KASTNERS BEACH HOUSES SHORT TERM RENTAL AGREEMENT
Kastners Beach Houses Vacation Rentals Terms and Conditions: This contract constitutes an agreement between the Guest, as listed on online lease and Kastners Beach House Vacation Rentals (KBHVR) as agent of OWNER to rent the premises located at 9600 Shore Drive, Myrtle Beach SC Unit A303. The restrictions, conditions and limitations described below are included as part of this agreement.
Check in is 3pm on SATURDAY Check out is 10am on SATURDAY unless otherwise arranged. (If you are renting on a monthly basis, check in will be 3 pm on the day specified and checkout will be 10 am on the last day of the month)

THE PARTIES HERETO, IN CONSIDERATION OF THESE PRESENTS, AGREE:
PAYMENTS: Guest is responsible for full payment for the rental period. A non refundable deposit of 200.00 is due immediately along with this signed agreement to hold the requested rental dates and to consider the rental confirmed. The balance is due thirty days before check-in.
Rent: Guest agrees to pay total rent of (specifics listed on payment request).
CANCELLATION POLICY: All cancellations by a Guest must be made in writing and received and acknowledged by KBHVR on behalf of the Property Owner. If the Guest wishes to cancel the Rental Agreement after it has been signed by a Guest and returned to KBHVR there is a cancellation consequence of forfeiture of 200.00 reservation deposit for weekly rentals. If the rental is monthly, one half of the rental amount will be retained as a consequence. This is to recoup income lost due to the rental unit being off the market for rent. If further payment has been made, the balance less the 200.00 (or half rental amount for monthly rentals) will be refunded up to thirty days prior to check-in. Any cancellations within thirty days of check in will incur loss of full payment. In very few circumstances, at owner/agent discretion, monies will be returned IF the property can be re rented for the contracted period of time.
There will be no refunds for shortened stays of cancellations due to family emergencies, work obligations, ruined expectations because of weather, power outages or other unexpected conditions which are beyond our control.

Updated COVID Cancellation Policy: AS of March 31,2021, COVID-19 is a foreseeable event and therefore, limitations are applicable for cancellation. If the state of South Carolina goes into a mandatory shutdown monies will be either be credited back to you for a future stay or refunded at owners discretion! Otherwise, the guest assumes all financial responsibility of the reservation and cancellations and cancellations will be subject to the normal cancellation policy. If you are concerned about this, please purchase cancellation insurance that is offered to you for a nominal fee at time of booking the reservation.


