The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. During high season, all efforts are given to ensure that the house is ready by 3 p.m. Occasionally, due to the conditions that the house is left in; it may not be ready by 3 p.m., and your patience is appreciated.

GROUPS ARRIVING AT DIFFERENT TIMES:
The registered guest is the designated Check-In-Party and we encourage you to be the first person at the property. It is the booking guest's responsibility to coordinate all parties arriving separately and see to it that they have the necessary information. Please report any insufficient and/or broken items at the time of the arrival to prevent additional charge to your lease at 1 (573) 427-7245.

SECURITY:
In lieu of a Security Deposit, your credit card will be held on file. If there are damages to this unit during your stay, we will send you an invoice for the damages along with the amount that was charged to your credit card. If your credit card declined, you will be asked to pay by other resources. If not paid, we will seek further actions. You will be held RESPONSIBLE FOR ALL DAMAGES by Credit Card at the end of this online booking process. The balance of rent and any other fees are due 60 days before you arrive. This information will be emailed to you. If you are booking this within 60 days of arrival, the total amount is due at the time of booking.

INCLUSIVE FEES:
Rates include a one-time linen setup fee and a cleaning service fee is required before the reservation can be confirmed. There is NO DAILY MAID SERVICE. Guests will need to provide their own paper items and cleaning supplies. An initial set up of trash liners and toiletries are provided. Extra items needed are the responsibility of the guest. (i.e. bring your tooth paste, laundry detergent, soap, beach towels, extra toilet paper, etc.)

EVENT FEE:
If a property is used for an event, an "Event Fee" of $500 in addition to the normal rent rate is required before reservation can be confirmed. An "Event" must be approved by the owner prior to confirming a reservation. Below applies to "Event" but not limited to:

If the "Event is planned for more than the maximum occupancy allowed per property, below applies.

If a property is used for an "event" as described above, or a similaar event has occurred while under this lease agreement, and in which no event fee was paid, the tenant will be required to pay such fee ($500) plus pay a penalty of $150 for each infraction that was not abided by in a description.

DAMAGES:

Any damage noticed upon arrival should be reported to the owner immediately. If damage is not reported, your credit card may be charged for the cost of the repair. All general maintenance should also be reported so the unit can be kept in good repair. In order to prevent additional charge, the following must occur:

SEVERE WEATHER:
We do not refund rents or deposits lost due to cancelled, shortened stays, or utilities disruptions because of weather. Departures due to inclement weather do no warrant refund of rent or deposit.

Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. PETS POLICY:
No pets are allowed without prior approval from the owner. It is the guests responsibility to receive approval, prior to confirming a reservation. If approved there will be a $250 nonrefundable fee. If any evidence of a pet found on the premises without owner approval, you will be potentially asked to vacate immediately with no refund of rents paid and/or a $100 penalty. You will be responsible for any damages (labor & materials). House owners assume no responsibility for illness or injury that may incur to pets or humans, while on premises.

PET RULES to apply if approval allowed: No pets allowed on any hardwood floors (applies to all properties), furnitures, and linens. Pet must be kept on a leash, crated if left alone in the house. All waste must be cleaned from property and disposed of in the dumpster.


COMMUNITY RULES:
Guest agree to abide by rules of the community. ”Beach Stop II” was designed for the QUIET enjoyment of our guest and NOT to be used for parties, large gathering or receptions beyond the sleeping capacity of the home. Please refer to Event Fee when applies. "Disturbing the Peace" may result in eviction and/or loss of security and/or other charges. Please do not play LOUD music. Local neighbors do not appreciate it. This is considered trespassing and authorities will be called. The capacity of the home as stated on the rental agreement and the parking capacity cannot be exceeded.

GRILLS:
A charcoal grill is available at this house. Local Fire regulations prohibit the use of charcoal grills on the wooden deck surface. Please use the charcoal grill on the concrete/rocks, if you would like to grill your food.

MINIMUM STAY:
This unit has a 3 or 7 day minimum stay required (varies depending on season). Exceptions due to special events may apply. If you have a question about a shorter stay please contact the owner direct.

UTILITIES:
The landlord will provide water, heat, electric, and trash removal. INTERNET IS AVAILABLE. “Beach Stop II” provides FREE Wi-Fi is picked up from local internet access. Cell reception is clear.

UTILITY SERVICES:
No refund will be made for interruption in service beyond our control.

