-housing is not permitted in the pool or pool area. Running, pushing and dunking are prohibited.
- No animals or pets are permitted in the pool or pool area.
- Acceptable swimming apparel must be worn in the pool/hot tub. All children not toilet trained must use swim diapers.
- Please shower before entering the pool to keep oils, sand and chemicals from building up in the equipment. A hot/cold outdoor shower is provided.
- Pool hours are from 7:00 a.m. until 10:00 p.m.
- The hot tub is not suitable for pregnant women, children under 12 years of age, (especially those under the age of 5) intoxicated persons or persons with certain heart or health conditions. Maximum temperatures for children should not exceed 98 degrees.
Pool/SPA HEAT: Pools and overflowing SPA/Hot Tubs that are equipped with heaters are not guaranteed to sustain any constant temperature. Please note that pool temperatures vary due to certain circumstances, including but not limited to: wind, rain, low temperatures, storms, sand, fungus or algae caused by extreme temperatures, excessive use or contamination by Guests. There shall be no compensation for any loss of use. Any damage to the pool and/or spa caused by Guest and any other persons on Property during the agreed upon Rental Period, including but not limited to: broken glass or other items introduced into the pool, contamination of the water, damage to the automatic cleaners or equipment, or excessive loss of water will result in charges to the Guest for correction of the problem.
SPA Shut Off: When and if the spa is used, Guests must comply with “Livin’ The Dream” Pool/Hot Tub Rules and Policies, comply with posted instructions for use, and agree adults only will be responsible for turning on and shutting off the SPA/Pool Controls. Failure to shut off the Hot Tub/Spa after use or running multiple “run times” the may result in damage to the unit and an excessive utility bill, which will result in repair and utility fees charged to the Renter.
You agree that you are aware your stay at the Property involves risks that may result in serious bodily injury and/or death to you and any other occupants. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Property during your stay, and the condition of the Property. I understand that the description of the risks in this Release of Liability, Waiver of Claims and Assumption of Risk (the “Document”) is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury and or/death.
The use of other equipment (including recreational equipment, beach loungers, umbrellas etc.) and facilities provided by the Owners of the property and participation in outdoor activities, involves risks including, but not limited to the following: risk of property damage, bodily injury, including, but not limited to permanent disability, paralysis, and possibly death. These risks may result from a variety of circumstances including, but not limited to, the use or misuse of the equipment or facilities, from the activity itself, from the acts of myself or others, or from the unavailability of emergency medical care.
You and all occupants or guests of “Livin’ The Dream” understand and acknowledge that being in or near the ocean present various risks and hazards, including strong currents, unexpected wave activity, floating debris and other potential hazards. You assume all such risks associated with being near or in the ocean.
In consideration of being permitted to rent and stay at the Property, you agree hereby release from liability and waive any and all claims that you or any other occupant or guest on the property during my stay have or may have in the future against the property owners (William R. And Melody A Dunn) and their members, principals, agents, officers, employees, and representatives (collectively “Releasees”) the landlord/owner of the Property.
You agree to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including property damage that may result from arise out of or be related in any way to my rental and stay at the Property. If any portion of this Document shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Document and the remainder of the Document shall not be affected and shall be valid and enforceable to the fullest extent permitted by law.
You and all other occupants and guests during your stay are informed and agree
TO WAIVE ANY AND ALL CLAIMS in the future against the Owners of “Livin’ The Dream” (William R. Dunn and Melody A Dunn) its directors, officers, employees, agents, or representatives (hereinafter referred to as the “Releasees”) relating to my use of the pool and pool area; TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES; TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area.