INSPECTION OF PROPERTY: If Guest does not personally inspect the premises prior to signing this Agreement, Guest agrees to accept the rental property, as is, upon arrival. In addition, Guest agrees that Guest will not be entitled to a refund of rental money and will have no claim or recourse against the owners or agents of the property. No refunds are given due to unmet expectations such as, but not limited to, changes in décor, furniture or amenities, inconveniences such as power outages, inoperable equipment, adverse road and /or weather conditions, acts of God and use of cleaning chemicals (although we use a few chemicals as possible) poor lighting, the presence of insects, neighborhood construction, neighborhood or road noise, or allergic reactions. These will not be reason for reduction of the rent and fees paid under this agreement or for damages to the guest. The guest agrees that if for any reason, they decide not to rent this home as agreed, including the fact that they might not have had the opportunity to visually inspect the property, they may forfeit their total payment.
SECURITY DEPOSIT: A 200.00 security deposit may be collected with your rental. This will be promptly returned after the unit has been cleaned and inspected for damage beyond normal wear and tear. The 200.00 deposit does not limit your financial responsibilities if damages exceed 200.00. If damages occur, we will bill you for amount of replacement/repair. Failure to reimburse KBHVR for damages will result in legal litigation.
ENTRY OF PREMISES: Homeowner or Homeowner’s agent may enter the premises immediately, in the event of an emergency, in order to perform necessary repairs or maintenance, and within 24 hours of notice for normal maintenance. Equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Owner will correct the problems as soon as possible. An authorized employee or repairman may enter the premises to repair such equipment.(Notice will be given to tenants before this occurs.) Refunds will not be issued due to malfunctioning equipment including, but not limited to, Internet access.
OCCUPANCY: The total occupancy of the property cannot exceed 6 persons, adults and children.
VEHICLES: There is parking for 2 cars. You will be issued or instructed where to locate parking pass(es). These passes MUST be displayed in your front vehicle window to avoid towing by our HOA. If your vehicle is towed, it is your responsibility physically and financially to retrieve your vehicle.
DAMAGES: The Guest will be responsible for all damage or breakage and/or loss to the premises, except normal wear and tear which may result from occupancy. The Homeowner or Homeowner's representative will define normal wear and tear. The entire building and all grounds will be left in the same good and habitable condition in which it was found upon arrival. Any damages or unusual conditions found upon arrival will be reported to the owner/property manager or KBHVR within one (1) hour of occupancy or, if arrival after 6:00 p.m., before 9:00 a.m. the following morning.
LINENS AND TOWELS: Sheets, towels, pillows and blankets are provided are NOT to be taken outside or off the premises.
PERSONAL PROPERTY: Guest understands that any personal property of and used by Guest is not insured by Owner and Owner and/or KBHVR shall not be responsible for any lost, stolen or missing property of the Guest or property of Guest left after check out.
PET CLAUSE: We love our pets too! However, NO pets are allowed under this lease agreement per our HOA rules.
MINIMUM AGE: Per our HOA regulations, you must be 25 years of age to rent our condo. A person aged 25 or older must be on premises during the stay as well.
OFF-LIMIT AREAS: There may be certain areas of the property that are not accessible to guests either for the privacy of the owner or safety of the guests (ie. owner’s closet, basement, garage).
SECURITY SYSTEM: Owner reserves the right to operate a security system which may include a camera or cameras focused outside on the exterior of the property. This is for the protection of owner and guest personal property and safety. If a security camera is used, it will be aimed at the exterior door of the premises only and will not capture any guest activity within the unit. You are not permitted to tamper with, cover, unplug or otherwise hamper the operation of security system. If you do so, you will forfeit your security deposit and also be responsible for the service call from our repairman that will be required to restore operation.
LAWS: All guests are expected to adhere to all state, county, and city ordinances/laws as well as the HOA rules while using the property. If you are evicted from the premises by law enforcement, owners, HOA representative or any other agent appointed and acting on behalf of the owners, you will forfeit any remaining time and funds remaining on this contract, including your security deposit.
SMOKING POLICY - NO SMOKING! This property has been smoke free and the Homeowner’s require that it remains as such. Smoking is prohibited inside the unit and any evidence of smoking inside the unit shall forfeit security and the renter shall be charged for the cleaning of the entire property in order to restore it back to its original smoke free condition.(250.00 additional dollars) This charge may exceed the security deposit in escrow. Any smoking outside must be done so the smoke does not enter the house and cigarette butts are to be disposed of properly.
GRILL AND FIREPIT: Grilling is not permitted in the unit or on the porches/balconies. There are grilling areas located in the pool area for outdoor bar-b-quing.
TRASH REMOVAL:. Garbage is to be secured in plastic bags. No garbage is to be left in the condo when the Guest departs at the end of the rental period. Please empty your trash daily in the dumpster provided on the property!
CHECK IN/ CHECK OUT: Check in time is 3pm. Check out time is 10am. We want you to soak up as much sunshine as possible, however, these times are in place to allow our cleaning crews ample time to prepare our home for you and the following guest!
SUBLETTING: Guest agrees that this rental Agreement will not be assigned to any other party or the property sublet to any other individual other than the renter noted on this document.
BUGS AND PESTS: The location along the South Carolina Coast is beautiful! However, the hot damp sea air does occasionally attract bugs of various types.....Our HOA does take active steps in keeping these critters at a minimum, however, you may see an occasional insect. Guests acknowledge that in a beach area there will be bugs - different kinds of bugs at different seasons. This is mostly limited to an occasional Palmetto Bug (roach) but for the most part no bugs are generally seen! In order to prevent problems, our HOA has contracted for monthly in unit pest control. If the monthly service falls on a day that you are visiting, please allow pest control to enter the premises. This spray is harmless to humans and treatment takes only a few minutes and is necessary to prevent a potential infestation of our homes. Failure to allow access of pest control will result in a charge of 50.00 deducted from your security deposit. This is very important to our HOA community and is treated as such!