ACCOMMODATIONS:
2 (two) kings, 3 (three) queens, 1 (one) full, 2 (two) queen sleeper sofas, 2 (two) twin sleeper sofas. 5 (five) full bathrooms. LESSEE supplies linens for beach use.

MAXIMUM NUMBER OF OCCUPANTS:
The house is to be occupied by no more than 18 (eighteen) persons at a maximum. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. VIOLATION OF THIS PROVISION SUBJECTS GUEST TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM SUMMER VACATION RENTAL.

FALSIFIED RESERVATIONS:
Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
LESSEE assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
LESSEE assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).
LESSEE agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
LESSEE and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
LESSEE agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
LESSEE agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the LESSEE, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.
LESSEE agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.
Upon not less than 24 hours notice, LESSEE shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants.
In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from LESSEE.
LESSEE may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.
If LESSEE abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.
In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.
Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.
The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures.
LESSEE assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the LESSEE.
PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION. VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEWER. THEREFORE, IN THE EVENT GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FIFTEEN PERSONS, GUEST SHALL BE RESPONSIBLE TO PAY LESSOR.THE-SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF FIFTEEN PERSONS PER DAY FOR EACH DAY THE GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FIFTEEN PERSONS.

CANCELLATION POLICY:
Travelers who cancel at least 14 days before check-in will get back 100% of the amount they've paid. If they cancel between 7 and 14 days before check-in, they'll get back 50%. Otherwise, they won't get a refund.

CREDIT CARD AUTHORIZATION:
I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by "clicking" that I have read the terms and conditions of this property, I am bound by this agreement and I have signed "electronically", and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but are not limited to: satellite TV charges; damages beyond normal wear and tear.

FEATURES AND FURNISHINGS:
The following is a list of basic items you will find in “Beach Stop II” : Heat & A/C, refrigerator, stove, microwave, toaster, coffee maker, basic pots & pans, dishes, flatware, utensils, Color TV(s), DVD player(s), iPod FM/Alarm Clocks, fire extinguishers & smoke detectors, bed linens, pillows, towels, washcloths and bath mats along with dish soap, and paper goods to meet the home's maximum occupancy. Items that are NOT SUPPLIED typically include beach towels, charcoal, laundry soap, plastic wrap, foil, coffee filters, condiments, spices or any type of food item.

TELEVISION, STEREO, CD, DVD, & GAME CONSOLES:
We assume no responsibility for TV reception or operation and cannot guarantee that specific channels will be available. Television or DVD, CD, or VIDEO GAME wiring must not be changed to facilitate its use. Everything is in place and programmed for your convenience and enjoyment. Please consider the next guest by not disconnecting any wires, or changing any programming on the remotes, so that they have problems with the electronics. Digital remote in the living room is $500 if damaged. Charger and components are located under the stairwell. Please be caution with high technology, this could result in expensive charges when damaged.

RATES AND SEASONS:
This property is a Daily Rental, 3 or 7 minimum night stay required (varies depending on season). Event Fee are $500, please refer to EVENT FEE above.

We offer seasonal rates and holiday rates. Please refer to check-in and check-out booking and review to find out the rates of the dates you select.

Reservations may be booked up to eleven months in advance. 3 or 7 nights minimum is required (varies depending on season), unless otherwise noted. Price amenities, and/or minimums are subject to change with or without notice. THE RENTAL PRICE IS DETERMINED BY THE RENTAL AGREEMENT AT THE TIME OF MAKING THE RESERVATION. NO REFUNDS OR ADJUSTMENTS WILL BE MADE FOR RATE CHANGES MADE AFTER THE DATE THE RESERVATION IS MADE.

PARKING:
“Beach Stop II” provides ample parking.

HOUSEKEEPING & LINEN SUPPLIES:
We provide bed linens; sheets, pillowcases, 1 blanket & bedspread per bed, bath towel per person, wash cloths and shower mats for the occupancy of the unit along with starter supply of dish soap, toilet paper and paper towels (laundry soap is not provided). The house is cleaned, sanitized, and beds (except sofa beds) are made prior to your arrival. Daily maid service is not provided and guest is expected to launder towels, etc. as needed during their stay. It is not necessary to wash towels or bed linen prior to departure. It is a good idea to bring a beach towel for swimming use.

TRASH REMOVAL:
All trash is to be removed by tenants and carried to the trash dumpster from the house at the end of each reservation. Please do not allow outside containers to overflow due to animal problems. Weekly trash removal is provided.