I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE DOCUMENT AND THAT I UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM. I UNDERSTAND THE EFFECT OF THIS DOCUMENT IS I AM RELEASING LIABILITY AND WAIVING MY RIGHT TO SUE RELEASEES AND I AM ASSUMING RISK FOR MATTERS RESULTING FROM, ARISING OUT OF OR RELATING IN ANY WAY TO MY RENTAL AND STAY AT THE PROPERTY, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH AND PROPERTY DAMAGE. I ACKNOWLEDGE THAT THIS DOCUMENT APPLIES EVEN IF RELEASEES MAY BE NEGLIGENT IN WHOLE OR PART. I UNDERSTAND THAT THIS DOCUMENT APPLIES TO AND SHALL BE EFFECTIVE AND BINDING UPON ME, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE, ESTATE, AND ALL MEMBERS OF MY FAMILY, MINORS, AND OTHERS IN MY CARE, CUSTODY OR CONTROL.

Recreational Items Addendum
You and any other occupant of the Premises (including minor children, any members of your household, or anyone who makes use of any of the Recreational Items, and together with you, each collectively and individually referred to herein as a “User” or “Users”) hereby agree to abide by the following terms and conditions:
- Users shall obey all federal, state and local laws and any applicable community rules and regulations.
- No one other than the undersigned shall be eligible to use the Recreational Items.
- No person using a Recreational Item shall be under the influence of drugs or alcohol or have any impairment which would affect his or her ability to operate a Recreational Item in a safe manner in compliance with all federal, state and local laws and any applicable community rules and regulations.
- Bicycle helmets and life jackets are recommended and available upon request from us. Any User who declines to wear a helmet or life jacket while riding a bicycle or using a water-based Recreational Item does so at his or her own risk. Each User understands that wearing protective gear, such as a helmet or life jacket, does not eliminate the risks of using a Recreational Item and may not reduce the
risk of injury in the event of an accident.
- Users are prohibited from carrying, pulling or towing a Recreational Item at any time. Users of bicycles shall not add any kind of seat or modification to allow someone else to ride on the rear fender, and no one shall ride on the handlebars at any time.
- Any equipment failure shall be reported to us immediately.
- Users shall not ride, park or store a Recreational Item outside of designated areas and shall properly secure Recreational Items at all times.
- Unless you are told by us otherwise in writing, the Recreational Items are not equipped with the statutorily required lighting sufficient to allow riding in the dark.
- Users are responsible for any and all damages to any Recreational Item that occurs during the stay, including theft or vandalism of any Recreational Item and other equipment, regardless of whether Users or someone else is at fault for such damages, and Renter hereby authorizes us to charge the credit card or checking account on file for any amounts incurred by us to repair or replace any Recreational Item, including paying the reasonable (i) costs of repair and diminution in value, if any, or the full replacement value of such Recreational Item and other equipment; and (ii) reasonable administrative, shipping, storage and other related fees. The decision as to whether to repair or replace a damaged Recreational Item is in our sole discretion. Delay in recovery of damages, including any dispute of any charges or damages, may result in additional charges due to increased down-time, storage or other fees.
- The Users agree to return the Recreational Items and equipment in the same condition as received, except for ordinary wear and tear, at check-out.
RELEASE AND INDEMNIFICATION
The Users acknowledge the inherent risks involved in using the Recreational Items and further agree that the use of the Recreational Items SHALL BE AT THEIR OWN RISK. The Users understand that the use of a Recreational Item has known and unknown risks, which could result in physical or emotional injury, paralysis, death or damage or injury to the undersigned, to property or to other persons, and that we cannot eliminate these risks. The Users knowingly, intelligently and voluntarily assume all risks, including but not limited to any injury or damage that may result including but not limited to colliding with one or more bicycles, motor vehicles, water vessels or objects of any kind, falling off the Recreational Item, sudden flat tires or holes in the Recreational Items, potholes or water obstructions, failing brakes and weather related risks. Having acknowledged these risks and other unforeseen risks, Users desire to use the Recreational Items despite these risks and agree to assume the risk of injury or damage resulting from the use of a Recreational Item and agree to release and indemnify the Livin' The Dream Parties as set forth in the paragraphs below.
