OWNERSHIP AND MANAGEMENT: This condominium (“property” or “condo”) is owned by Mike and Rice Hill, hereinafter referred to as “we”, “us”, “our”, “owner” or other similar terms. We reserve the right to refuse rental or to discontinue your occupancy without refund of rent or deposits if, in our sole and absolute judgment, your occupancy is detrimental to the property or you are in violation of the terms and conditions contained herein. Property may not be used for any unlawful purpose. We reserve the right to enter the premises at any time, without notice, for the purpose of inspection, repair, management duties or showing to a prospective buyer (this includes any representative we may appoint on our behalf).


HOLD HARMLESS: By renting this property you, the party signing this document, are assuming all risk of and liability for any damage done to person or property, agents, employees or visitors occasioned by the present or future condition of the premises both latent and manifest. We are not responsible or liable for accidents or injury to any guests or loss of money or valuables of any kind. By signing below, you are agreeing to hold harmless and make no claim against Mike or Rice Hill, whatsoever for or on account of any loss of life, personal injury, or damage to or loss of personal property.

WHAT WE PROVIDE: We provide bed linens, bath towels (bath towels may not be used at the pool or beach. Bring your own beach towels!) and a start up supply of dishwashing soaps, trash bags, paper products and bath soap. Kitchens have silverware, dishes, pots & pans, small appliances including toasters, blenders and coffee makers (without filters). WHAT RENTERS MUST PROVIDE: Please bring beach towels, sunscreen, and beach chairs unless you are renting from the beach service provider. Please note that canopies and tents are not allowed within 50 feet of the water at Gulf Shores and Orange Beach in all cases must be placed behind the beach chairs provided by the beach service. PLEASE MAKE SURE YOU READ AND UNDERSTAND THE "ONLY FOOTPRINTS" POLICY OF GULF SHORES AND ORANGE BEACH. It can be found on their website www.orangebeach.com. Owners/Managers are not responsible for any items left at the beach after sunset and taken by the city.


RENTAL TERMS AND CONDITIONS – PLEASE READ CAREFULLY

LENGTH OF RENTAL: We have a 3-night minimum stay. During peak summer season, we may choose to rent only Saturday to Saturday (7 nights). Should you desire to increase your length of stay once you have checked in, we will make every reasonable effort to accommodate your request.


FORMS OF PAYMENT: The quote that you receive will include a MANDATORY $49 fee for damage insurance. It is not an additional fee added on later. That will automatically come out of your initial payment and be directly paid to the insurance company and will reflect that way on your CC statement. Owner does not receive any funds from this insurance fee but we do require it be purchased for our protection.


INITIAL RESERVATION PAYMENT: The Initial Reservation Payment will be approximately 50% of total payment and is payable at the time of reservation. This amount will reserve your reservation.
• The Initial Reservation Payment is a portion of your rent and will be applied to your total rental; therefore, it will NOT be refunded following your departure.
• Payment in full is required 30 days prior to check-in.
• Reservations made within 30 days of check-in require full payment at the time of reservation.

TAXES AND FEES: Cleaning fee of $140.00 and will be added to your rental total. Lodging tax is 13% for Gulf Shores & Orange Beach, HomeAway / VRBO Fees as disclosed on quote provided.


FINAL PAYMENT: Final Payment (balance due after Initial Reservation Payment has been paid) is required 30 days prior to arrival. Any reservations made within 30 days of arrival will require payment in full. At the time of your reservation, your payments will be scheduled to pay the reservation down payment as well as the balance. You will receive an email on the date that the final balance is due with the link to make the payment.


CONFIRMATION: A confirmation listing arrival and departure dates, and property will be emailed to you upon acceptance of your reservation request and receipt of your Initial Reservation Payment. Please contact us immediately by phone (334-654-4157) or email us (hill.pelican.pointe.305@gmail.com) if any corrections are necessary; otherwise, it will be assumed correct.


CANCELLATIONS & CHANGES: It is never fun to have to change your plans but if you have to.
All cancellations are subject to the following:
•60-day notice is required for a full refund of your reservation payment
•31-day notice prior to arrival date, a refund of 50% of your reservation payment will be refunded.
•Within 30-day of your arrival date, no refund will be issued.
•If after a cancellation request owner fills the dates being cancelled to another guest, a full refund may be issued.
•The only exception is that of a MANDATORY hurricane evacuation. If this happens, any unused days will be refunded.
•NO REFUNDS are issued for cancellations or early departure due to inclement weather or personal circumstances inside the cancellation date range. Guestspurchasing travel insurance should consult their insurance provider directly to see if they qualify for a refund.
•Please Note: Reservations are subject to change or cancellation up to 45 day of arrival date in the event the unit becomes unavailable or is sold. A full refund will be provided if these circumstances arise.


TRAVEL INSURANCE: Travel insurance is the sole responsibility of the guest and has no affiliation with the owner or management.