INSECTS/PEST:
“Beach Stop II” is sprayed regularly by a professional pest control company, ladybugs, wasps, other insects that visit the home.

MAINTENANCE:
As the property owners, we do everything possible to keep all equipment in good working order. However, it is impossible to guarantee that all appliances, hot water heaters, etc. will be in working order 100% of the time. We do guarantee to make every effort to correct all deficiencies as soon as possible during normal business hours. Report all maintenance problems to us at 1 (573) 427-7245 or 1 (251) 209-0074. If it is after hours, please be certain to leave your phone number and the nature of the problem with the answering machine. You should take reasonable action to secure the problem. Management reserves the right to perform exterior and/or interior maintenance during your stay. In the event maintenance must be performed, we will do our best to do so without inconvenience to you. Your silence indicates full acceptance of the house and its condition.

GULF OF MEXICO:
Please use with caution in the waters of Gulf of Mexico. All persons using the water area do so at their own risk and sole responsibility. KIDS MUST BE SUPERVISED AT ALL TIMES. Owners assume NO responsibility for any accident or injury in connection with such use. Persons using the water areas agree with the owners for and in consideration of the use, to make no claim against the owners for or on account of any loss of life, personal injury, or damage to or loss of personal property.

FIRE:
“Beach Stop II” is not permitted the use of fireworks and/or campfires.

SMOKING:
“Beach Stop II” is a non-smoking property. There is no odor of smoke in this house, so please do not smoke inside. If the interior of the cabin has the smell of smoke after your visit, you will be charged $250 for Odorize to get rid of the smoke odor inside the house, so please utilize the porches, and outside areas in consideration of our non-smoking guest. Please do not discard smoking materials on the grounds. If found, additional charges will be added.

““Beach Stop II” is equipped with residential telephone service and it is FREE long distance anywhere in the United States. It is also important that you leave your cell phone number for the home with relatives and emergency contacts. There is mail service to our home. LOST AND FOUND & PERSONAL PROPERTY:
We, property owners, are not responsible for personal property left behind, stolen or damaged during your stay. Never leave valuables (cash, wallets, jewelry, cameras, etc.) unattended. If you find you have left something behind, call us and we will try to locate the missing item (s). If the item(s) is located it will be returned to you COD. Items unclaimed more than 14 days will be disposed of or given to charity.

KEYS:
Key code for the property will be emailed to you. The lock code combination will change after each visit. You will be emailed the code 48-24 hours in advance. If you forget your code number, you may call us at 1 (573) 427-7245.

CONTRUCTIONS, TRAFFICS & DIRECTIONS:
The Gulf Shores/Fort Morgan Area is growing rapidly and therefore it is necessary to plan for alternate routes to avoid traffic delays. Check with MapQuest for alternative directions.

CHECK-OUT PROCEDURES:
We know you are on vacation and we do appreciate your business. We do have to ask that you abide by our check-out procedures. The main reason for this is so we can get the house ready for the next guest(s). They arrive only hours after you leave. If you leave the house in great shape, the next guest(s) can have access to the unit on time. We really appreciate you following these procedures.

  1. Please leave any key(s) (if any) in the lock box and lock all the doors/windows.
  2. Take ALL trash, including bathrooms/bedrooms to the bins outside the unit.
  3. Wash ALL soiled dishes and run dishwasher.
  4. Wipe down kitchen, including the oven/microwave.
  5. COMPLETELY empty the refrigerator/freezer. Turn out ALL lights.
  6. Please leave all used beds unmade, but remove sheets from sleeper sofas leaving the mattress pads on unless soiled before closing the sofa.
  7. Make sure ALL extra pillows/blankets, remote controls, etc are back in place.
  8. Bring all used towels to the laundry room
  9. Make sure the décor, indoor and outdoor furniture is in it’s original position, stacked up, or lined up correctly.
  10. Set thermostat to 72°F in the summer, 68°F in the winter.

Most of our guests follow all of these rules very nicely, but for the few that do not, this is NOTICE that a $100 fee per incident or per hour which ever applies will be charged to your credit card.

Please leave the home neat and orderly to avoid additional charges. If the cleaning crew finds that the house has been left excessively dirty, you will be billed. The cleaner we find it, the faster we can turn it over to the next guest.

This lease is between the Lessee or Guest and Werner Property Management, LLC or LESSOR. Werner Property Management, LLC is the management company that operates this house.