The Users hereby release, waive, discharge and covenant not to sue or bring any claim against the Livin' The Dream Parties for any liability, claim and/or cause of action arising out of or related to any loss, damage or injury, including death, that may be sustained by the Users or the members of their household related to, arising out of or incident to the use of a Recreational Item or other equipment, including the possession, use, operation or return of a Recreational Item or other equipment.
The Users have adequate insurance to cover any injury or damage that he or she may cause or suffer while using the Recreational Items or sufficient assets to self-insure the costs of any such injury or damage. Any insurance coverage maintained by the Users, whether liability, casualty, personal or health, shall be the primary coverage in the event of any loss, injury, death or damage to persons or property while using the Recreational Items.
The Users understand that we are not the manufacturer or supplier of the Recreational Items, and all Recreational Items and other equipment are provided “AS-IS” without any warranty, either express or implied, including any warranty of merchantability or fitness for a particular purpose.

“Livin’ The Dream”
Rental House Policies
Welcome! You Are Special Guests! This is a home in which we, the owners, have strived to provide a luxurious yet casual, Five Star environment with many great amenities especially for your enjoyment during this stay and hopefully the next! Unlike most rental homes in the area, this privately owned two home beach compound is new construction as of 2018 and has been professionally decorated with new high end furnishings and furniture, rugs, accessories and just about everything you will need to feel right at home. We want you to be able to enjoy it on each and every stay, so we ask every guest to please be respectful of furnishings, minimize roughhousing, handing of decor items and to refrain from careless actions which may cause damage to the interior and exterior design of our home. “Livin’ The Dream” was designed with luxury and comfort in mind for the discerning beach bound travelers who value quality and care.
The Responsible Party’s signature upon booking indicates his/her full agreement with “Rental House Policies” and he/she is responsible for informing all guests of Rental House Policies. The Responsible Party agrees to be an occupant of the property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over 21 or accompanied by a parent or legal guardian. The Responsible Party agrees to be solely responsible for actions of themselves and all family members, guests, and invitees present at the property at any time during your stay, and to ensure all occupants understand and comply with the terms. Failure for any guest to comply with these regulations will result in fees/penalties charged to the “Responsible Party’s” credit card and/or eviction of all guests from the property.
Maximum Occupancy. For safety reasons, the maximum occupancy during your stay will be the total number of guests for which you have registered and SUBMITTED NAMES for the duration of the booking. A $500 penalty will be charged to your credit card per day for each additional non-listed guest. Only renters accepted through the original booking have the privilege of house amenities, pool/ hot tub, barbecue and neighborhood amenities. This is not transferrable without permission. The maximum number of occupants for the Premises is also based on the Premises’ ability to comfortably and safely house our guests (“Livin’ The Dream” Main house up to 10 persons, “Poolside Paradise” Carriage house up to 4-6 persons). For safety reasons, if the number of individuals on the Premises at any time during your stay EXCEEDS THE NUMBER AND NAMES OF GUESTS YOU REGISTERED UPON THIS AGREEMENT or exceeds the MAXIMUM 16 PERSON OCCUPANCY you may be evicted from the Premises immediately and forfeit all booking charges, in addition to liability for additional charges for damages incurred.
1:2 Adult/Minor Ratio. To optimize adult supervision and security there shall be a maximum of 2 minors to each 1 adult ratio, unless otherwise permitted.
Visitors (anyone who’s name is not submitted on the original guest list) allowed only with permission and are subject to all house rules and regulations, and shall never exceed the house maximum capacity of 16. We are renting space in our home with you, our registered guests, whom we have checked out via your verifications and reviews. If you want to have any visitors for the duration of your stay, please discuss it with us first (Randy @ 615-766-2777 or Melody @630-234-4866 ).
Absolutely No Smoking. No smoking is permitted anywhere on the property (including porches, decks or outdoor areas). “Smoking” means inhaling, exhaling, breathing, carrying, or possessing any lighted or electronic cigar, cigarette, pipe, vaporizer, joint, or other tobacco or marijuana product in any manner or any form. This house is surrounded by pine straw which is highly flammable. Disposal of any cigarettes, butts, or other fire lit or smoking product is prohibited on the property, in the landscape or trash cans.
