Vacation Rental Agreement
This is your short-term vacation rental agreement. This agreement outlines everything you need to know about our rental policies for our property. Our goal is to ensure that your stay at our property is wonderful and meets all of your expectations. Please let us know immediately if you have any issues during your stay and we will do our best to get it resolved in a timely manner. Rental Agreement: This Agreement constitutes a contract between the Guest (you, your) and Agent (us, we, our) of the Vacation Rental Property located at 5957 Windy lane Port St. Joe, Florida 32456. By signing this agreement, you and your guests are agreeing to all terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property.
Age Requirement Policy: The name on this agreement must be an adult who is at least 25 years old (Proof of age is required) Violation of this policy will result in immediate eviction with NO refund.
Payment: An advance payment equal to 50% of the rental rate is required at the time of booking. The advance payment will be applied toward the rent. Please make payments via credit card.The balance of rent is due 60 days before your arrival date. Reservations made less than 60 days prior to arrival require Full payment at the time of booking.
Acts of God/Other Events: In the event of a mandatory evacuation or other events beyond our control which restrict access to the property, every attempt will be made to accommodate our guest in other properties managed by VIP Vacation Properties. There are NO refunds for severe weather including hurricanes, hurricane evacuations, and tropical storms. It is highly recommended, but not required, that you purchase travel insurance. It is up to you to purchase the insurance, it is not our responsibility.
Travel Insurance Provided by TRAVEL GUARD: Every year, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp).

Accidental Damage Protection: Accidental damage protection is included and NOT (Optional) on ALL reservations for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000.00. Any damage or accidents exceeding $3,000.00 the Renter will be responsible for.
**The purchase of the insurance still requires you to follow the Check-out instruction list provided to you. The Renter will receive a Departure email 48 hours before Check-out. (Please be sure to check your spam box) The property also has a House Menu with a QR-Code that provides all Check-out instructions.(Please be sure to follow the check-out instructions properly)
Maximum Occupancy: The maximum number of guests is 16 (babies in cribs not included). If you are found in breach of this contract, you will be evicted and NO money will be refunded. Only people who have registered with us as a guest may stay overnight on the property.
Elevators: Some of our properties have elevators in the unit and specific instructions are provided for your safety and convenience. Elevators are to be operated by adults only. Misuse of an elevator may result in serious injury or death. If a service call is required due to misuse, a fee of $100.00 will be charged. Elevators may experience outages and refunds will not apply if the elevator is not in service during the time of occupancy.
Internet: All properties are equipped with WIFI; however, no refunds will be given for service interruptions.
Smoking Policy: Smoking is strictly prohibited inside all vacation homes. “Inside” also applies to any area enclosed by screens. Additional charges will be incurred for cleaning and deodorizing if any evidence of smoking is found in the property. You will be charged a fee of $500.00. There are no exceptions to this policy.
Open Flame: No candles or any open flame are allowed inside the property.
Pet Policy: Properties that are pet-friendly will be advertised accordingly. A two (2) pet maximum is strictly enforced unless otherwise noted on your reservation. All pets must be declared in advance of arrival. If pets are found in a home that prohibits pets, the guest will be required to vacate immediately and will be charged a $500.00 non-refundable fee, the guest will not be refunded for any rental rates either. All pet waste must be cleaned up immediately by the renter and any failure to do so will result in additional fees at the agent's discretion.
*Pets are not allowed on the furniture. If evidence of pets are found on the furniture, an additional minimum cleaning fee of $250.00 will be charged to the renter.
*If fleas are present after check-out, renter may be charged an additional extermination fee.
*The cost of any damage caused to real or personal property of a rental by any pet of the renter or renters party shall be charged accordingly.
Grills: A Grill is provided for your use, Please be sure to review the property’s description for a better understanding on the type of grill provided. Each of our properties have different types of grills such as Gas or Charcoal. Grills may not be moved from their designated location. For properties that have a gas grill we do provide a tank but DO NOT provide propane. If you are having any issues with a grill during your stay please contact our office at 850-890-0231.
Garbage: Each property is equipped with tan (BCC waste solutions) garbage cans. Please be sure that all trash is put inside of the can. Please refer to your (Access Email or House Menu for trash pick up dates. If the renter does not follow instructions on proper trash pick up dates and additional trash pick-up is required the renter may be charged an additional fee due to non-compliance.
Community Pools: Homes that advertise a community pool as an amenity are subject to availability as determined by the managing authority responsible for the care of the pool and not VIP Vacation Properties. Community pools do not include pool heat. Please be sure to follow any and all rules posted.
Beach: Public access and easements are available to accommodate guests who are not staying in a beachfront home. Beach access is subject to availability and may be impacted by beach restoration, engagement by public works or other unforeseen events, VIP Vacation Properties does not offer refunds or discounts for limitations to beach access or use.
*Glass is NOT allowed on the beach.

Utilities: No compensation will be given for temporary outages of electricity, gas, water, cable, satellite or phone service. Utility service outages should be reported immediately and all efforts will be made to have them restored as soon as possible. In the event an outage can not be restored, VIP Vacation Properties has the right to substitute rental properties and move the renter for the remainder of the reservation or until the outage has been fully restored.
Housekeeping: Your vacation home will be cleaned prior to your arrival. Please call us immediately upon arrival if you are not satisfied with the cleanliness. The cleaning fee charged that the time of your booking does not include daily or mid-week cleans it only includes the property being cleaned after departure. If you choose to have a mid-week clean please contact our office and we will schedule accordingly. Additional cleaning fees will be charged.

Arrival Inspections + Damages: Please complete an arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported immediately to us.
Arrival and Check-in: Check-in is 5:00 PM local time "Eastern" on your scheduled arrival date. Check-in before 5:00 PM is not guaranteed. You will receive an email with the (Property access information) 72 hours prior to check-in. (Please be sure to check your spam box).
Departure and Check-out: Check-out is 10:00 AM local time "Eastern" on your scheduled departure date. Check-out is strictly at 10:00 AM. If you or anyone in your party is not out by the designated check-out time an additional fee of $100.00 will be charged. You will receive a Departure email 48 hours prior to your check-out date and it will include proper check-out instructions. You can also refer to the QR-code located on the House menu.
Parking: Parking is limited to 9 cars. You must park in designated parking areas only (Carport, Drive way of the property)
Criminal Activity: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.
Indemnification: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.
Governing Law: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.
Severability: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.
Falsified Reservations: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.
Insurance: You are expressly Excluded from ANY insurance policy held by VIP Vacation Properties, LLC. and or the Property owner. You understand that it is suggested that you carry renter's insurance to cover your personal belongings.
Acknowledgement: You have read and agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only.