FAILURE OF NON-ESSENTIAL ITEMS: There will be no refund of any kind due to failure of non-essential items. Equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Owner or owner’s representative will correct the problems as soon as humanly possible. An authorized employee or repairman may enter the premises to repair such equipment. Refunds will not be issued due to malfunctioning equipment including internet.
FAILURE OF ESSENTIAL ITEMS: In the unlikely event of unforeseen situation at the condo in advance of the stay, the owners have a right to cancel contract and will, of course, refund rent and security deposit paid in it’s entirety . KBHVR will make attempts to arrange for alternate accommodations elsewhere if possible. However, owners/agent will not be held liable for any other losses or expenses.
HURRICANE/TROPICAL STORMS/INCLEMENT WEATHER The Guest agrees to hold the Homeowner and KBHVR harmless on account of any natural disaster affecting the leasehold premises. If a catastrophe (hurricane, tornado, earthquake, snowstorm, flood, etc.) impairs the rental, the Homeowner and/or WAMVR is not responsible for any of the following:
a. Finding alternate lodging for the Guest.
b. Guest's financial losses related to transportation or alternate lodging

If Guests are required by local authorities to evacuate the area, the Homeowner will refund a pro-rated portion of the unused rent paid by the Guest for the rental. There are no refunds of any kind for any inclement weather (ie. stormy, rainy, snowy, cloudy, windy, etc) unless there is an evacuation order.
CHILDPROOFING: The property has not been childproofed in any way, parents must be completely responsible for the safety of their children at all times.
ASSUMPTION OF RISK: Any swimming, or other activity (including, but not limited to kayaking, canoeing or other boating) anywhere on the property or in the water is solely at the risk of the Guest and invitees of guest and will hold the Homeowner or KBHVR harmless for any injury or death that may result. No one should swim alone. Guests must be aware of currents and tides at all time in the water. Guests will hold the Owners and KBHVR harmless from any and all bodily injury and/or property damage incurred in the house or on the property arising out of Renters' negligent acts or omissions.
MISSING ITEMS - Renters will be charged for any missing items reasonably attributable to Renters and not returned after notification. The cleaning service performs an inventory/survey of the property after Guests depart and notifies the Owner or KBHVR of any damage or missing items. Owner or KBHVR will notify guests in the event that items were inadvertently taken, and provide guests the opportunity to return the missing items.
JOINT AND INDIVIDUAL OBLIGATIONS: If there is more than one p a y i n g Occupant, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Occupant.

LIABILITY
1. Owner Insurance: Occupant's or guests' personal property, including vehicles, are not insured by Owner or KBHVR against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner does not insure against personal injury to Occupant or guests due to any reason other than the condition of the Premises.

3. Indemnity and Hold Harmless: GUEST agrees to indemnify, defend and hold harmless Owner, Owner's Representatives, KBHVR and KBHVRs representatives from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to GUEST or GUEST’S guests or their personal property. The Homeowner and KBHVR shall not be liable to Guest, or any other person for any death, injury, loss, or damage to any person or property on or about the premises. Guest shall hold Homeowner and Agent, harmless and indemnified from and against all loss or damage occasioned by the use or misuse or abuse of any part of or fixture on the premises and from or against any omission, neglect, or default of Guest, his guest, licensees or invitees.
Release of Liability
I understand that I am responsible for all damage, breakage and/or loss to the premises including household contents, furnishings, or equipment not caused by normal wear and tear or unavoidable casualties (deemed by the Owner/KBHVR) which may result from occupancy!
• Neither KBHVR nor the Owner will be held liable for any injury, loss or damage that may occur to Guest or their invitees, during occupancy in or on the property.
Guests also acknowledge that unit(s) do not have a landline telephone and a cell phone will be needed to call 9-1-1 in case of emergency.

Accidental Rental Damage Insurance

Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.