No Pets. No pets of any kind are permitted at the property. The owners of this home suffer from allergies and asthma and want to be able to comfortably use the home or host any future guests with similar health issues.
No Events. There shall be no events, wedding parties, meetings, parties or group gatherings other than registered guests.
Parking. We allow parking for 4 vehicles. You may park in the driveway or on in front of the house, in the gravel area between the sidewalk and the street, in the direction of traffic flow. Vehicles cannot block the sidewalks or driveway. Limit to no more than 2 vehicles in front. Do not park vehicles across street, in front of other properties, empty lots or other driveways. Additional parking is available at the Carillon Meeting House or Carillon Village Market parking lot. Towing is enforced by the Carillon Neighborhood Security and will be the responsibility of the Renter. No boats, RVs, buses, campers, recreational vehicles, personal watercraft, wave runners, trailers, regardless of size or type may be parked at the property.
Electric Car Charging. This home is equipped with a high powered 240V outdoor electrical car charging outlet located in the driveway.
- Only one vehicle will have authorized access to charging
- That guest must be an occupant and registered for the rental period
- That guest must obtain permission to charge with listing of vehicle, make, model and license #, type of charging cord used.
- Extension cords to and from this outlet are prohibited.
- Supply your own compliant charging cord of shortest distance, in good repair, without fray.
This outlet is an amenity for the use of one of our registered guest's vehicles only per rental period. Any attempts to use it for any other use, appliance or other vehicles will result in heavy fines to the renter. Visitors are not permitted use of the car charging outlet. The user of this outlet does so at their own risk and assumes responsibilities and repair costs for any fire or electrical damage that may result to the vehicle or the property.
Keeping Doors and Windows Closed… Keep The House Comfortable! . The HVAC units disengage and shut down when the doors and windows are left open longer than 2 minutes and will resume immediately once doors and windows are in the fully closed and latched position. This home boasts two porches and a pool deck with furnishings so you can feel the ocean breeze and comfortably enjoy the outdoors. The thermostats have a seasonal minimum/maximum temperature threshold to prevent the units from freezing up. Do not alter, tamper with, or modify the pre-programmed settings.
Hurricane Doors…A Little Patience Required This house is equipped with six pronged exterior hurricane doors. All exterior doors require the handle to be lifted whether inside or outside before the door latches in the proper closed and lockable or unlocking position. Failure to lift the handle may cause the doors to remain in the open position Any exterior door in the open or unlatched position for more than 2 minutes will cause the HVAC systems to shut off. The HVAC system will resume automatically as soon as doors/windows are once again in the closed position. Double doors require the stationary door with middle trim to be latched first before latching the opposing door. Refrain from slamming or extreme pressure on the doors. Maintenance and damage fees will be charged if there is any evidence of door, window or sensor tampering.
Safety of Valuables. Keep all window and doors closed and locked when leaving the property. We are not responsible for any of your valuables left on the premises, however you are responsible for all of our valuables during your stay. Tampering with Housekeeping or Owner’s locks on chest, cabinets, closets, storage shed or 6’ ladder is prohibited and subject to fines.
Keeping Up With The Keys
Two keys will be provided during your stay. If locks, doors or entry are damaged during your stay, Renter will be responsible for locksmith, repair and door repair. Please contact Homeowner prior to contacting a locksmith. House keys are to be returned to the lockbox upon your departure. You will be charged for missing keys and costs to re-key locks.
Maintenance. You are on vacation! If you have questions or experience any difficulties including anything not in working order please contact the owners (Randy 615-766-2777 or Melody @ 630-234-4866) and we will make every attempt to answer your questions quickly or fix any issues ASAP! This is a smart home. Tampering with it can cause a host of problems you don’t want! Please do not unplug any electrical cords from outlets that are secured, used for WiFi, Alarm and Barrier Systems, appliances, audiovisual equipment or other Smart Home Devices. Please do not attempt to change light bulbs, tamper with internet/Wifi, cable, smoke detectors, safety alarms door sensors or thermostats.