RENTAL OCCUPANCY: The maximum number of occupants, including children, is 6, at times we may allow up to 8. We reserve the right to require lower occupancy at any time and for any reason. VIOLATIONS OF RENTAL OCCUPANCY RESTRICTIONS ARE GROUNDS FOR IMMEDIATE EVICTION AND FORFEITURE OF RENT. An atmosphere conducive to quiet enjoyment of those in surrounding units and properties must be maintained at all times. All rules and regulations of Pelican Pointe and Orange Beach must be strictly observed, see EXHIBIT A.

MINIMUM RENTAL AGE OF 25: By renting this unit, you certify that you are above the age of 25 and will be present during the stay. Persons above the age of 25 may not rent on behalf of persons under the age of 25. A driver's license of the signing party will be requested upon reservation. Violation of this rule will result in IMMEDIATE EVICTION AND LOCKOUT WITHOUT REFUND. HOUSE PARTIES ARE NOT ALLOWED.


PARKING: Parking passes 30.00 each, maximum of 2 payable upon arrival to on site guard, normally on site on 3-11 shift, Or payable at site managers office located inside the indoor pool facility..


PETS: NO PETS ARE ALLOWED. A pet, or any evidence of a pet found on the premises, is cause for eviction and forfeiture of rent and security deposit. Additional cleaning fees of $500 will be charged if evidence of a pet is found after your departure.


GRILLS: It is a violation of local fire codes to grill on a deck. Don't do it! You will be immediately evicted without refund.


MAINTENANCE: It is important to us that the properties be maintained in good repair. Maintenance providers may access the property for purposes of repairing previously reported issues, or for other routine items. We strive to be as unobtrusive as possible while performing these tasks and appreciate your patience—it is important to you and to us that the property be well maintained.
Please let us know as soon as possible if a maintenance issue arises. Just as might occur at you own well-maintained home, mechanical failures and other breakdowns could occur. Please TEXT or call us at 334-654-4157 or 334-654-3713 – we will make every effort to correct the situation as quickly as possible.


NO REFUNDS or rate adjustments will be made for mechanical failures and malfunctioning equipment. Working condition of pools, air conditioners, cable, phones,internet service, TVs, VCRs, DVDs, appliances, elevators, etc. are NOT guaranteed. These amenities are extras provided in addition to the condo rental. We will make every effort to correct the situation during your stay.


DAMAGE: Please report any damage or breakage when it occurs so we can fix or replace items as soon as possible.
Some things break or need repair or replacement due to normal wear and tear or factors out of your or our control. Please let us know about those items so we can take care of them. We want to keep things in good condition.
We understand accidents happen. We ask that you let us know about them. Unreported new damages found upon your departure will be billed and full payment for repairs will be deducted from the security deposit or charged to the credit card on file.


Missing items are considered damage. All furnishings, fixtures, appliances, linens, decorations, pillows are the property of the owner. Missing or damaged linens and towels will be charged back to your credit card. Removing makeup with towels, washcloths, etc. may cause stains that cannot be removed, and you WILL be charged for these damages. Blood or other stains on the sheets and mattresses are also considered irreparable damage that will result in cashing the security deposit check or a charge to the credit card on file. We do not have extra pillowcases that match our sheet sets if one is taken—we have to purchase a new set. The following charges will apply: $100 King sheet sets, $75 Queen sheet sets, $50 Full sheet sets, $25 Bath Towel, $10 Hand Towel, $5 Washcloths/Kitchen Towels. Please do not leave your old bed pillow and take ours—that still counts as a missing item. Pillows are $25. Damage to any other items will be charged according to the cost of replacing the item damaged, plus a $50 service charge. By signing below, you agree to allow any charges for missing or damaged item to be taken up with the insurance company.
CHECK-IN: Within 1 week of your arrival, we will provide instructions for access for check-in.
Check-in begins at 4:00 p.m. CST.
We make every effort for the property to be ready for your arrival at that time; however, much of that depends on the courtesy of our guests and the condition in whichthe property is left. Our housekeeping standards may require extra cleaning time which may delay check-in. We ask for your patience in the unfortunate event this happens on your check-in date. And we ask for your help in ensuring it does not happen to the guests who arrive after you!
CHECK-OUT: Check-out time is 10:00 a.m. Central Time. An additional fee of $100 per hour (or fraction thereof) will be assessed if the property is not completely vacated by the check-out time. We are sorry to have to do this, but the next guests will still want to check-in at their check-in time!


SMOKING: NO SMOKING IS ALLOWED ON THE PROPERTY, WHETHER INSIDE THE CONDO, BALCONY, OR OUTSIDE LOCATIONS. Evidence of smoking on the property will result in a charge of $500 plus any additional damages caused by smoke or burns. IN ADDITION, YOU WILL BE IMMEDIATELY EVICTED AND LOCKED OUT WITHOUT REFUND.


