Please print these Terms and Conditions for your records.
The property will be ready for occupancy at 4:00 PM local time (Eastern Time Zone) on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. During high season the cabin may not be ready by 4 p.m., your patience is appreciated. In some cases (if there are not back to back bookings) the cabin may be available for early check-in or late checkout. Please email or call us to see out if that is a possibility
RESERVATION PROCESS AND SECURITY/DAMAGE DEPOSIT:
A reservation deposit/initial payment in the amount of $350 is payable at the time this lease is booked. You will be asked to pay the deposit/initial payment by Credit Card at the end of this online booking process. We will keep your credit card on file and we will have up to 45 after checkout to charge your credit card for any non-accidental damages or excessive cleaning fees not covered by the damage insurance. As an added convenience we have included a non-refundable $49 damage insurance to cover any accidental damages. A $300 damage/security deposit fee is due for any reservation not using a credit card. This must be received 7 days after booking (this will be cashed and held as a security deposit). If you pay by check this will be refunded to you within 14 days after checkout and after final housekeeping inspection. The balance of the rent is due 30 days before you arrive (60 days for Thanksgiving and Christmas holidays). You can mail a check for the balance or pay by credit card. Information will be e-mailed to you with the address for mailing the balance or you may pay online. There will be a link in the e-mail for online payment. A reminder e-mail will be sent 5-7 days before your last payment is due. Finally an e-mail will be sent with the balance owed and the opportunity for online payment with you credit card. If you are booking this within 30 days of arrival, the total amount is due at time of booking. After receiving the final payment, an e-mail will be sent with access information for the cabin, including the address, directions, and information about the key code to access the cabin.
Accidental Rental Damage Insurance

Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

Any damage noticed upon arrival should be reported to the owner immediately. If damage is not reported, your credit card may be charged for the cost of the repair. All general maintenance should also be reported so the unit can be kept in good repair. In order to avoid any extra charges, the following must occur:
If deposit was collected it will be refunded within two weeks of your departure if these terms are fulfilled.
CANCELLATION POLICY:
Cancellations made 30 days or more (60 days for Thanksgiving and Christmas/New Years) of arrival will receive full refund of the deposit less a $100 cancellation fee and the travel insurance (if purchased). If you cancel less than 30 days (60 days for Thanksgiving and Christmas/New Years) prior to arrival, there will be no refund unless we are able to rebook your cancelled days. The amount of the refund will be at the rebooked rate minus the $100 cancelation fee and the cost of the Travel insurance if purchased. We strongly encourage you to consider travel insurance in case of unforeseen emergencies. This is available to purchase on Ivacationonline when you reserve our cabin.
No refunds will be given due to bear sightings. This is the mountains and bears do live here. We suggest you refer to our bear safety tips we have posted at the cabin and in the information on bears facts provided in the "links". No refunds due to closing of the National Park.
No refunds will be given for adverse weather condition. The Smoky Mountains occasionally have snow accumulation so please anticipate this in your plans if scheduling in the winter months. During the times of inclement weather you may want to consider a 4-wheel drive vehicle or chains. No refunds for early departures. Cable TV, internet service outage, electrical outage, or temporary loss of water will not entitle the guest to a refund.
Inclement Weather Policy:
Departures due to inclement weather do no warrant refund of rent or deposit. We do not offer any refunds for inclement weather such as snow or ice. We highly recommend getting TRAVEL Insurance for your trip. It is up to the Guest to purchase this coverage for their trip. Coverage is available for health and weather related problems. Please call them direct or order online to purchase this in your name. Travel insurance may cover a traveler’s vacation investment if severe weather conditions directly affect their travel arrangements or accom­mo­dations.
Travel Insurance is available on this site and we highly recommend you purchase it.