Please Take Care
Please take care of this home in the same manner you would your own and leave it in the same general condition in which it was in when you arrived. In order to maintain our high standards for each and every renter, housekeeping will perform inspections as to the general cleanliness of the property and care taken within the use of its contents immediately upon your departure.
- Please be respectful of all furnishings and avoid: standing on furniture, sliding heavy sandy coolers across the wood floors, use of dyes, and other permanent staining and fabric or furniture damaging products.
- Rearranging furniture or removing any items from the Premises is prohibited.
- Please do not remove kitchenware from the premises and use care with glassware.
- Use appliances large and small for their intended purposes only and according to manufacturer recommendations.
- Removal of all house bath linens from the premises is prohibited.
- Towels and swimsuits are not to be hung over porch railings. Hooks are provided on the pool deck.
- Do not sit on furniture or white bed coverlets in wet swimsuits or with suntan oil on.
- Do not spray suntan oils inside the house.
- Clean all food and drink spills immediately. Be aware that food and drink spills on rugs and furnishings constitute damage to the property (and not normal wear and tear).
- Nail polish is ugly on expensive wool rugs, white bedding or marble floors rather than on nails. We recommend…Carillon’s Baliage Spa offers great manicures and pedicures!
- Sand is great at the beach! Not so much in the houseWe have provided a hot/cold shower outside the Carriage house so you can wash the sand off before entering the houses or hot tub/pool area.
- To prevent breakage and damage, moving furniture within or between the main house or Carriage house is not permitted.
- Do not flush sanitary products, used diapers, paper & q-tips, cotton balls, down the toilet. A plunger is provided in the kitchen pantry.
- Please keep front gate to house in the closed position.
- Do not lean, prop, chain or lock bicycles to the property, fences or fixtures
Anti-microbial Face Cleaning Cloths have been provided for your ease of make-up removal and protection of our Five Star bath linens. You may use these with your own face cleaning product or just rinse in warm to hot water and notice how the fibers grab make-up and dirt safely and naturally from your face with water alone. Rinse in warm water or soapy water and hang for a quick dry and reuse during your stay. These may be laundered, tumble dry on low heat, no fabric softener.
Beach Towels For your convenience, we have provided high quality Beach Towels for use during your stay. If you feel the need to wash these, please wash separately from clothing or any other white house linens, cold water, tumble dry, no fabric softener. If any bath or beach towels are missing you will be charged for their replacement.
Laundry This property boasts two washer/dryer sets for your convenience. We have even supplied an initial supply of laundry product for you. If you find the need to wash our white towels or linens please wash white towels separately (not with colored beach towels or clothing) in warm water with no bleach and tumble dry without fabric softener.
Chef Equipped Kitchen Use and Care. The owner of this home loves to cook and is providing you with a chef’s equipped gourmet kitchen featuring high end appliances large and small, cookware and utensils. Please enjoy and handle them with care, keep parts and attachments in their proper places and use according to manufacturer’s instructions. (Manuals are located in the kitchen drawer under floating shelves). We’ve provided inventory lists in the cabinets and drawers which will help you locate and return items to their proper places. Viking Stainless Steel cookware is provided as well as Barkeepers Friend for your use to remove any stubborn stains. Once stains are removed, cookware is dishwasher safe. Non-stick pan liners are provided for use with baking pans and make for fast and easy clean-up so you can get back to that book or the beach! In case of emergency, a fire extinguisher is located in each of the kitchens under the sinks.
We hope you love the beautiful White Quartz Counter Tops. Please remember…Citrus like limes and lemons, wine, juices, tomatoes and other acids will etch the finish. Boos Cutting Boards have been provided for cutting fruits and vegetables on in a healthy manner. Easy to clean bamboo cutting boards are also provided for meats/poultry etc. Please do not put hot pans or dishes on countertops or glass table tops (a large trivet is provided under the stove in the main kitchen).