DEPARTURE RESPONSIBILITIES: Please leave the property clean and orderly. (Additional cleaning charges will apply if it is not). Please treat this condo as you would like us to treat your home. All furniture, decorative items, bedding, dishes, etc should be where it was upon your arrival. Please do not remove anything from the condo.
• Leave kitchen items (dishes, cookware, etc.) cleaned and returned to their proper place.
• Dispose of all trash in proper outside containers.
• Lock all windows and doors.
• Please strip all beds, (leave mattress pads) and put all dirty laundry, with towels and wash clothes, in the bath tubs.


We have made every effort to ensure that all information printed here is accurate, but cannot be held responsible for errors in printing or changes made in furnishingsand appliances. The appearance and amenities of some properties may have changed from the photographs as we consistently update properties. Until confirmed, prices are subject to change and special rates may differ. Any exception to the above-mentioned policies much be approved in writing and in advance.


WAIVER OF LIABILITY: Pools, balconies and stairs present an inherent danger. You are accepting full responsibility for the safety of renting parties and all guests; and agreeing to supervise children to ensure their safety. CHILDREN MUST BE SUPERVISED ALL THE TIMES WHILE ON THE PREMISIS. Persons using pools, hot tubs, tennis courts and other amenities agree that for and in consideration of the use of the amenity, to hold harmless and make no claim against Mike or Rice Hill for or on account of any loss of life, personal injury, or damage to or loss of personal property. This hold harmless applies to the grounds, common areas, and private property within the unit itself as stated in paragraph 2 page 1.
Owners and/or Management assume no responsibility for any accident, injury, or loss that may occur during your stay.
Pelican Pointe: Pelican Pointe provides pool chairs for your enjoyment during your stay. Please do not take the pool lounge chairs to the beach. Please do not remove any items from the condo. Beach service (chairs and umbrellas) are available during certain times and must be arranged directly with the vendor.

NOTE: It is the renter’s responsibility to report any defects with the unit within 12 hours of their stay. Any damage detected upon inspection after the departure that is not reported will be assumed to be caused by that guest and therefore billed accordingly
By accepting the booking you acknowledge that you have read, understand, and agree to comply with all the terms and conditions herein this document. In addition we require the information below to be returned to us as soon as possible after booking.

We request a text or email of occupantes names and ages prior to your arrival. It is sad but we have experienced excessive occurpants staying overnight and are required to provide this information to onsite guards if any trouble arises.

Pelican Pointe Rules
Rule #1is for you to have a GREAT time here at Pelican Pointe enjoying the amenities of the condo and the wonderful beach and gulf just outside your condo. To help ensure that everyone has a great time, here are some common-sense rules that we need your support in following:
PARKING
• All Guests are required to have a Pelican Pointe parking pass upon entering the property. Only two (2) passes will be issued per unit.
• All owners and guests must have a parking pass visibly displayed through the front windshield.
• Vehicles without valid parking passes displayed will be towed.
• Vehicles parked in emergency lanes, in front of fire-hydrants, or the garbage truck lanes will be towed.
• No trailers, boats, jet skis, or RV's are allowed on the premises.
POOLS -HOT TUB- EXERCISE ROOM
• Pool hours are 8:00 AM until 10:00 PM
• All children in pool areas under the age of 13 must be accompanied by an adult.
• No diving in either pool.
• No running or horseplay in pool areas.
• No. rafts, floats, balls, or water toys are allowed in either pool.
• No glass containers or food allowed around either pool area.
• No beverages or food allowed ·in either pool.
• No radios on the pool decks areas except those with earphones which must be used.
• No objects thrown into the pool or pool areas.
• Deck chairs and lounges may NOT be reserved by a towel or other item.
• Items left overnight around pool areas will be discarded.
• Children under the age of 13 are NOT allowed in the hot tub or in the exercise room unless accompanied by adult.
BUILDING USE AND ACCESS
• Quiet time will be observed from 10:00 PM until 8:00 AM.
• No loud music anywhere in the condo complex.
• Luggage carts I buggies are NOT allowed in a unit. Please return them to the lobby area after use.
• Do not fly kites, feed birds, or release objects from balconies.
• Do not hang towels, swimsuits, or other items from the balcony railings. .
• Do not leave items in and around the trash chute areas.
• Do not discard cigarette butts, gum, candy wrappers, paper, or beverage containers in stairwells.
• Do not leave items in main hall walkways.
• Skateboards, scooters, and roller-blades are not allowed on the premises.
• No running or horseplay in building corridors, stairwells, or in elevators.
• No fireworks are allowed.
• Canopies or tents are not allowed on the beach.
No Smoking on Pelican Pointe Property is allowed, this includes parking lots, swimming pool, elevators, hallways, corridors, balconies, or condo units. Violators will be evicted