ABSOLUTELY NO SMOKING INSIDE CABIN:
No exceptions. Any evidence of policy violation will result in full loss of deposit or $300 charged to your credit card.
ABSOLUTELY NO PETS:
No Pets are permitted in cabin under any circumstances, NO EXCEPTIONS. If any evidence of a pet(s) is found on the premises, you will be asked to vacate immediately and $300 will be charged to your charge card for removal of pet dander.
MINIMUM STAY:
This unit has a 3-night minimum, 5 nights for major holidays (Thanksgiving, Christmas/New Years) and 4 nights for other holidays. If you have a question about a longer stay please contact the owner directly. Stays of 2 nights will be considered during slow season with a cleaning fee of $95.00.
INCLUSIVE FEES:
Rates include all linens, setup and cleaning service at the time of departure. There is NO DAILY MAID SERVICE. Supplied items: linens for 2 queen beds, queen sofa sleeper (located in bottom drawer of chest downstairs bedroom), pac-n-play and sheets kept inside pac-n-play, 3 blankets, 6 pillows, 2 towels and 2 washcloths per guest , 2 hand towels per bathroom, 2 dishcloths, 2 dishtowels, dishwashing liquid, automatic dishwasher detergent, bath soap, 1 roll toilet paper for each bathroom, 1 roll paper towels, and trash can liners. We also provide an iron and ironing board, and emergency kit. Extra items are the responsibility of the guest. (e.g. bring your toothpaste, laundry detergent, extra soap, beach towels, extra toilet paper, charcoal, etc.)
UTILITIES:
The landlord will provide water, heat, electric, and trash removal.
RESTRICTIONS:
No trailers, motor homes or campers.
ACCOMMODATIONS:
Two queen beds, one queen sofa sleeper and one pac-n-play.
HOT TUB:
No food, drinks, soaps, bubble bath, glass or bath oils in the hot tub. You will be charged $150 for excessive cleaning. Do not lean, walk, stand or lie on the hot tub cover. Do not have sharp objects close to the hot tub. You will be charged $350 to replace the hot tub cover. Follow directions for use of using the hot tub lift (posted on wall next to hot tub).
LEFT OR LOST ITEMS:
We are not responsible for any items left behind, lost or stolen. If you realize you left something, please call and we will make every attempt to ship it to you. The funds will be charged to your credit card.

INTERNET ACCESS:

Access is for legal usage only.Guests will accept full and sole responsibility for enforcing legal internet activity for duration of the rental agreement. Using internet service to engage in any form of copyright infringement is expressly prohibited by our internet carrier’s “Acceptable Use” policy and we can be fined for illegal downloads. If there are illegal downloads or copyright infringements during your stay, our internet carrier will notify us with the exact dates and times of the illegal activity. Copyright infringements or violations of any other internet carrier’s policy may result in charges per violation when reported by our service provider. We reserve the right to seek additional damages in case of a law suit or any other financial penalty against the owner caused by these violations.
MAXIUM NUMBER OF OCCUPANTS:
The house is to be occupied by no more than 6 (six) persons at a maximum. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. VIOLATION OF THIS PROVISION SUBJECTS GUEST TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM VACATION RENTAL.
FALSIFIED RESERVATIONS;
Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
GUEST assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
GUEST assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).
GUEST agrees that any tenant who is found using illegal drugs or allows others to use illegal drugs on the premises will be immediately denied continued occupancy at these premises.
GUEST and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
GUEST agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
GUEST agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the GUEST, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.
GUEST agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.
GUEST shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants.
In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from GUEST.
GUEST may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.
If GUEST abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.
In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.
Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.
The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures.
The renter/guest accepts renting privileges with the understanding the he/she does hereby release Glenn/Vickie Hill of all liability for loss or damage to property and injury, against claims resulting from loss or damage to property or injury to the person of any member of the family or guest of the registered renters arising out of the use of the cabin.
GUEST assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the GUEST.
PAYMENT:
We accept payment for balance of rent with personal check, MasterCard or Visa. If a personal check is returned for non-sufficient funds, fees will be added based on the amount charged by the bank. Rates, terms, and conditions are subject to change without notice.
CREDIT CARD AUTHORIZATION:
I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by "clicking" that I have read the terms and conditions of this property, I am bound by this agreement and I have signed "electronically", and that this Credit Card Authorization cannot be revoked and will not terminate until 45 days after leased premises are vacated. Charges may include but not limited to: damages beyond normal wear and tear; excessive cleaning, and missing linens.