You Don’t Have To Buy Ice Everyday! A stand alone ice maker is provided in the Carriage House kitchen. Please keep the scoop on top of the ice maker and not in the bin. The scoop can be very difficult to find in the bin when 75-100 lbs. of ice is constantly in production.
For the Grillmeister…We’ve provided a natural gas Weber Grill so you won’t have to worry about running out of propane! You will find“metal only” grill thongs and spatulas (drawer right of the dishwasher)for your convenience. Please do not use silicone coated utensils at the grill. Please keep grill covered when cool and not in use.
When using the BBQ, do not leave it unattended and after using please clean with the provided grill brush and empty grease trap pan.
Trash Talk…All trash must be bagged in plastic bags and placed in the trash cans in the corral beside the Carriage house. Pick up is Monday thru Saturday during the Summer season. No pick up on Sundays. All other off season times are Monday, Wednesday and Friday @ 7:00 a.m. If you need extra pick up you can call 850-234-7819.
Staying Safe…Candles are not permitted on the property. Sparklers or fireworks other than those you feel while kissing a lover are strictly prohibited on the property, in the Carillon complex or on the beach according to local ordinances.
Enjoying the Pool and Hot Tub…Please adhere to all “Livin’ The Dream” Pool/Hot Tub Rules and Policies and posted instructions for use. This property includes a hot tub and pool. This home has separate pool and hot tub heaters that may be used November through March. The temperature will be set by the owners upon the payment of an added fee option per day for each the pool and/or hot tub during your stay and is based on seasonal temperatures. Contact the homeowners for more information. Do not tamper with any pool equipment, including the heating equipment. The pool heaters may be ineffective once outdoor temperatures drop below 50 degrees. Pool heating must be requested in advance of your stay and paid for at least one (1) week prior to arrival. You and your occupants agree to comply with Livin’ The Dream Pool/Spa/Hot Tub operation instruction and use such pool/hot tub/spa at your own risk and agree through booking this property to accept and assume any and all risks of injury, death or property damage resulting from use of the hot tub or pool.
Pool Area Schedule for Lights and Filtration:
- String/Party Lights: Timer controlled “Dusk to 10:00 p.m.”
- Pool Lights: Timer controlled “Dusk to 11:00 p.m.”
- Pool Filtration/Waterfall: Timer controlled “8:00 a.m. – 11:00 p.m.”
Guests/Occupants Use The Pool and Hot Tub At Your Own Risk
- YOU AND EACH OTHER OCCUPANT USE THE POOL AT YOUR OWN RISK AND AGREEE TO ALL “LIVIN’ THE DREAM” POOL/HOT TUB RULES AND POLICIES.
- The owners of the property (William R. And Melody A. Dunn) do not assume any responsibility in the event of damage or bodily harm to you or any other occupant.
- At no time is there a lifeguard on duty, you (the renter and all occupants or guests) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay.
- You assume all responsibility for and charges incurred from misuse or negligence of the pool/hot tub/spa equipment, the pool/hot tub/spa itself, pool furniture and any pool accessories on the Premises that occur during your stay.
- You are to comply with posted instructions for use of pool/spa/hot tub control buttons and agree not to allow children to use these control buttons.
- Neither you nor any other occupant should disable, disarm or otherwise remove or compromise any pool safety feature, including any barrier or exit alarm.
- All doors leading to the pool area should be kept locked at all times. Use the child proof latches provided on exterior doors leading to the pool area when children are present.
- You should notify us immediately if any pool safety feature is not working properly during your stay.
- Only you and other occupants are permitted in the pool or pool area.
- All policies applying to the Premises include the pool/hot tub/spa and pool area, as well.
- The maximum number of people in the pool or pool area should not exceed the number of the reservation party and never exceed the 16 person maximum capacity of the Premises at any time.
