SHORT TERM RENTAL AGREEMENT
This Short-Term Rental Agreement (the “Agreement”) is made by and between Matt and Dusty Thomas (“Homeowners”) and the “Guest” as indicated on web sites reservation confirmation E-mail as of the dates set forth on that E-mail or as listed below. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
Property: The property is located at 6213 Thomas Drive unit 408, Panama City Beach, FL 32408
The property is fully furnished and includes customary appliances, utensils, linens and towels.
Travel Insurance provided by TRAVEL GUARD:
Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.866.478.8222 or www.travelguard.com/astp). Please refer to product number 008573/008574 P1 & account # 97908.

Rental Party: The rental party shall consist of the persons stipulated in the reservation confirmation E-mail or as listed below. You must be at least 25 Years of age and be present for the entire stay to faithfully execute this agreement. No additional persons may remain in the unit overnight without owner’s permission. Pets are not allowed.
Maximum Occupancy: The maximum number of guests is limited to 6, including adults and children.
Term of the Lease: The lease begins at 4 PM on the “Check-in Date” (or earlier if access is granted for early check-in time) and ends at 10 AM on the “Checkout Date” listed on the reservation confirmation e-mail, or earlier. The unit may not be sublet.
Rental Rules: Guest agrees to abide by this agreement and the Rental Rules, as attached in Welcome Packet, at all times while at the property and shall cause all members of the rental party and anyone else the Guest permits on the property to abide by these rules at all times while at the property. You agree and fully understand that in the event that you or anyone in your party is evicted for breaking Mariner West Property Rules and Regulations or Florida Statutes or the stipulations of this rental agreement, that you automatically forfeit your entire security deposit as well as the nightly costs associated with your nonuse of the unit due to your eviction.
***COVID-19 UPDATE*** The Homeowners and the Mariner West Home Owner's Association Inc., are NOT responsible for any exposure or infection of novel coronavirus, COVID-19, that may result in personal injury, illness, permanent disability, and death. By agreeing to these Terms and Conditions the GUEST ASSUMES ALL OF THE RISKS and accepts sole responsibility for any injury to registered guests, child(ren), and others allowed in the unit from illness, damage, loss, claim, liability, or expense, of any kind, that may be experience or incur in connection with occupation of Mariner West, Unit 408 and/or other Mariner West facilities. Agreeing to these Terms and Conditions, the guest hereby releases, covenant not to sue, discharge, and hold harmless the Homeowners, employees, agents, representatives, and the Mariner West staff from all Claims of liabilities, actions, damages, costs or expenses, and other claims of any kind arising out of or relating thereto. Guests understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Mariner West, Unit 408 Homeowners, employees, agents, representatives, and Mariner West staff whether a COVID-19 infection occurs before, during, or after the terms of this lease.
Access: Guest shall allow Homeowner and his agents’ access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
Costs: Rental rates, fees, add-ons, and deposits are as published on our websites.
Payments: A deposit of 30% of charges (rent, cleaning, tax, security deposit) is due no later than 90 days before arrival (unless other arrangements have been made). The remainder is due no later than 30 days prior to stay. Reservations will not be held if funds are overdue.
A $200 security deposit is required and applied during booking. The security deposit will be fully refunded unless the following conditions occur:
Theft or Intentional damage to the property or furnishings;
Guest does not comply with unit signage concerning condition to leave unit in.
Guest exceeds maximum capacity of six (6 adults), has pets, or smokes in unit and/or balcony area.
Failure to depart unit at scheduled check out time
Dirt or other mess requiring excessive cleaning; or
Any other unusual cost incurred by Homeowner due to Guest’s stay.
Cancellation Policy: If Guest wishes to cancel his/her reservation, deposits will be refunded as follows:
100% if cancelled 30 days prior to the Check-in Date on weekly rentals
Deposits on rentals are non-refundable after 30 days prior to check in
If you booked through a website, that site's refund policy takes precedence.
Insurance: We encourage all renters to purchase traveler insurance.
Payment: Preferred payment method is credit card using the secure servers on our web sites.
Front Desk "Amenity/Registration Fee": Guests must check into the front desk, at your first opportunity, to obtain parking pass and armbands. The front desk will charge guests an additional $20.00 amenity fee ($20.70 if paying by credit card). This fee IS NOT a part of any rental fee costs charged by the owner and it cannot be added to your total. This is a separate charge assed by Mariner West Homeowners Association, Inc.
The parties agree to the terms of this Short-Term Rental Agreement, as evidenced by their participation in the booking process provided through our websites or in writing with a signature below.

Smoking is NOT allowed anywhere in Mariner West Unit 408 to include the balcony. There will be a full forfeiture of the security deposit if evidence of smoking is found/detected in the unit.
People other than those in the Guest party set forth in the reservation confirmation e-mail may not stay overnight in the property. Any other person on the property at the invitation of the guest is the sole responsibility of the guest. Unit may not be sublet.
All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
Keep the property and all furnishings in good order.
Only use appliances for their intended uses.
Pets are NOT allowed.
Parking passes and Armbands: Parking pass and Armbands are available at the Mariner West Office. YOU MUST have a parking pass and armbands on the premises.
Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit bath towels or linens to be taken from the units.
Water and Septic: The septic system is very effective; however, it will clog up if improper material such as rice or grease is poured down drains. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time.
Storms: If there is a storm or hurricane, no refunds will be given unless the state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest.
The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
- Any unused portion of rent from a guest currently registered;
- Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, or arrive after the Tropical Storm/Hurricane Warning is lifted; and
- Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Warning" period.
Evidence of drug use and/or underage use of alcohol is grounds for immediate eviction. Names of responsible adults will be forwarded to police authorities for legal action.