- Children under the age of ten (10) regardless of swimming ability should be supervised at all times by an adult when in or near the pool or pool area.
- No diving or jumping from edges or off the water fall is allowed. Always enter the pool feet first.
- No glass containers are permitted in the pool or pool area. You may be charged an additional cleaning fee if broken glass is found in and/or around the hot tub and pool area.
- Impaired individuals should not enter the pool or pool area.
- No riding equipment of any kind including bicycles, skateboards, skates, roller blades or scooters, is permitted in the pool or pool area.
- Only single-person flotation devices are permitted in the pool except for devices used to aid individuals with a handicap.
- Do not leave floatable or other objects in the pool when not present in the water. These may block the pool filtration systems and cause system malfunction.
- Rough-housing is not permitted in the pool or pool area. Running, pushing and dunking are prohibited.
- No animals or pets are permitted in the pool or pool area.
- Acceptable swimming apparel must be worn in the pool/hot tub. All children not toilet trained must use swim diapers.
- Please shower before entering the pool to keep oils, sand and chemicals from building up in the equipment. A hot/cold outdoor shower is provided.
- Pool hours are from 7:00 a.m. until 10:00 p.m.
- The hot tub is not suitable for pregnant women, children under 12 years of age, (especially those under the age of 5) intoxicated persons or persons with certain heart or health conditions. Maximum temperatures for children should not exceed 98 degrees.
Spa Use and Spa Control Buttons
Fees for spa/hot tub heating must be paid in advance or contact “Randy” @ 615-766-2777 to initiate fees for heating upon request. Spa tub jets without heat may be used.
Wall mounted control pad must be managed by adults only.
Buttons #1, #2 and #3 control sequential events and therefore longer reaction times. Pushing buttons repeatedly will cause system failure. Button #4 is inactive.
#1: “Pool Lights Button” operates pool/hot tub lights on and off
#2: “Spa Button” operates spa jets (and heating if prepaid)
- Waterfall will cease and water in spa will begin to level (1-2 minutes) before spa jets or heating will begin. (Heating takes approx. 10-15 minutes)
- Spa runtime is 30 minutes. More than two consecutive runtimes may cause overheating and system failure
- While spa jets are running, push the spa button at anytime to stop jets and/or heating. If the spa/hot tub is at high temperature, the jets will continue to run for 3-4 minutes while the unit cools down. If for any reason the hot tub jets/heat do not cease after a 10 minute cooling period, please contact the homeowners immediately
- Once spa jets have stopped, it will take 1-2 minutes for the spa to re-level and waterfall/filtration to begin again
#3: “High Speed Button” operates the total filtration pump. DO NOT PRESS
- Pool/SPA HEAT: Pools and overflowing SPA/Hot Tubs that are equipped with heaters are not guaranteed to sustain any constant temperature. Please note that pool temperatures vary due to certain circumstances, including but not limited to: wind, rain, low temperatures, storms, sand, fungus or algae caused by extreme temperatures, excessive use or contamination by Guests. There shall be no compensation for any loss of use. Any damage to the pool and/or spa caused by Guest and any other persons on Property during the agreed upon Rental Period, including but not limited to: broken glass or other items introduced into the pool, contamination of the water, damage to the automatic cleaners or equipment, or excessive loss of water will result in charges to the Guest for correction of the problem.
- SPA Shut Off (Button #2) When and if the spa is used, Guests must comply with “Livin’ The Dream” Pool/Hot Tub Rules and Policies, comply with posted instructions for use, and agree adults only will be responsible for turning on and shutting off the SPA/Pool Controls. Failure to shut off the Hot Tub/Spa after use or running multiple “run times” may result in damage to the unit and an excessive utility bill, which will result in repair and utility fees charged to the Renter.
Private-In-Season Daily Beach Service is provided during your stay (2 sets of “Livin’ The Dream” wooden loungers w/umbrellas directly on the beach). Additional loungers are available for rent from Ed’s Beach Services through Kyle @ 850-628-0344 or email eddbaebs@aol.com.
Enjoy Beach…Follow the Rules Tents are NOT allowed on the beach. Shade canopy pop-ups are allowed but are limited to. 10’ x 10’ in size. Side panels are not allowed. Carillon’s Good Neighbor Policy. We want you to have fun…however, “Carillon” quiet hours are from 10 p.m. to 7 a.m., during which time you shall not unreasonably disturb adjacent neighbors. Amplified sound that is audible beyond the property boundaries is prohibited. Carillon Security patrols the complex 24/7. Illegal Activity… Use of this property or its contents for any criminal activity is prohibited and may result in fines or prosecution including the use of internet service for any unlawful downloads of copyrighted material, movies, music, software or other material.
Upon Departure:
- Please leave bath linens hanging in the bathrooms on hooks
- Please put all used beach towels in laundry basket
- Leave bed linens on beds unmade
- Please do not leave any food or beverages in refrigerator or in the house or porches
- Take all garbage to trash corral
- Put dirty dishes in dishwasher
- Clean and return to proper place any small kitchen appliances you have used with attachments
- Return any furnishings, decorations, amenities, appliances, kitchenware etc. to their original places for inventory assessment
- Sign off any Apple TV/Netflix or streaming accounts for the TV’s
- Turn off all lights/TVs
- Make sure all windows and doors are securely latched and locked
- Turn off night light in main house powder bath
- Turn off ceiling fans inside house and on porches
- Turn off exterior lights
- Turn off ice maker in Carriage House (On/Off Switch on bottom)
- Put 2 keys in Key Lock Box
- Close front gate

Damage Protection Waiver Terms and Conditions
The damage protection insurance does not substitute for your responsibility to leave the Premises in appropriate condition with all contents intact. It is a non-refundable, one-time charge per reservation that covers accidental damage that you report prior to Check-Out and is subject to your strict compliance with the terms of this Agreement. In exchange for the damage protection insurance and the execution of this Agreement, we waive the right to charge you for damages or loss to the Premises that are reported before your departure and are a result from your accidental or inadvertent acts or omissions during the duration of your stay for damages up to but not exceeding $3,000 (the “Damage Limit Amount”)
You are responsible for any damages or losses in excess of the Damage Limit Amount as well as any damages or losses excluded per the terms herein, and any such damages or losses will be charged to your credit card or checking account on file.
The damage waiver fee does not cover damages or losses during your stay related to the foregoing:
- Intentional acts or omission, abuse or neglect by you or any other occupant.
- Negligence or gross negligence. This includes any damages to the Premises caused by acts or omissions that could have been foreseen by a reasonable person including loss of property contents, damages resulting in any additional cleaning and/or maintenance costs.
- Any damage which you do not report to us immediately prior to Check-Out.
- Theft of any items or theft of items that results from your failure to lock or secure the Premises or property, including items such as bikes.
- Damages, including additional cleaning costs or additional maintenance costs caused by an animal allowed on or in the Premises by you or any other occupant, including any service animal.
- Damage to a golf cart provided with the Premises.
- Loss or damage in excess of the Damage Limit Amount.
- Loss or damage to any of your personal property or that of any other occupant.
- The owner of the Premises remains responsible for (a) damages that constitute normal wear and tear; (b) damages resulting from acts of God, including but not limited to acts resulting in fire, flood or other natural disasters; (c) damages or losses to the Premises which are unrelated to your actions or those of any other occupant; and (d) theft that occurs despite your reasonable efforts to secure the Premises and related items.
- When you provide immediate notice to us prior to Check-Out of accidental or inadvertent damage to the Premises, we will investigate the damage to determine whether the damage appears to have been caused by accidental or inadvertent actions and to determine the nature and extent of the damages and the necessity for and costs of the repairs or replacements. Such determination will be made in our sole and absolute discretion.
